10-21-1991 MinutesAction CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS OCTOBER 21, 1991 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, October 21, 1991, at 4:00 P.M. There were present: Mayor Stephen C. Ryan, Chairman presiding Commissioner Carol E. Beggs Commissioner Peter F. Brungardt Commissioner John Divine Commissioner Joseph A. Warner comprising a quorum of the Board, also present: Absent: Greg Bengtson, City Attorney Dennis M. Kissinger, City Manager Jacqueline Shiever, City Clerk None None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor presented City Service Awards to City Employees with 10 and 25 years of service. Those receiving 25 year awards were: Thomas C. Girard, Fire Chief; Thomas Gott, Fire; Richard S. Funke, Fire; Ernest R. Sanchez, Fire; Dennis L. Walker, Fire; Delbert Stuive, Traffic Control; Robert Dickerson, Park; and Glenn F. Kochanowski, Assistant Police Chief. Those receiving 10 year awards: David W. Klanke, Engineering; Bryan J. Keeler, Fire; Carol H. Vineyard, Fire; Patricia J. Schempp, Permits & Inspection; Kevin Hays, Police; Joseph L. Garman, Police; William F. Evans, Police; Donald E. Poore, Police; Kerry J. The proclamation was read by Priscilla Freeman, Member of the Telephone Pioneers, who worked for the telephone company 35 years. Action None DEVELOPMENT BUSINESS ADMINISTRATION (8.1) Second Reading Ordinance Number 91-9468, providing for the vacation of a portion of Westbend Avenue, a public street as shown on the recorded plat of Westbend Addition to the City of Salina, Saline County, Kansas. 91-440 Moved by Commissioner Divine, seconded by Commissioner Brungardt that Ordinance Number 91-9468, providing for the vacation of a portion of Westbend Avenue, a public street as shown on the recorded plat of Westbend Addition to the City of Salina, Saline County, Kansas, be adopted. Motion adopted. 91-442 91-443 (8.3) First Reading Ordinance Number 91-9470, providing for the vacation of a certain utility easement adjacent to Lots 14 and 15, Block 6, Meyer Addition to the City of Salina, Saline County, Kansas. Moved by Commissioner Brungardt, seconded by Commissioner Divine that the request for the vacation of a certain utility easement adjacent to Lots 14 and 15, Block 6, Meyer Addition to the City of Salina, Saline County, Kansas, be removed from the table for consideration. Aye: (5) . Nay: (0) . Motion adopted. Shawn O'Leary, Assistant City Engineer, reported on Petition Number 4018, which was filed by Kenneth and Nancy McDonald. He said Southwestern Bell Telephone Company provided a letter to release the easement on the basis that the petitioner has agreed to pay the total cost of relocating the existing cable. He recommended vacation of the easement. Moved by Commissioner Brungardt, seconded by Commissioner Divine that Ordinance Number 91-9470, providing for the vacation of a certain utility easement adjacent to Lots 14 and 15, Block 6, Meyer Addition to the City of Salina, Saline County, Kansas, be introduced for first reading. (8.4) First Reading Ordinance Number 91-9471, amending Sections 2-200, 2-204, 2-205, 2-206 of the Salina Code pertaining to the Design Review Board of the Salina Business Improvement District Number One; and repealing the existing sections. Judy Ewalt, Coordinator of Salina Downtown, Inc., reported that the members of the Design Review Board recently adopted their bylaws and the proposed amendments eliminate any conflict between the code and the bylaws. 91-444 '', Moved by Commissioner Divine, seconded by Commissioner Beggs that Ordinance Number 91-9471, amending Sections 2-200, 2-204, 2-205, 2-206 of the Salina Code pertaining to the Design Review Board of the Salina Business Improvement District Number One; and repealing the existing sections, be introduced for first reading. Action (8.5) Resolution Number 91-4392, authorizing the Mayor to execute and the City Clerk to attest a contract with Wilson and Company, Engineers and Architects, for engineering services for the Wastewater Plant Construction, in an amount not to exceed $718,550. Don Hoff, Director of Utilities, reviewed the scope of the contract for the rehabilitation and construction of Wastewater Treatment Plant 1. The Commissioners and staff discussed the project. 91-445 Moved by Commissioner Brungardt, seconded by Commissioner Warner that Resolution Number 91-4392, authorizing the Mayor to execute and the City Clerk to attest a contract with Wilson and Company, Engineers and Architects, for engineering services for the Wastewater Plant Construction, in an amount not to exceed $718,550, be adopted. (8.6) Resolution Number 91-4393, authorizing the City Manager to execute an Environmental Protection Agency Assistance Agreement for the construction Of major Wastewater Treatment Plant Number 1 improvements. Dennis M. Kissinger, City Manager, reviewed the grant application. !I He said the Cit of Salina is one of the last tees for federal fun and Y C�171gf that the $4,663,900 grant will assist in the renovation of the wastewater treatment facilities. The estimated project cost is $10,900,000 with the City responsible for $6,236,100, or 57% of the total. The Commissioners and staff discussed financing the wastewater treatment facility improvements. 91-446 'I Moved by Commissioner Warner, seconded by Commissioner Brungardt that Resolution Number 91-4393, authorizing the City Manager to execute an Environmental Protection Agency Assistance Agreement for the construction of major Wastewater Treatment Plant Number 1 improvements, be adopted. Aye: (5) . Nay: (0) . Motion adopted. (8.7) Authorize the purchase of 1,000 polycarts for the Sanitation Department from Ameri-Kart for $44,110.00. Frank Weinhold, Director of General Services, reviewed the bids received and recommended that the contract for 1,000 polycarts be awarded to Ameri-Kart for $44,110.00. 91-447 Moved by Commissioner Divine, seconded by Commissioner Beggs that the staff recommendation be accepted and that the contract for 1,000 polycarts for the Sanitation Department be awarded to Ameri-Kart in the amount of $44,110.00. Aye: (5) . Nay: (0) . Motion adopted. (8.8) Request for Executive Session under the attorney-client privilege. (Cable TV issue) 91-448 Moved by Commissioner Brungardt, seconded by Commissioner Warner j that the City Commission recess into executive session for 45 minutes for the purpose of discussing a matter deemed subject to the attorney/client privilege; specifically, legal matters related to cable TV negotiations, for the reason that public discussion at this time would waive the attorney/client privilege and would adversely affect the City's negotiating position in the matter. Aye: (5) . Nay: (0) . Motion adopted. 91-44911 The Commission recessed at 4:28 p.m. and reconvened at 5:18 p.m. Moved by Commissioner Brungardt, seconded by Commissioner Beggs that the City Commission recess into executive session for 15 minutes for the purpose of discussing a matter deemed subject to the attorney/client privilege; specifically, legal matters related to cable TV negotiations, for the reason that public discussion at this time would waive the attorney/client privilege and would adversely affect the City's negotiating position in the matter. Aye: (5) . Nay: (0) . Motion adopted. The Commission recessed at 5:18 p.m. and reconvened at 5:32 p.m. The Commissioners took no action. Action (8.9) Request for Executive Session under the attorney-client privilege. j (Railroad property condemnation appeal) 91-450 ',', Moved by Commissioner Warner, seconded by Commissioner Brungardt that the City Commission recess into executive session for 15 minutes the purpose of discussing a matter deemed subject to the attorney/client privilege; specifically, the appeal by Union Pacific Railroad of the appraisers award in condemnation of a 60,000 square foot tract of real estate located immediately north of Elm Street and west of North 3rd Street, for the reason that public discussion at this time would waive the attorney-client privilege and would -� adversely affect the City's position in the appeal.
