05-20-1991 Minutes91-197 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS MAY 20, 1991 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, May 20, 1991, at 4:00 p.m. There were present: Mayor Stephen C. Ryan, Chairman presiding Commissioner Carol E. Beggs Commissioner Peter F. Brungardt Commissioner John Divine Commissioner Joseph A. Warner comprising a quorum of the Board, also present: Greg Bengtson, City Attorney Dennis M. Kissinger, City Manager Jacqueline Shiever, City Clerk Absent: None CITIZEN FORUM Mary Anderson, President of USD 305 Board of Education, read a letter from the School Board supporting the City Commission's continuing cable negotiations and enhanced cable service. AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed the Week of May 19 through 25, 1991 as "NATIONAL PUBLIC WORKS WEEK." The proclamation was read by Bill Armstrong, Engineer with Bucher, Willis and Ratliff. (4.2) The Mayor proclaimed the Week of May 19 through 25, 1991 as "NATIONAL ASSOCIATION OF INSURANCE WOMEN." The proclamation was read by Brenda Smith, Vice President Elect, Insurance Women of North Central Kansas. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting May 13, 1991. DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission that Planned Development District Application 89-1C, filed by Sunset Plaza, Inc., for the rezoning of Lot 4, Block 8, Sunset Manor Addition to the City of Salina, (aka 817 Osage) to District PDD, be approved. (Introduce Ordinance 91-9444 for first reading.) Roy Dudark, Director of Planning and Community Development, reviewed the application for an extension of the existing Soil Conservation Service parking lot. Lenora McCall, 821 Osage, said she is opposed to the parking lot expansion and feels it will devalue her property. Moved by Commissioner Brungardt, seconded by Commissioner Warner that the recommendation of the City Planning Commission be accepted and Ordinance 91-9444 providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof, be introduced for first reading. ADMINISTRATION (8.1) Second Reading Ordinance Number 91-9441 establishing the membership of the Salina Business Improvement District Number 1 Board of Advisors, amending Section 6 of Ordinance Number 83-8979 as amended by Ordinance Number 87-9172; and repealing the existing Section 6. Dennis Kissinger, City Manager, said staff received one letter regarding the Attorney General's opinion relating to City Commissioners sitting as voting members on other boards and commissions. Moved by Commissioner Warner, seconded by Commissioner Beggs that Ordinance Number 91-9441 establishing the membership of the Salina Business Improvement District Number 1 Board of Advisors, amending Section 6 of Ordinance Number 83-8979 as amended by Ordinance Number 87-9172; and repealing the existing Section 6, be adopted. (8.2) Second Reading Ordinance Number 91-9442 repealing Division 2 of Chapter 2 of the Salina Code regarding the Arts Commission; amending Section 2-162 of the Salina Code regarding membership of the Salina Arts and Humanities Commission; and repealing the existing section. Moved by Commissioner Beggs, seconded by Commissioner Divine that Ordinance Number 91-9442 repealing Division 2 of Chapter 2 of the Salina Code regarding the Arts Commission; amending Section 2-162 of the Salina Code regarding membership of the Salina Arts and Humanities Commission; and repealing the existing section, be adopted. (8.3) Second Reading Charter Ordinance 26 amending Section 3 of Charter Ordinance 22 concerning the membership of the Convention and Tourism Committee; and repealing the existing section. Moved by Commissioner Brungardt, seconded by Commissioner Beggs that Charter Ordinance 26 amending Section 3 of Charter Ordinance 22 concerning the membership of the Convention and Tourism Committee; and repealing the existing section, be adopted. Aye: Beggs, Brungardt, Divine, Warner, Ryan. (5) . Nay: (0) . Motion adopted. (8.4) Second Reading Ordinance Number 91-9443, providing for the construction of certain sidewalks; for the payment of the cost thereof and how the same shall be assessed; and the manner of the payment therefor. (Engineering Project 91-830, Ellsworth Sidewalk) . Dennis Kissinger, City Manager, explained the Ordinance describes the four properties for which a permit has not been issued. Moved by Commissioner Warner, seconded by Commissioner Brungardt that Ordinance Number 91-9443, providing for the construction of certain sidewalks; for the payment of the cost thereof and how the same shall be assessed; and the manner of the payment therefor, be adopted. Cox 91-203 91-204 91-205 91-206 91-207 91-208 (8.5) Consideration of Program Statements and Project Budget for Proposed Capital Improvements at Kansas State University - Salina, College of Technology. Roy Dudark, Director of Planning and Community Development, reviewed the seven proposed capital improvements to be funded by the local sales tax levy. Gerald Cook, President of the Salina Area Chamber of Commerce, thanked the Commissioners and staff for their support on this project. Moved by Commissioner Beggs, seconded by Commissioner Warner that the recommendation of staff be accepted and that the program statements and project budget for Kansas State University - Salina, campus development, be approved. Aye: (5) . Nay: (0) . Motion adopted. (8.6) Request for Executive Session. (City Manager evaluation and compensation) . Moved by Commissioner Warner, seconded by Commissioner Brungardt that the Board of Commissioners recess into executive session for 20 minutes for the purpose of discussing a personnel matter involving non -elected personnel for the reason that public discussion of the matter would invade the privacy of the non -elected personnel involved. The Board of Commissioners recessed at 4:40 p.m. and reconvened at 5:04 p.m. Moved by Commissioner Divine, seconded by Commissioner Warner that the City Manager's salary be increased by 3% effective on the anniversary date which is the same as the city employees on January 1, 1991. The Mayor invited the public to attend the Memorial Day services to be held at the Veterans Memorial.
