10-14-1991 MinutesCITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS OCTOBER 14, 1991 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, October 14, 1991, at 4:00 p.m. There were present: Mayor Stephen C. Ryan, Chairman presiding Commissioner Carol E. Beggs Commissioner Peter F. B run rdt Commissioner mmissioner Jo hn Divine Commissioner Joseph A. Warner comprising of the Boa P g a quorum rd, also present: Greg Bengtson, City Attorney Dennis M. Kissinger, City Manager Jacqueline Shiever, City Clerk Absent: None CITIZEN FORUM J. D. Williams and Frank Fancher, representing the Salina Association of Life Underwriters, spoke to the Commissioners about purchasing "spook insurance" to benefit the Kansas Special Olympics. Dan Eyler, 1700 Pershing, thanked Commissioners Beggs and Divine for speaking at a neighborhood forum last week and asked for clarification on a comment regarding the school budget versus the city budget and other items. Jerry Davis, President of KSU Air Club, said the club is volunteering to maintain the B-47 aircraft in order to keep it in Salina. AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed the Week of October 14 through 19, 1991 as "SALINE COUNTY MEDICAL ASSISTANTS WEEK." The proclamation was read by Janet Poore, Saline County Medical Assistants. (4.2) The Mayor proclaimed the Week of October 13 through 19, 1991 as "ALPHA DELTA KAPPA WEEK." The proclamation was read by JoAnn O'Brien, President of the Kansas Chapter of Alpha Delta Kappa of Salina. (4.3) The Mayor proclaimed the Month of October, 1991 as "BREAST CANCER AWARENESS MONTH." The proclamation was read by Ann Rollins, Public Relations for Social Rehabilitation Service. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Public Hearing on vacation of Westbend Avenue required by Resolution Number 91-4383, adopted by the Board of Commissioners on September 23, 1991. (Requested in Petition 4017 filed by Central Kansas Mental Health Center) . (5.1a) First Reading Ordinance Number 91-9468, providing for the vacation of a portion of Westbend Avenue, a public street as shown on the recorded plat of Westbend Addition to the City of Salina, Saline County, Kansas. Shawn O'Leary, Assistant City Engineer, reported on the validity of the petition and reviewed the staff recommendation to approve the vacation. Mayor Ryan declared the public hearing open. R. W. Bull, Vice Chairman of the Building Committee of the Central jKansas Mental Health Center, said this property was purchased recently and is necessary to expand the Center. Patricia Murray said the Mental Health Center is expanding its services for the long-term mentally ill and asked for a favorable vote on the vacation of Westbend Avenue. There were no other comments, so the Mayor declared the public hearing closed. 91-428 Moved by Commissioner Warner, seconded by Commissioner Brungardt that Ordinance Number 91-9468, providing for the vacation of a portion of Westbend Avenue, a public street as shown on the recorded plat of Westbend Addition to the City of Salina, Saline County, Kansas, be introduced for first reading. (5.2) Public Hearing on vacation of a utility easement between Lots 14 and 15, Block 6, Meyer Addition, required by Resolution Number 91-4384, adopted by the Board of Commissioners on September 23, 1991. (Requested in Petition Number 4018, filed by Kenneth and Nancy McDonald) . Shawn O'Leary, Assistant City Engineer, explained that Southwestern Bell Telephone has buried cable in this easement, but would be willing to relocate the cable if the property owner paid the cost. He recommended action on this request be tabled until next week when a letter of consent from Southwestern Bell Telephone is finalized and the McDonalds have closed on the purchase of Lot 14. Kenneth McDonald, 915 N. 10th, said the delay is acceptable to him. Mayor Ryan declared the public hearing open. There were no comments, written or filed, so the Mayor declared the public hearing closed. 91-429 Moved by Commissioner Beggs, seconded by Commissioner Divine that consideration of the vacation of a utility easement between Lots 14 and 15, Block 6, Meyer Addition, requested by Kenneth and Nancy McDonald, be tabled until October 21, 1991. Motion adopted. 91-430 (5.3) Public Hearing on vacation of the northwest 1/21 of that certain- utility ertainutility easement on the SE 8' of NW 21' of Lot 21, Block 8, Key Acres Addition, required by Resolution Number 91-4385, adopted by the Board of Commissioners on September 23, 1991. (Requested in Petition Number 4320, filed by Donald and Shirley Roach) . (5.3a) First Reading Ordinance Number 91-9469, providing for the vacation of the northwest 1/2' of that certain utility easement in Block 8, Key Acres Addition to the City of Salina, Saline County, Kansas. Shawn O'Leary, Assistant City Engineer, reported on the petition and the background for the request. He said the property owners have agreed to pay 50% of the cost to relocate a 4" water main currently in the easement. The Commissioners and staff discussed the size of easements and the cost to the City to process the vacation requests. Mayor Ryan declared the public hearing open. There were no comments, written or filed, so the Mayor declared the public hearing closed. Moved by Commissioner Brungardt, seconded by Commissioner Warner that Ordinance Number 91-9469, providing for the vacation of a portion of a certain utility easement in Block 8, Key Acres Addition to the City of Salina, Saline County, Kansas, be introduced for first reading. Aye: (5). Nay: (0) . Motion adopted. 