Page 1 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS October 1, 2012 4:00 p.m. w The City Commission convened at 2:30 p.m. in a Study Session on Cloud and 9w Street Improvements. The Regular Meeting of the Board of Commissioners was called to order - at 4:00 p.m. in Room 107, City -County Building. A roll call was taken followed by the Pledge of Allegiance and a moment of silence. ' U There were present: Mayor Norman M. Jennings, Presiding Officer Commissioner Samantha P. Angell Commissioner Aaron Householter Commissioner Barb Shirley Absent: Commissioner Kaye J. Crawford comprising a quorum of the Board, also present: Jason A. Gage, City Manager Greg Bengtson, City Attorney Lieu Ann Elsey, City Clerk CITIZEN FORUM None. AWARDS AND PROCLAMATIONS (4.1) The day of October 10, 2012 as "Putting the Brakes on Fatalities Day' in the city of Salina. David Greiser, Public Affairs Officer with the Kansas Department of ' Transportation, read the proclamation and announced upcoming events. (4.2) The month of October 2012 as "Domestic Violence Awareness Month" in the city of Salina. Cameron Thurner, Outreach Specialist with DVACK, read the proclamation and announced upcoming events. (4.3) The month of October 2012 as "Breast Cancer Awareness Month' in the city of Salina. Cheri Sammons read the proclamation and announced upcoming events. Nay: (0). Motion carried. DEVELOPMENT BUSINESS None. Page 1 ADMINISTRATION (8.1) Authorize revisions to the reduced speed school zone around Oakdale Elementary. Dan Stack, City Engineer, explained the existing and school zone. Mr. Stack then responded to Mayor Jennings' question regarding the existing school zones within w the city limits. A discussion followed between Commissioner Angell and Mr. Stack regarding cost ' o sharing with the school district. Commission Angell felt that there is a need to look into cost sharing for future zone changes. 12-0250 Moved by Commissioner Angell, seconded by Commissioner Householter, to authorize staff to extend the current reduced speed school zone around Oakdale Elementary and construct the improvements next year with the 2013 Traffic Control operational budget. Aye: (4). Nay: (0). Motion carried. (8.2) First reading Ordinance No. 12-10660 amending Sections 8-174, 8-185 and 8-185.1 of Chapter 8, Article III of the Salina Code pertaining to qualifications for a building contractor and skilled trade license. Elvin DeVorss, Building Official, explained the request, Building Advisory Board's recommendation to not change the current code, and the proposed changes. Eric Campbell, Summit Plumbing Company, commented on the current regulations and concerns on allowing a master to work for different companies. Don Marrs, 2035 E. Iron Avenue, expressed his concerns of the responsibilities of a qualified individual. He continued to summarize state regulations regarding skilled trade contractors and the use of regulations to control quality. Mr. Marrs expressed his opposition of changing the current regulations. A discussion followed between Mayor Jennings, Mr. DeVorss, Commissioner Angell, Mr. Schrage, City Manager Jason Gage, and Commissioner Householter regarding supervision on job site and employees, qualified individual accountability, and regulating employment. Mr. Campbell again spoke on his opposition and concerns regarding allowing an employee to work for more than one company. 12-0251 Moved by Commissioner Angell, seconded by Commissioner Householter, to pass Ordinance No. 12-10660 on first reading. Aye: (4). Nay: (0). Motion carried. The City Commission also gave consensus to allow the Building Advisory Board to look into the concerns of qualified individuals responsibilities. (8.3) First reading Ordinance No. 12-10661 amending Sections 8-171, 8 -172,1 -Chart I, 8- 177, 8-178, 8-179, 8-180, 8-181 and 8 -182 -Chart III of Chapter 8, Article III of the Salina Code pertaining to the provisional contractor licensing requirements. Elvin DeVorss, Building Official, explained provisional contractor licenses and the proposed ordinance. 12-0252 Moved by Commissioner Householter, seconded by Commissioner Shirley, to pass Ordinance No. 12-10661 on first reading. ' (8.4) First reading Ordinance No. 12-10662 amending Section 8-172.1 of the Salina Code to allow a licensed specialty concrete contractor to perform concrete work in the right-of-way and to clarify the allowed scope of work under a Class A, B, or C Building Contractor license. Elvin DeVorss, Building Official, explained the current specialty and building contractor license and proposed amendments. Michael Schrage, Deputy City Manager, clarified the type of work that could be performed by a Class A, B, or C contractor. 12-0253 II Moved by Commissioner Shirley, seconded by Commissioner Householter, to pass Ordinance No. 12-10662 on first reading.
