REGULAR MEETING OF THE BOARD OF COMMISSIONERS
APRIL 13, 1992

The Regular Meeting of the Board of Commissioners met in the Commission
Meeting Room, City -County Building, on Monday, April 13, 1992, at 4:00 p.m.
There were present:

CITIZEN FORUM
Dennis Vogan, 1700 E. Iron, member of the Board of Realtors, said
the City's method of selecting appraisal services is flawed. He said there is
a large number of qualified individuals in the area and that appraisal and
acquisition services should be let out for bid.

Shawn O'Leary, Assistant Director of Engineering and Utilities,
reviewed the petition and recommended that the utility easement be vacated.
Mayor Ryan declared the public hearing open.
There were no comments filed, written or oral, so the Mayor declared
the hearing closed.
Moved by Commissioner Warner, seconded by Commissioner Divine that
Ordinance Number 92-9499, providing for the vacation of all of the twenty foot
utility easement on the west side of Lot 2, and the West 10' of the twenty foot
utility easement on the east side of Lots 2 and 3, Block 1, King Addition to
the City of Salina, Saline County, Kansas, be introduced for first reading.

(5.3) Public Hearing required by Resolution Number 92-4438 for the
vacation of a 70' x 100' storm sewer easement and the North 20' of a storm
sewer easement along the north line of the vacated Woodland Avenue on Lot 1,
Block 1, Trochenbach Addition. (Requested in Petition Number 4031, filed
by James M. Hall, IV)
(5.3a) First Reading Ordinance Number 92-9501, providing for the
vacation of a 70' x 100' storm sewer easement on Lot 1, Block 1,
Trochenbach Addition to the City of Salina, Saline County, Kansas.
Shawn O'Leary, Assistant Director of Engineering and Utilities,
reviewed the petition and vacation request. He recommended approving the
vacation of the 70' x 100' storm sewer easement on Lot 1, but retaining the 40'
storm sewer easement in the vacated Woodland Avenue as a major storm sewer
line is located there.
Mayor Ryan declared the public hearing open.
James Hall, 231 Fairdale Road, the petitioner, said he needs a
portion of the storm sewer easement to develop the property and requested
narrowing the 40' easement to a 20' easement.
The Commissioners and staff discussed the location of the sewer line
and the amount of staff time necessary to do a full field survey.
There were no other comments filed, written or oral, so the Mayor
declared the hearing closed.
Moved by Commissioner Beggs, seconded by Commissioner Divine that
consideration of Ordinance Number 92-9501, providing for the vacation of a 70'
x 100' storm sewer easement on Lot 1, Block 1, Trochenbach Addition to the
City of Salina, Saline County, Kansas, be tabled for one week to
April 20, 1992, to give the petitioner time to have the lot surveyed. Aye:

(5.4) Public Hearing required by Resolution Number 92-4439, for the
vacation of the dedicated east -west alley on the South 15' of Lot 14, Block 4,
Southern Heights Addition to the City of Salina, Saline County. (Requested in
Petition Number 4033, filed by Leon Ashton)
(5.4a) First Reading Ordinance Number 92-9502, providing for the
vacation of all of the dedicated east -west alley on the South 15' of Lot
14, Block 4, Southern Heights Addition to the City of Salina, Saline
County, Kansas.
Shawn O'Leary, Assistant Director of Engineering and Utilities,
reviewed the petition and recommended the alley be vacated.

that Ordinance Number 92-9502, providing for the vacation of all of the
dedicated east -west alley on the South 15' of Lot 14, Block 4, Southern Heights
Addition to the City of Salina, Saline County, Kansas, be introduced for first

CONSENT AGENDA

DEVELOPMENT BUSINESS
ADMINISTRATION
(8.1) Second Reading Ordinance Number 92-9498, annexing certain land in
Section 35, Township 14 South, Range 3 West of the Sixth Principal Meridian in
Saline County, in conformity with the provisions of K.S.A. 12-520. (Schilling
Road and I-135 and Ninth Street Intersections) .
Moved by Commissioner Warner, seconded by Commissioner Brungardt
that Ordinance Number 92-9498, annexing certain land in Section 35, Township
14 South, Range 3 West of the Sixth Principal Meridian in Saline County, in
conformity with the provisions of K.S.A. 12-520, be adopted. Aye: Beggs,
Brungardt, Divine, Warner, Ryan. (5) . Nay: (0) . Motion adopted.
(8.2) Resolution Number 92-4449, authorizing the Mayor to execute and the
City Clerk to attest Supplemental Agreement Number 1 between the City of
Salina, Kansas and Wilson and Company, Engineers and Architects for design
services related to the rehabilitation of the existing treatment facilities and
the construction of advanced treatment facilities at the Wastewater Treatment
Plant Number 1.
Don Hoff, Director of Engineering and Utilities, reviewed the design
of the disinfection facility.
Moved by Commissioner Divine, seconded by Commissioner Brungardt
that Resolution Number 92-4449, authorizing the Mayor to execute and the City
Clerk to attest Supplemental Agreement Number 1 between the City of Salina,
Kansas and Wilson and Company, Engineers and Architects for design services

(8.3) Resolution Number 92-4450, appointing a member to the Convention
and Tourism Committee.
Moved by Commissioner Beggs, seconded by Commissioner Warner,
that Resolution Number 92-4450, appointing a member to the Convention and
Tourism Committee, be adopted. Aye: (5) . Nay: (0) . Motion adopted.
(8.4) Approve the Preliminary Official Statement for General Obligation
Internal Improvement and Refunding Bonds, Series P-240 and R-240, and
authorize George K. Baum & Company to proceed with a non-binding
pre -offering of the bonds.

Robert K. Biles, Director of Finance and Administration, provided an
update on the current interest rates and said the City could save approximately
$80,000 by refinancing the bonds at this time.
The Commissioners and staff discussed the difference between this
proposal and one presented on February 24, 1992 by Stephen Shogren of
Ranson Capital Corporation.

(8.5) Request for Executive Session to discuss a personnel matter.

that the Board of Commissioners recess into Executive Session for 10 minutes to
discuss a personnel matter involving non -elected personnel for the reason that
public discussion of the matter would invade the privacy of the non -elected
personnel involved. Aye: (5) . Nay: (0) . Motion adopted.
The Board of Commissioners recessed at 4:47 p.m. and reconvened at