91-431 CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting September 23, 1991. (6.2) Approve the Minutes of the Special Meeting October 2, 1991. (6.3) Authorize the City Clerk to issue an additional taxi license to Eloise French, dba Radio Cab / Yellow Taxi, and an additional taxi license to Mike Scriven dba City Cab. (6.4) Set the date of November 12, 1991 to receive bids for Engineering Project 91-844 for 1991 manhole regrading. (6.5) Resolution Number 91-4389, directing public notice of application for vacation of the West 9' of the South 113.27' of an existing ten foot utility easement located adjacent to the east line of Lot 8, Block 4, Replat of Schippel Addition, Blocks 4 and 5 and part of Block 3. (Requested in Petition Number 4321, filed by the City of Salina.) (6.6) Resolution Number 91-4390, directing public notice of application for vacation of a temporary storm water drainage easement on Lot 9, Block 1; and for the vacation of the twenty foot utility easement on Lots 1 through 7, Block 1, all in Wallerius Addition Number 2. (Requested in Petition Number 4322, filed by Southwestern Mobile Homes Court.) (6.7) Resolution Number 91-4391, directing public notice of application for vacation of the north -south alley between Ninth Street and Highland Avenue, from the north line of Kirwin Avenue to the south line of the intersecting east -west alley in the Grounds of KWU Addition. (8.2) Resolution Number 91-4387, making appointments to the Heritage Commission and the Salina Business Improvement District Board of Advisors. 91-433 Moved by Commissioner Divine, seconded by Commissioner Beggs that Resolution Number 91-4387, making appointments to the Heritage Commission and the Salina Business Improvement District Board of Advisors, be adopted. Aye: (5) . Nay: (0) . Motion adopted. (8.3) Report on bids received October 8, 1991 for Engineering Project 91-834 for 1991 sidewalk improvements. (Award the contract to Wilbur Construction Company in the amount of $30,751.75.) Shawn O'Leary, Assistant City Engineer, reviewed the project and the bids received and recommended the contract be awarded to Wilbur Construction Company in the amount of $30,751-75. 91-434 Ill Moved by Commissioner Warner seconded by Commissioner Beggs that the staff recommendation be accepted and that the contract for Engineering Project 91-834, for 1991 sidewalk improvements, be awarded to Wilbur Construction Company in the amount of $30,751.75. Aye: (5) . Nay: (0) . Motion adopted. (8.4) Report on bids received October 8, 1991 for Engineering Project 91-841 for 9th and Cloud intersection improvements. ( Reject all bids and set the date of November 12, 1991 to receive bids) . Shawn O'Leary, Assistant City Engineer, reported that all bids were over the engineer's estimate for this project. He said State Statutes require that all bids be rejected and recommended that November 12, 1991 be set to receive bids on Engineering Project 91-841 with traffic signal modification to be done "in house" or let as a separate contract. 91-435 '' Moved by Commissioner Beggs, seconded by Commissioner Brungardt 91-436 91-437 that the staff recommendation be accepted, that all bids for Engineering Project 91-841 be rejected and that November 12, 1991 be set to receive bids. Aye: (5) . Nay: (0) . Motion adopted. (8.5) Consideration of an offer to purchase Lots 11, 12 & 13, Block 3 in the Replat of Faith Addition by Wayne May, 1228 Meyer Drive, Salina, Kansas for $12,000. Robert K. Biles, Director of Finance and Administration, reported that an offer was received from Wayne May to purchase three lots in the Replat of Faith Addition for $12,000. He recommended accepting Mr. May's offer. Moved by Commissioner Warner, seconded by Commissioner Beggs that the offer from Wayne May to purchase Lots 11, 12 & 13, Block 3, in the Replat of Faith Addition for $12,000, be accepted. Aye: (5) . Nay: (0) . Motion adopted. (8.6) Disposition of surplus property. Robert K. Biles, Director of Finance and Administration, reviewed the City -owned property in the Replat of Faith, Eastgate and Mayfair Additions. He recommended offering the property for sale at the established prices "free and clear" of future special assessments. Moved by Commissioner Brungardt, seconded by Commissioner Beggs that staff be authorized to sell the properties in the Replat of Faith, Eastgate and Mayfair Additions at the amounts listed until April 30, 1992 with terms of sale being 10% down and the balance due at closing within 30 days.
