12-02-1991 Minutes91-513 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS DECEMBER 2, 1991 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, December 2, 1991, at 4:00 p.m. There were present: Mayor Stephen C. Ryan, Chairman presiding Commissioner Carol E. Beggs Commissioner Peter F. Brungardt Commissioner John Divine Commissioner Joseph A. Warner comprising a quorum of the Board, also present: Absent: Greg Bengtson, City Attorney Dennis M. Kissinger, City Manager Jacqueline Shiever, City Clerk None CITIZEN FORUM Randall Holm, 848 Custer, presented a petition (later numbered 4325) , signed by more than 300 people, requesting a public outdoor shooting range. Mayor Ryan instructed staff to review the request. AWARDS - PROCLAMATIONS Mayor Ryan announced that the Governor has proclaimed Saturday, December 7, 1991 as "Pearl Harbor Remembrance Day" and reminded Salina citizens to observe this day. 'DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission that Zoning Application 91-6, filed by John Heline for the rezoning of an 11.45 acre tract in the SE/4 of Section 17, Township 14 South, Range 2 West to District R-1, (Single Family Residential), be approved. (Introduce Ordinance 91-9482 for first reading.) Roy Dudark, Director of Planning and Community Development, reviewed the application. He said any extension of utilities would be paid by the petitioner and recommended City Commission approval subject to platting. The Commissioners and staff discussed the improvements necessary for development of the area and the potential cost to the City. G Actio 91-514 Moved by Commissioner Warner, seconded by Commissioner Brungardt that the recommendation of the City Planning Commission be accepted, that Z91-6 be approved and that Ordinance Number 91-9482, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the zoning district map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof, be introduced for first reading. I — 91-516 Moved by Commissioner Divine, seconded by Commissioner Beggs that the recommendation of the City Planning Commission be accepted, that Z91-8 be approved and that Ordinance Number 91-9484, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the zoning district map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof, be introduced for first reading. Motion adopted. ; j (7.4) Recommendation from the City Planning Commission that Zoning Application 91-9, filed by the City Planning Commission, for the amendment of Chapter 42 of the Salina Code regarding procedure for public hearings, building on easements, residential design manufactured homes, manufactured home district, and definitions relating to mobile and manufactured homes, be approved. Roy Dudark, Director of Planning and Community Development, summarized the major changes to Chapter 42. He said many of these changes are mandatory to bring the Salina Code into compliance with new state regulations. The Commissioners and staff discussed the ramifications of the III amendments in Salina. Roy Dudark, Director of Planning and Community Development, reviewed the policy. Moved by Commissioner Beggs, seconded by Commissioner Brungardt that Resolution Number 91-4407, establishing a policy for vacating public street rights-of-way and easements within the City of Salina, Kansas, be adopted. ADMINISTRATION (8.1) Second Reading Ordinance Number 91-9480, providing for the vacation of certain utility easements and temporary storm water drainage easement in Wallerius Addition Number 2, with conditions. (Includes amended legal description.) Shawn O'Leary, Assistant City Engineer, reviewed the conditions and stated that the petitioner has met 4 of the 5 conditions and recommended the ordinance be adopted. Moved by Commissioner Divine, seconded by Commissioner Warner that Ordinance Number 91-9480, providing for the vacation of certain utility easements and temporary storm water drainage easement in Wallerius Addition Number 2, be adopted. Motion adopted. 91-524 91-525 91-526 91-527 (8.2) Second Reading Ordinance Number 91-9481, authorizing and directing the issuance, sale and delivery of $1,785,000 principal amount of General Obligation Internal Improvement Bonds, Series C-239, of the City of Salina, Kansas, for the purpose of providing funds to pay the cost of the construction of certain street improvements in the City; prescribing the form and details of said bonds; providing for the levy and collection of the necessary taxes for the purpose of paying the principal of and interest on said bonds as they become due; authorizing an agreement between the City and the bond registrar; approving the preliminary and final official statements and redeeming outstanding temporary notesauthorizing the issuance of $1,785,000.00 General Obligation Internal Improvement Bonds Series C-239. (Crawford Street Improvements, Phase II.) (8.4) Change Order No. 1 for Lakewood / Centennial Park Restroom Project No. 91-828. Shawn O'Leary, Assistant City Engineer, said the project is complete and requested approval of Change Order No. 1 for a decrease in original contract of $520.00. Moved by Commissioner Brungardt, seconded by Commissioner Warner that Change Order No. 1, for a decrease of $520.00, for Lakewood/Centennial Park Restroom Project No. 91-828, be approved. Aye: (5) .
