REGULAR MEETING OF THE BOARD OF COMMISSIONERS
AUGUST 12, 1991

The Regular Meeting of the Board of Commissioners met in the Commission
Meeting Room, City -County Building, on Monday, August 12, 1991, at 4:00
p.m.
There were present:

PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME
(5.1) Public Hearing on the proposed 1992 budget of expenditures for the
City of Salina, Kansas.
(5. la) Resolution Number 91-4354, adopting the 1992 budget.
(5.1b) First Reading Ordinance Number 91-9460, providing for the
adoption and appropriation, by fund, of the budget of the City of Salina
for the year beginning January 1, 1992; and appropriating money from
the various funds to pay payrolls and claims against the City of Salina
for the calendar year 1992.
Robert K. Biles, Director of Finance and Administration, explained
that the County informed the City of an $823,000 decrease in assessed
valuation. He told the Commissioners that a decision must be made to raise
the mill levy to adjust the budget for the lower taxes or lower the budget
accordingly.
Mayor Ryan declared the public hearing open.
There were no comments, written or filed, so the Mayor declared the
public hearing closed.
The City Commissioners discussed aspects of the 1992 proposed
budget.
Moved by Commissioner Warner, seconded by Commissioner Beggs
that Ordinance Number 91-9460 (Option B to maintain the mill levy at the
current level) , providing for the adoption and appropriation, by fund, of the
budget of the City of Salina for the year beginning January 1, 1992; and
appropriating money from the various funds to pay payrolls and claims against
the City of Salina for the calendar year 1992, be introduced for first
reading. Aye: (5) . Nay: (0) . Motion adopted.

CONSENT AGENDA
(6.1) Approve the Minutes of the Regular Meeting August 5, 1991.
(6.2) Petition Number 4015 was filed by Robert L. Marietta for the
curbing, guttering, paving and grading of Bentley Drive from Shalimar Drive
to Linden Drive in Mayfair Addition. (Refer the petition to the City Engineer
for a recommendation and report on the validity of the petition and a report
on the improvement . )

(8.1) Second Reading Ordinance Number 91-9457, levying special
assessments against certain lots and pieces of property to pay the cost of
cutting weeds on certain lots and parts of lots and the parkways abutting
thereon in the City of Salina, Kansas.
Moved by Commissioner Beggs, seconded by Commissioner Divine
that Ordinance Number 91-9457, levying special assessments against certain
lots and pieces of property to pay the cost of cutting weeds on certain lots

certain lots and pieces of property to pay the cost of sidewalk repair located

(8.4) Report on bids received August 6, 1991 for Engineering Project
91-837 for 1991 Curb and Gutter and Concrete Pavement Repair. (Award the
contract to Wilbur Construction Company in the amount of $50,372.50).
Shawn O'Leary, Assistant City Engineer, reported that two valid
bids were received and recommended awarding the contract to Wilbur
Construction Company in the amount of $50,372.50.

Moved by Commissioner Divine, seconded by Commissioner Beggs
that the staff recommendation be accepted and the contract for Engineering
Project 91-837 for 1991 Curb and Gutter and Concrete Pavement Repair be
awarded to Wilbur Construction Company in the amount of $50,372.50. Aye:

(8.5) Resolution Number 91-4355, authorizing the Mayor to execute a
Certified Local Government Agreement between the City of Salina, Kansas and
the Kansas Historic Preservation Department, for participation in the National
Historic Preservation Program.
Roy Dudark, Director of Planning and Community Development,
reviewed the history of the application for certification and said Salina is
the fourth city in Kansas to have a certified historic preservation program.
He said training and funding are available to certified local governments.
Moved by Commissioner Warner, seconded by Commissioner
Brungardt that Resolution Number 91-4355, authorizing the Mayor to execute a
Certified Local Government Agreement between the City of Salina, Kansas and
the Kansas Historic Preservation Department, for participation in the National
Historic Preservation Program, be adopted. Aye: (5) . Nay: (0) . Motion
adopted.
(8.6) Resolution Number 91-4356, determining the reasonable and safe
maximum speed limit on Ohio Street, and repealing Resolution Number 81-3540.
Shawn O'Leary, Assistant City Engineer, explained that this
Resolution reduces the speed limit from 40 mph to 30 mph in a three block
area on Ohio Street, from Albert Avenue to Wayne Avenue. He said the
recommendation originated from the School Safety Committee as one element of
a total program.
The Commissioners and staff discussed the issue. Staff was asked
for a full report on Ohio traffic flow and for a summary of the
recommendations from the School Safety Committee.
Moved by Commissioner Divine, seconded by Commissioner Warner
that Resolution Number 91-4356, determining the reasonable and safe maximum
speed limit on Ohio Street, and repealing Resolution Number 81-3540, be
adopted. Aye: Divine, Warner (2) . Nay: Beggs, Brungardt , Ryan (3) .
Motion defeated.
