Ryan, Chairman presiding Commissioner Carol E. Beggs Commissioner Peter F. Brungardt Commissioner John Divine Commissioner Joseph A. Warner comprising a quorum of the Board, also present: Greg Bengtson, City Attorney Dennis M. Kissinger, City Manager Jacqueline Shiever, City Clerk Absent: None None None CITIZEN FORUM AWARDS - PROCLAMATIONS PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting June 3, 1991. None DEVELOPMENT BUSINESS ADMINISTRATION (8.1) Second Reading Ordinance Number 91-9445, ordering the condemnation and acquisition of fee simple title to certain real estate for use of the City of Salina, Kansas, for the purposes of a city vehicle fueling facility and utility distribution warehouse, pursuant to K.S.A. Chapter 26, and amendments thereto, as it relates to condemnation by cities, and further pursuant to Resolution Number 91-4298 of the City of Salina, Kansas. Moved by Commissioner Warner, seconded by Commissioner Divine that Ordinance Number 91-9445, ordering the condemnation and acquisition of fee simple title to certain real estate for use of the City of Salina, Kansas, for the purposes of a city vehicle fueling facility and utility distribution warehouse, pursuant to K.S.A. Kinn-Co Py^ g — Salina, Kansa{ 91-220 91-221 91-222 — 91-223 (8.2) First Reading Ordinance Number 91-9446, amending Section 25-28 of the Salina Code regarding resisting arrest, and amending Article II of Chapter 25 by adding Sections 25-29, 25-30, 25-31; and repealing the existing Section 25-28. Police Chief James D. Hill explained that this Ordinance clarifies actions of resisting arrest versus other actions such as giving false information. He said this Ordinance will allow officers to charge offenders with specific violations rather than the broad application of resisting arrest. Commissioners and staff discussed the matter. Moved by Commissioner Divine, seconded by Commissioner Warner that Ordinance Number 91-9446, amending Section 25-28 of the Salina Code regarding resisting arrest, and amending Article II of Chapter 25 by adding Sections 25-29, 25-30, 25-31; and repealing the existing Section 25-28, be introduced for first reading. Aye: (5) . Nay: (0) . Motion adopted. (8.3) First Reading Ordinance Number 91-9447, amending the Salina Code by enacting Section 25-8, prohibiting fortune telling, palmistry and craniology. Chief Hill explained this Ordinance is a precautionary measure to prohibit fradulent activity in Salina. Moved by Commissioner Beggs, seconded by Commissioner Brungardt that Ordinance Number 91-9447, amending the Salina Code by enacting Section 25-8, prohibiting fortune telling, palmistry and craniology, be introduced for first reading. Aye: (5) . Nay: (0) . Motion adopted. (8.4) First Reading Ordinance Number 91-9448, amending Section 30-18 of the Salina Code regarding merchant police vehicles; and repealing the existing Sections 30-18, 30-19, 30-21 and 30-23. Chief Hill explained that this Ordinance requires merchant police vehicles to be marked differently than police vehicles; removes private security services from the public safety radio channel; removes the requirement that merchant police employees who carry firearms be certified by the Chief of Police; and removes the requirement that any licensee who acquires a new vehicle for merchant police use shall immediately report same to the City Clerk. Moved by Commissioner Beggs, seconded by Commissioner Brungardt that Ordinance Number 91-9448, amending Section 30-18 of the Salina Code regarding merchant police vehicles; and repealing the existing Sections 30-18, 30-19, 30-21 and 30-23, be introduced for first reading. Aye: (5) . Nay: (0) . Motion adopted. (8.5) Request from Salina Downtown, Inc. to close Santa Fe Avenue on Wednesday, June 26, 1991 for the "Interstate Batteries Great American Race." Judy Ewalt, Coordinator of Salina Downtown, Inc., provided background on this event. Clarke Sanders, Great Race Chairperson, explained that volunteers are doing a lot of work, but City services will be required to support this event. Moved by Commissioner Brungardt, seconded by Commissioner Warner that the request from Salina Downtown, Inc. to close Santa Fe Avenue on Wednesday, June 26, 1991 for the "Interstate Batteries Great American Race". be approved. Aye: (5) . Nay: (0) . Motion adopted. 91-224 91-225 (8.6) Resolution Number 91-4307, providing for cooperation in development and operation of housing for low income families. Abner Purney, Director of the Housing Authority, explained that the Authority has applied for federal funding to construct 10 low income housing units. These units would be titled to the City and would be exempt from any property taxes or future special assessments. Moved by Commissioner Divine, seconded by Commissioner Warner that Resolution Number 91-4307, providing for cooperation in development and operation of housing for low income families, be adopted. Aye: (5) . Nay: (0) . Motion adopted. OTHER BUSINESS Robert Sinclair, 1101 North 12th Street, spoke to the Commissioners about problems along Dry Creek. He said the mosquitoes are terrible and though the City -County Health Department has sprayed, it didn't do any good. He also said that a fence across Dry Creek is holding back trash. Mayor Ryan explained that the entire Dry Creek area was being investigated by staff and a resolution to many of the problems in this area is expected soon.
