Hoffman Parties of the Second Part, hereinafter referred to as Property Owners, witnesseth: That, whereas the said Property Owners are the record owners, respectively, of the following described tract of real estate abutting on North Tenth Street from Lincoln Avenue to Grand Avenue in the City of Salina, Kansas; to-wit: RECORD OWNER LOT BLOCK ADDITION C. N. Hoffman 7 2 Crowthers and, <Y Whereas paving has been ordered on said North Tenth Street from Lincoln Avenue to Grand Avenue; and Whereas the water service line for said property on said street has been in place approximately fifteen years and should be replaced with copper or lead water lines from the main water lines to the curb box; and Whereas Section 2 of Ordinance No. 2410 (26-3024 provides that the Board of Commissioners shall give notice of any order to construct water service pipes by publishing an order to such effectfor three consecutive days in the official city paper and that in the event the owners of such lots abutting on said avenue shallyrefuse or neglect to lay down or construct such water service pipes within 30 days from and after the last publication of such order then the Board of Commissioners of the City of Salina shall proceed to construct or •cause to-be constructed and laid such water service pipes in accordance with the provisions of law and the costs thereof for which such service pipes are laid and such assessments shall be certified by the City Clerk of Salina, Kansas to the County Clerk of Saline County, Kansas, to be collected according to law in the same manner as paving assessments are collected; and, Whereas the delay provided for by the said ordinance will make the paving of said avenue impossible this winter; and, Whereas said property owners are desirous of having said pavement laid at once; • • Now, therefore, it is agreed by and between First Party and said Property Owners that in consideration of First Party proceeding to lay said paving at once said property owners hereby agree to waive and do hereby waive all claims of every kind.and nature, class or description which they or any of them now have or shall have by virtue of the provisions of said Section 2 of Ordinance No. 2410 (26-302) as to publication of notice for three consecutive days in the official city paper and consent that the Board of Commissioners of the City of Salina, Kansas shall proceed to construct or cause to be constructed and laid, said water pipes in accordance with the provisions of law, and that the costs thereof shall be assessed against the adjoining lots or fractional parts thereof for which such service pipes are laid, and that such assessments shall be certified by the City Clerk of Salina, Kansas, to the County Clerk of Saline County, Kansas, to be collected accord- ing to law in the same manner as paving assessments are collected; it being the intent of this agreement of waiver that all parties hereto shall have the same rights and be subject to the same obligations as if the provisions of Section 1 and 2 of Ordinance No. 2410 (26-301, 26-302) had been literally complied with in every particular. • \1 • In witness whereof the parties hereto have hereunto set their hands this 29th day of October 1945 The Ci ill`• : • BY a‘fft// „stk.! Around the 15th of August I intend to move into my new home , and, as you know , the one-inch make-shift water pipe by which two houses have been receiving water will be out of the question for three houses ; it is barely enough for two. This grant to be made on a temporary basis, that is until such time as it may be necessary to use this site for school building purposes. This will be for a short-duration of a few months while the permanent loca- tion is being remodeled. The Brown-Mackie School of Business will compensate the city for the use of the building. The Brown-Mackie School of Business will only use space that does not in- terfere with any public function. We believe this action is fair because the Brown- Mackie School of Business, Inc . , is an asset to the city of Salina. During a period of 12 months, the school en- rolls annually from 350 to 400 students outside of Salina. These young people live here while attending school and 80% of them locate in Salina in permanent positions. Be it resolved by the Saline County Bar Association . that it shall , and it does hereby respectfully request that the City of Salina purchase, for the use of the city court of Salina, a set of the "Reports of Cases Determined in the Supreme Court of Kansas;" and a Digest for such Reports. In support of this request we respectfully suggest that a court with the jurisdiction of the city court of Salina is. hardly complete without a set of said reports. The citizens and taxpayers of Salina are beneficiaries of our court system in that about Six Thousand Dollars per annum of • fines collected is used to support our city schools. It should cost little,if any, more than Two Hundred Dollars to buy a second hand set of said reports that will answer the purpose of .this request. S. Rosenwald and T. S. Howell, for the erection of a band shell in the city park of said city of Salina, Kansas, wherein said L. S. Rosenwald and T. S. Howell have agreed to pay the said second party the sum of $765.00 as part payment for the construction of said band shell, Now Therefore; The party of the first part hereto hereby agrees to pay to the second party the sum of Seven Hundred ($700.00) Dollars in consideration of which the second party hereby agrees to sa build and construct a band shell in the city park of said city of Salina, Kansas, such band shell to be build and constructed in strict accordance with the plans and specifications therefore now on file with the city clerk of said city, which plans and ppeoifioations the party of the second part hereby recognizes as and for the plans and specifications for said band shell, and which plans and specifications are hereby made a partof this contract as fully as if the same were set out at length herein. all Party of the second part hereby waives/liens of any kind which he might have on said band shell, except as to the sum of $700.00 hereby agreed to be paid to him by the city of Salina, and hereby agrees to hold the city of Salina harmless - from all liens which might be filed on said band; shelll by material men or laborers in consideration of the payment to him of said sum of $700.00 by said first party. Said above mentioned sum of $700.00 shall be paid to the second party, by the first party, upon the completion and acceptance of said band shell, or the first party may, at its option, pay to r • Irk the second party,from time to time during the construction of such band shell, such sum or sums of money as may be necessary to successfully cam on the work of constructing such band shell, such payments to be made upon estimates of the city engineer of the first party; provided however that such payments shall not at said any time exceed fourty per cent of *km estimates of said city engineer.
