11-25-1991 MinutesActio # J CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS NOVEMBER 25, 1991 4:00 p.m. 91-499 The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, November 25, 1991, at 4:00 p.m. There were present: Mayor Stephen C. Ryan, Chairman presiding Commissioner Carol E. Beggs Commissioner Peter F. Brungardt Commissioner John Divine Commissioner Joseph A. Warner comprising a quorum of the Board, also present: Absent: Greg Bengtson, City Attorney Dennis M. Kissinger, City Manager Jacqueline Shiever, City Clerk None None CITIZEN FORUM AWARDS - PROCLAMATIONS The Mayor proclaimed Sunday, November 24, 1991 as "THE FORTIETH BIRTHDAY OF DENNIS M. KISSINGER". The Mayor read the proclamation on Monday, November 25, 1991, honoring the 40th birthday of Mr. Kissinger. (4.1) The Mayor proclaimed December 1, 1991 as "WORLD AIDS DAY." The proclamation was read by Del Meier from the Salina -Saline County Health Department. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Public Hearing required by Resolution 91-4390, adopted by the Board of Commissioners October 14, 1991, for the vacation of the temporary storm drainage easement on Lot 9, Block 1 and the 20' utility easement on Lots 1 through 7, Block 1, all in Wallerius Addition No. 2 to the City of Salina, Saline County, Kansas, requested in Petition Number 4322, filed by Southwestern Mobile Homes. (5.1a) First Reading Ordinance Number 91-9480, providing for the vacation of certain utility easements and temporary storm water drainage easement in Wallerius Addition Number 2, with conditions. Shawn O'Leary, Assistant City Engineer, reviewed the vacation request. He said the petitioner has agreed to pay the cost of relocating the existing utility lines and recommended approving the vacation request with conditions. The Commissioners and staff discussed the conditions. Mayor Ryan reconvened the public hearing. There were no comments filed, written or oral, so the Mayor declared the public hearing closed. Moved by Commissioner Warner, seconded by Commissioner Divine that Ordinance Number 91-9480, providing for the vacation of certain utility easements and temporary storm water drainage easement in Wallerius Addition Number 2, with conditions, be introduced for first reading. (6.4) Set the date of December 17, 1991 to receive bids on Building Demolition Project No. 91-847. DEVELOPMENT BUSINESS (7.1) Resolution Number 91-4404, authorizing the filing of an application with the Department of Transportation, United States of America., for a grant under the Urban Mass Transportation Act of 1964, as amended. Roy Dudark, Director of Planning and Community Development, reviewed the project. He said this resolution authorizes the filing of two separate grant applications, seeking funds for a mass transit feasibility study. 91-501 Moved by Commissioner Divine, seconded by Commissioner Brungardt that Resolution Number 91-4404, authorizing the filing of an application with the Department of Transportation, United States of America, for a grant under the Urban Mass Transportation Act of 1964, as amended, be adopted. ADMINISTRATION (8.1) Second Reading Ordinance Number 91-9477, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof . (E 58' Lot 5, Block 1, Cloverdale Addition to District 1-2 (Light Industrial District.) 91-502 Moved by Commissioner Warner, seconded by Commissioner Beggs that Ordinance Number 91-9477, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof, be adopted. (Crawford Street Improvements, Phase II) . Robert K. Biles, Director of Finance and Administration, reported on the 12 bids received. He recommended awarding the bonds to Mercantile Bank of St. Louis for a total interest cost to the City of $478,860 and an average annual interest rate of 5.0579%. Roger Edgar, George K. Baum & Co., financial advisor for the City, was available for questions. 91-505 !I Moved by Commissioner Beggs, seconded by Commissioner Brungardt that General Obligation Bonds, Series C-239, be awarded to Mercantile Bank of St. Louis for a total interest cost to the City of $478,860 and an average annual interest rate of 5.0579%. (8.5) First Reading Ordinance Number 91-9481, authorizing and directing the issuance, sale and delivery of $1,785,000 principal amount of General Obligation Internal Improvement Bonds, Series C-239, of the City of Salina, Kansas, for the purpose of providing funds to pay the cost of the construction of certain street improvements in the city; prescribing the form and details of said bonds; providing for the levy and collection of the necessary taxes for the purpose of paying the principal of and interest on said bonds as they become due; authorizing an agreement between the City and the bond registrar; approving the preliminary and final official statements and redeeming outstanding temporary notes. Motion adopted. 91-507 (8.6) Resolution Number 91-4405, that the City of Salina, Kansas, should repair, alter, extend, reconstruct, enlarge and improve its water and sewage system and authorizing notice be given of the city's intention to take such action. (Authorizing the Interceptor Sewer improvements) . Robert K. Biles, Director of Finance and Administration, said that this resolution authorizes the revised project cost of $8,100,000. Ernest Cole, 153 S. Front, said he still objects to the alignment of this project and the additional expense to citizens. Moved by Commissioner Brungardt, seconded by Commissioner Beggs that Resolution Number 91-4405, that the City of Salina, Kansas, should repair, alter, extend, reconstruct, enlarge and improve its water and sewage system and authorizing notice be given of the city's intention to take such action, be adopted. (Accept the bid of Pestinger Heating and Air Conditioning of Salina in the amount of $1,150) . Tom Girard, Fire Chief, reported on the bids received and recommended awarding the contract for the sale of the heater to Pestinger Heating and Air Conditioning. The Commissioners and staff discussed the resale value of the heater. -- 91-508 Moved by Commissioner Beggs, seconded by Commissioner Warner that the sale of the Direct Fired Gas Make-up Heater be delayed and that staff be !' directed to seek wider markets. Motion adopted. 91-509 91-510 (8.8) Request City Commission action to accept a proposal from Equipto of Aurora, Illinois to furnish equipment to expand existing vertical mezzanine in Heritage Hall and to add pallet racks for the storage building. (Sole source purchase; budgeted project) Phil Chamoff, Interim Bicentennial Manager, reviewed the project and recommended a sole source purchase from Equipto of Aurora, Illinois. Moved by Commissioner Beggs, seconded by Commissioner Warner that the proposal from Equipto of Aurora, Illinois to furnish equipment to expand existing vertical mezzanine in Heritage Hall and to add pallet racks for the storage building, be accepted. Aye: (5) . Nay: (0) . Motion adopted. (8.9) Resolution Number 91-4406, appointing a member to the Housing Authority of the City of Salina, Kansas. Moved by Commissioner Warner, seconded by Commissioner Divine that Resolution Number 91-4406, appointing a member to the Housing Authority of the City of Salina, Kansas, be adopted. Aye: (5) . Nay: (0) . Motion adopted. (8.10) Request for Executive Session to discuss Cable TV. Moved by Commissioner Brungardt, seconded by Commissioner Warner that the Board of Commissioners recess into executive session for 15 minutes to discuss a matter deemed subject to the attorney-client privilege, specifically a matter involving cable TV negotiations, for the reason that public discussion of the matter would waive the attorney-client privilege and adversely affect the City's position in the matter.
