09-14-1992 Minutes92-3 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS SEPTEMBER 14, 1992 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, September 14, 1992, at 4:00 p.m. There were present: Mayor Carol E. Beggs, Chairman presiding Commissioner Peter F. Brungardt Commissioner John Divine Commissioner Stephen C. Ryan Commissioner Joseph A. Warner comprising a quorum of the Board, also present: Absent: Greg Bengtson, City Attorney Jacqueline Shiever, City Clerk Roy Dudark, Acting City Manager Dennis M. Kissinger, City Manager None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed the Week of September 17 through 23, 1992 as "CONSTITUTION WEEK". The proclamation was read by Jean Hamilton, Constitution Week Chairman of the Mary Wade Strother Chapter of the Daughters of the American Revolution. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Public Hearing on vacation of the south 1' of the utility easement lying along the north property line of Lot 22, Block 1, Georgetown Addition to the City of Salina, Saline County, Kansas required by Resolution Number 92-4499, adopted by the Board of Commissioners on August 24, 1992. (Requested in Petition Number 4047 filed by Mary Steinbrock. ) (5.1a) First Reading Ordinance Number 92-9533, providing for the vacation of the south 1' of the utility easement lying along the north property line of Lot 22, Block 1, Georgetown Addition to the City of Salina, Saline County, Kansas. Shawn O'Leary, Assistant Director of Engineering and Utilities, reviewed the vacation request and recommended that the south 1' of the utility easement be vacated. Mayor Beggs declared the public hearing open. There were no comments filed, written or oral, so the Mayor declared the hearing closed. Moved by Commissioner Warner, seconded by Commissioner Divine that Ordinance Number 92-9533, providing for the vacation of the south 1' of the utility easement lying along the north property line of Lot 22, Block 1, Georgetown Addition to the City of Salina, Saline County, Kansas, be introduced for first reading. Street and Highland Avenue, from the west line of Highland Avenue to the east line of the intersecting north -south alley, between Jewell and Kirwin Avenues in the Grounds of Kansas Wesleyan University Addition to the City of j Salina, Saline County, Kansas. (This Resolution sets October 12, 1992 for public hearing on a request by Eldon Moyer and Stephanie Moyer.) (Introduce Ordinance Number 92-9534 for first reading.) i� Roy Dudark, Director of Planning and Community Development, reviewed the proposed amendment and recommended the ordinance be I, introduced for first reading. 92-371 Moved by Commissioner Divine, seconded by Commissioner Warner that Ordinance Number 92-9534 amending Chapter 42 of the Salina Code by adding Article XV, Airport Zoning District; and repealing Article IV of Chapter 4 of the Salina Code pertaining to Airport Zoning, be introduced for first reading. Motion adopted. �I ADMINISTRATION i, (8.1) First Reading Ordinance Number 92-9535, amending Section 13-104 of the Salina Code pertaining to Equal Opportunity; and repealing the existing section. Greg Bengtson, City Attorney, said this is the final amendment necessary to obtain certification by the Department of Housing and Urban Development (HUD) as a "substantially equivalent" agency for the purpose of processing housing discrimination complaints. 92-374 Moved by Commissioner Ryan, seconded by Commissioner Divine that Ordinance Number 92-9535, amending Section 13-104 of the Salina Code pertaining to Equal Opportunity; and repealing the existing section, be it introduced for first reading. Aye: (5) . Nay: (0) . Motion adopted. (8.2) Petition Number 4049 was filed by Randall Clark and Wynona Carol Clark, requesting that the Governing Body pass an ordinance amending the Salina Code by adding a section to be numbered 7-31.1 pertaining to pot bellied pigs, or submit the same to a vote of the electors. (The Saline County Clerk has certified that the petition contains 1,921 valid signatures Ii of the required 2,016 to require an election.) (8.2a) Request from Wynona Carol Clark to speak to Commissioners. Mrs. Clark reviewed the reasons for the petition process and the necessity for citizens to register to vote. She said this is an issue that will continue to come up and will have to be addressed sooner or later.
