05-11-1992 Minutes92-186 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS MAY 11, 1992 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, May 11, 1992, at 4:00 p.m. There were present: Mayor Carol E. Beggs, Chairman presiding Commissioner Peter F. Brungardt Commissioner Stephen C. Ryan Commissioner Joseph A. Warner comprising a quorum of the Board, also present: Absent: Greg Bengtson, City Attorney Dennis M. Kissinger, City Manager Jacqueline Shiever, City Clerk Commissioner John Divine None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed the Week of May 10 through 16, 1992 as "NATIONAL POLICE WEEK", and Friday, May 15, 1992 as "PEACE OFFICER MEMORIAL DAY". The proclamation was read by Police Chaplain Paxton Jones. (4.2) The Mayor proclaimed the Week of May 10 through 16, 1992 as "EMERGENCY MEDICAL SERVICES WEEK." The proclamation was read by E.M.S. Lt . Calvin Kelsey. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting May 4, 1992. (6.2) Petition Number 4035, filed by Monty Montee, for the curbing, guttering, paving and grading of Kimberly Lane from Marcella Drive to Huehl Circle. None DEVELOPMENT BUSINESS 92-187 92-188 92-189 92-190 # ADMINISTRATION ------- --- (8.1) Second Reading Ordinance Number 92-9501, providing for the vacation of a 70' x 100' storm sewer easement, and the North 15' of the storm sewer easement along the north line of the vacated Woodland Avenue on Lot 1, Block 1, Trochenbach Addition to the City of Salina, Saline County, Kansas. Moved by Commissioner Ryan, seconded by Commissioner Warner that Ordinance Number 92-9501, providing for the vacation of a 70' x 100' storm sewer easement, and the North 15' of the storm sewer easement along the north line of the vacated Woodland Avenue on Lot 1, Block 1, Trochenbach Addition to the City of Salina, Saline County, Kansas, be adopted. (8.2) Second Reading Ordinance Number 92-9507, repealing Sections 38-51, 38-52, 38-53, 38-54, 38-55, 38-56, 38-57, 38-58, 38-59, 38-60, 38-61, 38-62, 38-63, 38-64, 38-65, 38-66, 38-67, 38-68, 38-69, 38-70, 38-71, 38-72, 38-73, 38-74, 38-75, 38-76, 38-77, 38-78, 38-79, 38-80 of the Salina Code, pertaining to parking in parking meter zones. Moved by Commissioner Brungardt, seconded by Commissioner Ryan that Ordinance Number 92-9507, repealing Sections 38-51, 38-52, 38-53, 38-54, 38-55, 38-56, 38-57, 38-58, 38-59, 38-60, 38-61, 38-62, 38-63, 38-64, 38-65, 38-66, 38-67, 38-68, 38-69, 38-70, 38-71, 38-72, 38-73, 38-74, 38-75, 38-76, 38-77, 38-78, 38-79, 38-80 of the Salina Code, pertaining to parking in parking meter zones, be adopted. (8.3) Resolution Number 92-4455, expressing the desire of the City of Salina that Public Wholesale Water Safety District Number 10 proceed with negotiations for a water purchase contract with the Kansas Water Authority and expressing the City's potential interest in purchasing water from the District. Don Hoff, Director of Engineering and Utilities, said the District has identified Lake Milford as an alternate source of water and while the City is reviewing other options for water sources, this Resolution simply expresses the City's potential interest in purchasing water from the District. Ernest Cole, 153 South Front, said he thought there was something in the Resolution that obligates the City. Dennis M. Kissinger, City Manager, assured Mr. Cole this is not a contract, but merely a statement of interest. Moved by Commissioner Ryan, seconded by Commissioner Warner that Resolution Number 92-4455, expressing the desire of the City of Salina that Public Wholesale Water Safety District Number 10 proceed with negotiations for a water purchase contract with the Kansas Water Authority and expressing the City's potential interest in purchasing water from the District, be adopted. Aye: (4) . Nay: (0) . Motion adopted. (8.4) Approve Change Order #3 for Engineering Project 90-817, for the water tower painting improvements, in the amount of $1,375.00. Don Hoff, Director of Engineering and Utilities, reviewed the project. Moved by Commissioner Warner, seconded by Commissioner Brungardt that Change Order #3 for Engineering Project 90-817, for the water tower painting improvements, in the amount of $1,375.00, be approved. Aye: (4). Nay: (0) . Motion adopted. (8.5) Request for Executive Session to discuss a legal matter. 92-191 Moved by Commissioner Ryan, seconded by Commissioner Brungardt that the Board of Commissioners recess into Executive Session for 20 minutes for the purpose of allowing the City Attorney to discuss with the Commissioners several matters of pending litigation, which matters are subject to the !! attorney/client privilege. The reasons for conducting the discussion in executive session are that public discussion at this time would adversely affect the City's position regarding the matters and would waive the attorney/ client privilege.
