08-05-1991 Minutes91-329 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS AUGUST 5, 1991 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, August 5, 1991, at 4:00 p.m. There were present: Mayor Stephen C. Ryan, Chairman presiding Commissioner Carol E. Beggs Commissioner Peter F. Brungardt Commissioner John Divine Commissioner Joseph A. Warner comprising a quorum of the Board, also present: Absent: Dennis M. Kissinger, City Manager Jacqueline Shiever, City Clerk Greg Bengtson, City Attorney None CITIZEN FORUM AWARDS - PROCLAMATIONS Mayor Ryan introduced foreign exchange students from Japan with the Labo Group, a 4-H sponsored exchange program. The Mayor presented a Key to the City to each of them at the Study Session. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Special Meeting July 29, 1991. (6.2) Set the date of September 3, 1991 to receive bids for Engineering Project No. 91-838 for the Iron Avenue Water Main Improvements. (6.3) Set the date of August 27, 1991 to receive bids for Engineering Project 91-840 for a Park Storage Building. The City Commission and staff discussed the scope of the specifications. Motion adopted. 91-330 91-331 91-332 — 91-333 None DEVELOPMENT BUSINESS ADMINISTRATION (8.1) Second Reading Ordinance Number 91-9456, providing for the vacation of the west two and five tenths feet (2.51) of a twenty foot (20' ) utility easement along the east side of Lot Seven (7) , Block Fourteen (14) , Georgetown Addition to the City of Salina, Saline County, Kansas. Moved by Commissioner Beggs, seconded by Commissioner Brungardt that Ordinance Number 91-9456, providing for the vacation of the west two and five tenths feet (2.51) of a twenty foot (20') utility easement along the east side of Lot Seven (7) , Block Fourteen (14) , Georgetown Addition to the City of Salina, Saline County, Kansas, be adopted. (8.2) First Reading Ordinance Number 91-9457, levying special assessments against certain lots and pieces of property to pay the cost of cutting weeds on certain lots and parts of lots and the parkways abutting thereon in the City of Salina, Kansas. The City Commissioners asked about the process of notification. Jacqueline Shiever, City Clerk, reviewed the procedures for notifying the property owners, abating the nuisances, and assessing the property owners for the mowing. The Commissioners and staff discussed the process for special assessments for abatement of nuisances. Moved by Commissioner Divine, seconded by Commissioner Beggs that Ordinance Number 91-9457, levying special assessments against certain lots and pieces of property to pay the cost of cutting weeds on certain lots and parts of lots and the parkways abutting thereon in the City of Salina, Kansas, be introduced for first reading. (8.3) First Reading Ordinance Number 91-9458, levying special assessments against certain lots and pieces of property to pay the cost of abatement of nuisances, located on certain lots and parts of lots in the City of Salina, Kansas. Jacqueline Shiever, City Clerk, explained that these assessments are for clean-up of property. Moved by Commissioner Brungardt, seconded by Commissioner Warner that Ordinance Number 91-9458, levying special assessments against certain lots and pieces of property to pay the cost of abatement of nuisances, located on certain lots and parts of lots in the City of Salina, Kansas, be introduced for first reading. (8.4) First Reading Ordinance Number 91-9459, levying special assessments against certain lots and pieces of property to pay the cost of sidewalk repair located on certain lots and parts of lots in the City of Salina, Kansas. Moved by Commissioner Warner, seconded by Commissioner Brungardt that Ordinance Number 91-9459, levying special assessments against certain lots and pieces of property to pay the cost of sidewalk repair located on certain lots and parts of lots in the City of Salina, Kansas, be introduced for first reading. (8.5) Consider authorizing the sale of two lots in Eastgate Addition to the Salina School District. 91-334 91-335 91-336 91-337 Roy Dudark, Director of Planning and Community Development, explained that the Salina Area Vo -Tech School conducts an educational program to teach students home building skills and is interested in acquiring Lot 6, Block 2 and Lot 2, Block 3. The school district would pay the City $1.00 for each lot and general real estate and special assessment taxes due from August 1, 1991 to the end of the year. He said the school district and/or future homeowner would pay future specials equaling approximately $7,600 when fully paid which is a reasonable and fair price for the lots. Moved by Commissioner Warner, seconded by Commissioner Divine that the City Commission authorize the sale of Lot 6, Block 2 and Lot 2, Block 3, Eastgate Addition to the Salina School District for $1.00 each plus payment of all general taxes and special assessments due for 1991 beginning August 1, 