The Regular Meeting of the Board of Commissioners met in the Commission
Meeting Room, City -County Building, on Monday, February 1, 1993, at 4:00
p.m.

AWARDS - PROCLAMATIONS
(4.1) The Mayor proclaimed the week of February 7 through 13, 1993 as
"SCOUTING ANNIVERSARY WEEK". The proclamation was read by
Robert Richards, representative of Boy Scout Troop 5.
(4.2) The Mayor proclaimed the week of February 7 through 13, 1993 as
"BLACK HISTORY WEEK". The proclamation was read by Gracie B. Cox,
member of the NAACP executive committee.
PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME
(5.1) Public hearing on the sidewalk improvements installed in Engineering
Project 89-791.
(5.1a) Introduce Ordinance Number 93-9550 for first reading.
Shawn O'Leary, Assistant Director of Engineering and Utilities,
reviewed the sidewalk program. He said the city constructs and pays for the
handicapped ramps and sidewalks constructed in the street right-of-way. The
property owner is assessed for the sidewalk constructed on his property.
Mayor Beggs declared the public hearing open.
There were no comments filed, written or oral, so the Mayor declared
the hearing closed.

that Ordinance Number 93-9550, levying special assessments on lots, pieces and
parcels of ground in the City of Salina, Kansas for the purpose of paying a
portion of the cost of property line sidewalk along the east side of OHIO
STREET from Greeley Avenue to Martin Avenue; curb line sidewalk along the
east side of PLANET AVENUE from Otto Avenue to Magnolia Road; curb line
sidewalk along the north side of SATURN AVENUE from Planet Avenue to the
east side of Ninth Street; curb line sidewalk along the north side of MAGNOLIA
ROAD from Planet Avenue to the east side of Ninth Street; curb line sidewalk
along the south side of Magnolia Road from the east side of Ninth Street west
and south to the parking lot at Mid State Mall, be introduced for first

(5.3) Public hearing on the sidewalk improvements on East Ellsworth
installed in Engineering Project 91-830.
(5.3a) Introduce Ordinance Number 93-9552 for first reading.
Mayor Beggs declared the public hearing open.
Virgil Augustine, 845 E. Ellsworth, said he received an estimate from
the City Engineer when this project started of approximately $600. He said the
latest notice he received for this improvement was approximately $1,000. He
asked the City Commissioners to reconsider the assessment to the original
estimate.
The Commissioners and staff discussed the notification process and
the method of estimation for improvement costs.
Marjie Garrigues, 907 E. Ellsworth, said she received a notice that
the cost for the sidewalk on her property had more than doubled since the
original estimate.
Dennis M. Kissinger, City Manager, said staff is looking at this
project and will report back to the Commissioners at the next meeting.
There were no other comments, written or filed, so the Mayor
declared the hearing closed.

Ordinance Number 93-9552, levying special assessments on lots, pieces and
parcels of ground in the City of Salina, Kansas for the purpose of paying a
portion of the cost of Curb line sidewalk along the north side of ELLSWORTH
AVENUE from the west line of Ohio Street to the east line of Roach Street, be
introduced for first reading. Aye: (5) . Nay: (0) . Motion adopted.
(5.4) Public hearing on the sidewalk improvements installed in Engineering
Project 91-834.
(5.4a) Introduce Ordinance Number 93-9553 for first reading.

(5.5) Public hearing on the street and utility improvements in Meyer, King
and Mayfair Additions, installed in Engineering Project 91-836.
(5.5a) Introduce Ordinance Number 93-9554 for first reading.

David Burnett, 2206 Linden Drive, said he received three different
notices containing different information and asked what he was being assessed
for. He questioned that the assessment rule is fair.
Lee Leaderbrand, 1418 Meyer, and Jack Reed, 2202 Linden Drive,
asked for clarification of the amount of their assessment and suggested that
property owners be given more notice of the pending assessments.
Marlin Wilson, President/CEO of Federated Foods, Inc., owners of
Shoney's restaurant, protested the amount of their assessment.
Shawn O'Leary, Assistant Director of Engineering and Utilities, said
this assessment is for the frontage road in front of his property. It was
constructed as a connecting link between two parts of the street previously
constructed. He said no building construction could occur unless the street
was improved.
There were no other comments, written or oral, so the Mayor
declared the hearing closed.

that Ordinance Number 93-9554, levying special assessments on lots, pieces and
parcels of ground in the City of Salina, Kansas for the purpose of paying a
portion of the cost of Curbing, guttering, paving, grading of MEYER DRIVE
from the south line of Martin Avenue to the end of the cul-de-sac; Installation
of a water main and water service to serve Lots 1 through 6, Block 1, Replat
of Meyer Addition; Installation of water main and water service to serve Lots
11 and 12, Block 5; and Lots 29 and 30, Block 6, Meyer Addition; Installation
of water service line of Lot 4, Block 1, King Addition; Installation of Lateral
Sanitary Sewer 667 to serve Lots 4, 5, 6 and 7, Block 1, King Addition;
Curbing, guttering, paving and grading of BENTLEY AVENUE from the east
line of Shalimar Drive to the west line of Linden Drive; The curbing,

