You are herewith informed that the undersigned, Anna Phyllis
McMillin dependent, claims compensation in accordance with the
Workmen' s Compensation Laws of Kaneas, by reason of fatal injuries
sustained by Mark. Alvin McMillin while in your employ on or about
the 5th day of February, 1946, at or near Salina, Kansas.

FOR AND IN CONSIiiE ATI:N of the payment to us at this time of.
the sum of Sixty ($60.00) Dollars , the receipt of which is hereby
acknowledged, we , being of lawful age , do hereby release , acquit
and forever discharge R. 0 . Jones of 911 North 11th Street , Salina ,
Kansas , and the City of Salina, Kansas , of and from any and all _
actions , causes of action, claims , demands , damaes , _costs , loss
of services , expenses and compensation, on account of , or in any
way growing out of, any and all known and unknown property damage
and personal injuries resulting or to result from an accident that
occurred about 2 :50 P.11. on the 30th day of September , 19 $,,.,at
or near the intersection of North Santa Fu Ave and Grand Avenue ,
in the City of Salina , Kansas , when a two-ton Il-IC Truck, belonging
to the City of Salina Kansas , and being driven by said R. 0. Jones ,
collided with a 1941 Ford Panel Truck, belonging to the undersigned,
Garland Hill, and being driven by the undersigned, 1,Iildred Hill,
resulting in damage to said Ford Panel Truck.
It is further understood and a -reed that this settlement is
the compromise of a doubtful and disputed claim, and that the pay-
ment is not to be construed as an admission of liability on the part
of R. 0. Jones or the City of Salina, Kansas , by whom liability is
expressly denied.
This release contains the Entire Agreement between the parties
hereto , and the terms of this release are contractual and not a
mere recital.
We further state that we have carefully read the foregoing
release and know the contents thereof, and we sign the same as
out own free act.
Witness our hands and seals this 7th day of December, 1943 ,
at Salina, Kansas.

Re: H. N. Paul vs City
Dear Mr. Allison:
The claim of H, N. Paul in the sum of $118.00 for the claim-
ed wrongful killing of a dog by a city employee has been
submitted to me for an opinion as to the liability of the
city to the owner.
Our ordinances relating to dogs are fundamentally directed
toward the protection of the public health. The protection
of the public health is a governmental function. An em-
ployee of the city who is responsible for the enforcement
of ordinances relating to governmental functions cannot ex-
ceed his legal authority and thereby obligate the city.
Such an employee cannot, by commission of a tort, obligate
the city in its sovereign capacity in the performance of
governmental functions.
It is, therefore, my conclusion that the city is not liable
and the claim should be summarily denied.