1991. Aye: (5) . Nay: (0) . Motion adopted. (8.6) Consider proposed plan for disposition of a portion of Eastgate Addition. Roy Dudark, Director of Planning and Community Development, explained that staff has identified 14 lots in the northern portion of Eastgate Addition and recommended disposing of these lots by sealed bid on each individual lot with a 20% deposit required with each bid. He said this is 1 of 3 phases to sell the lots in Eastgate Addition and that the lots will be free and clear of special assessments. Moved by Commissioner Beggs, seconded by Commissioner Divine that the City Commission authorize the disposition of the identified lots in Eastgate Addition and set September 3, 1991 as the date to receive bids. Aye: (5) . Nay: (0) . Motion adopted. (8.7) Authorize repair of the Oakdale Park Memorial Entrance and Statue. Steve Snyder, Director of Parks and Recreation, reviewed the options of repairing or replacing the granite columns and archway entrance and recommended replacement. Staff recommended contracting with Cold Springs Granite Company for the replacement of the Oakdale memorial entrance and with Bergen's Sculpture Studio and Foundry for repair work on the Civil War soldier statue. The total cost of the project is expected to be $68,795. Settlement from the insurance company was $34,254, leaving a balance to the City of $33,241. Commissioner Divine asked that staff explore the possibility of selling or trading the old granite. The City Commission discussed landscaping and the possibility of civic group assistance. Moved by Commissioner Divine, seconded by Commissioner Warner that staff be authorized to repair the Oakdale Park Memorial Entrance and Statue in an amount not to exceed $68,795. Aye: (5) . Nay: (0) . Motion adopted. (8.8) Resolution Number 91-4350, setting September 16, 1991 for a Public Hearing on dangerous structures. Roy Dudark, Director of Planning and Community Development, explained that the Chief Building Official, Mike Peterson, has identified twenty (20) structures which need to be repaired or removed. Moved by Commissioner Brungardt, seconded by Commissioner Beggs that Resolution Number 91-4350, fixing a time and place to appear and show cause why certain structures should not be condemned and ordered repaired or demolished (setting September 16, 1991 for a Public Hearing on dangerous structures) , be adopted. K— Cox 91-338 91-339 91-340 91-341 (8.9) Resolution Number 91-4351, authorizing the Mayor to execute and the City Clerk to attest an agreement with New World Systems for cash register software in the amount of $8,000. Robert K. Biles, Director of Finance and Administration, explained that new cash registers are needed in the Water Department and that the purchase was included in the 1991 budget. He said parts are hard to find and maintenance costs are very high. Moved by Commissioner Warner, seconded by Commissioner Divine that Resolution Number 91-4351, authorizing the Mayor to execute and the City Clerk to attest an agreement with New World Systems for cash register software in the amount of $8,000, be adopted. (8.10) Resolution Number 91-4352, authorizing the Mayor to execute and the City Clerk to attest an agreement with CheckoutPlus for cash registers in the amount of $7,990. Aye: (5) . Nay: (0) . Motion adopted. (8.11) Petition 4014, filed by the City of Salina for the vacation of a portion of platted Ash Street west of the Dry Creek cutoff channel. Shawn O'Leary, Assistant City Engineer, reviewed an offer to purchase two tracts of land in this area recently. He said a title search revealed City ownership of both tracts clearing the way to sell them. He said by vacating this portion of Ash Street, the land can be sold as one large tract, and recommended offering the entire tract on a competitive bidding process. (8.12) Resolution Number 91-4353, giving notice of petition to vacate Ash Street. (The resolution sets August 19, 1991 for public hearing.) Moved by Commissioner Warner, seconded by Commissioner Divine that Petition 4014 be referred to the City Engineer for a recommendation and report and that Resolution Number 91-4353, directing public notice of application for vacation of a portion platted Ash Street and the existing street right-of-way west of the Dry Creek cutoff channel west of Broadway Boulevard (setting August 19, 1991 for public hearing), be adopted. Aye: (5) . Nay: (0) . Motion adopted. OTHER BUSINESS Commissioner Warner asked the City Engineer, Don Hoff, if the City has invoked its river water rights in light of the current drought. Don Hoff, City Engineer, said the City has invoked its water rights and explained the procedure of numbered water rights for the Smoky Hill River. He explained that Salina gets 800 of its water from the river and that the Corps of Engineers is releasing 50% more water. He said the Salina customers need to be more prudent and not let water stand or run in the gutter.