(6.1) Approve the Minutes of the Regular Meeting January 25, 1993.
(6.2) Authorize the City Clerk to issue Taxi Cab License numbers 14 - 18
to Mike Scriven, dba City Cab; numbers 1, 2, 8 and 11 to Eloise French dba
Radio Cab -Yellow Taxi; and, numbers 20 - 21 to Edwin Piersee dba Sunflower
Taxi and Courier Service.
(6.3) Authorize the City Clerk to issue Surety on Bail Bond Service
License to Jack L. Kindlesparger, dba B & K Bonding; and, Surety on Bail
Bonds Agent Licenses to Jack L. Kindlesparger, Scott Kindlesparger, Scott J.
Anderson, Guy Ray Arnold, and Steve Klingzell, agents for B & K Bonding.

(7.1) Recommendation from the City Planning Commission that Zoning
Application 92-14, filed by Wally Storey, for the rezoning of an unplatted
tract containing 3.0 acres located in the SW 1/4 Section 14, Township 14 South,
Range 3 West. ( Rounds & Porter site, 601 S. Broadway) , be approved.
(7.1a) Introduce Ordinance Number 93-9557 for first reading.
Roy Dudark, Director of Planning and Community Development,
reviewed the application.
93-040 Moved by Commissioner Divine, seconded by Commissioner Warner that
the recommendation of the City Planning Commission be accepted and that
Ordinance Number 93-9557, providing for the amendment of Ordinance Number
8526, the same being Chapter 42 of the Salina Code, and the zoning district
map therein and thereby adopted and providing for the rezoning of certain
property within the city and prescribing the proper uses thereof, be
introduced for first reading. Aye: (5) . Nay: (0) . Motion adopted.
(7.2) Recommendation from the City Planning Commission that Plat
Application 92-8/8A, filed by Wally Storey, for the approval of the final plat
of Rounds and Porter Addition, a one lot subdivision containing 6.03 acres and
located on the east side of Broadway Boulevard, south of Armory Road (aka 601
S. Broadway), be approved.

that the recommendation of the City Planning Commission be accepted, that the
final plat of Rounds and Porter Addition be approved and that the Mayor be

(7.3) Consider acceptance of a grant from the Kansas Department of
Transportation for the realignment of a section of Centennial Road.
Roy Dudark, Director of Planning and Community Development,
reviewed the project. He said the Kansas Department of Transportation will
finance 75% of the actual total cost of the project.

(7.4) Applications for 1993 Kansas Emergency Shelter Grants.
Roy Dudark, Director of Planning and Community Development,
reviewed the Shelter Grant program. He said two local shelters have applied
and there will be no city dollars involved in this project.

the City Manager be authorized to file the applications and execute any related

ADMINISTRATION
(8.1) Resolution Number 93-4552, authorizing participation in the National
Federation of Municipal Analysts Certificate of Recognition Program.
Robert K. Biles, Director of Finance and Administration, reviewed the
program and said it is important for the city to participate in order to
maintain its high bond ratings.
Moved by Commissioner Brungardt, seconded by Commissioner Ryan
that Resolution Number 93-4552, authorizing participation in the National
Federation of Municipal Analysts Certificate of Recognition Program, be
adopted. Aye: (5) . Nay: (0) . Motion adopted.
(8.2) Report on bids received Tuesday, January 26, 1993 for Engineering
Project 92-868, Memorial Hall Building Improvements for Community Access
Television System (C . A . T . S .) . (Award the contract to Harbin Construction
Co., Inc. in the amount of $210,200).
Shawn O'Leary, Assistant Director of Engineering and Utilities,
reviewed the bids received and recommended the contract be awarded to Harbin
Construction Co., Inc. in the amount of $210,200 for the base bid and
alternates 3, 6 and 7.
Mike Henry, Executive Director of Community Access Television
System (C . A . T . S .) , reviewed the bid alternates and the items covered in each
alternate. He said they are seeking grants, donations and other fund raising
activities to fund the other alternates.
Moved by Commissioner Ryan, seconded by Commissioner Warner that
the staff recommendation be accepted and that the contract for Engineering
Project 92-868, Memorial Hall Building Improvements for Community Access
Television System (C . A . T . S .) be awarded to Harbin Construction Co., Inc. in
the amount of $210,200 for the base bid and alternates 3, 6 and 7. Aye: (5).

OTHER BUSINESS
Dennis M. Kissinger, City Manager, reported the house at 620 North
12th Street, which is part of the dangerous structures demolition project, is
being redeveloped. He recommended this structure be removed from the
contract for demolition of dangerous structures.
Moved by Commissioner Brungardt, seconded by Commissioner Ryan
that the structure located at 620 North 12th be deleted from the contract for
demolition of dangerous structures. Aye: (5) . Nay: (0) . Motion adopted.
