ORDINANCE NUMBER 13-10671 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF, WHEREAS, fourteen (14) individual applications (`Applications") were initiated by the Salina City Planning Commission on August 21, 2012 for the purpose of mapping the newly established ' a Public Use/Educational Facilities zoning district on fourteen (14) school properties within the city of Salina owned by USD No. 305; and U WHEREAS, notice of the proposed change in zoning classification was provided to neighboring property owners in proximity to each school site and a sign was posted on each school property; and WHEREAS, fourteen (14) individual public hearings were conducted by the Salina City Planning Commission on October 2, 2012 and December 4, 2012 to receive public input on each individual school site and the Planning Commission made a recommendation regarding the zoning classification of each school site individually and that recommendation was that all fourteen (14) school sites be rezoned to Public Use/Educational Facilities district; and WHEREAS, all other conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. FINDINGS. That the Governing Body concurs with the findings of the Planning Commission in relation to each of the Applications as follows: 11 1. The school site is an established public use in the neighborhood in which it is located and is compatible with surrounding uses. ' 2. The proposed Public Use zoning designation more accurately reflects the ownership and use of this school property than the current residential zoning designation. 3. A change to P(EF) zoning would be in conformance with the Future Land Use Map in the Comprehensive Plan which shows this school site as a Public / Semi -Public land use. Section 2. AMENDMENT. DISTRICT "P -(EF)". PUBLIC USE/EDUCATIONAL FACILITIES DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: Tract #1 South High School — 730 East Magnolia Road Block 1, Magnolia Addition to the City of Salina, Saline County, Kansas. Tract #2 Central High School — 650 East Crawford Street Lot 1, Block 1, Salina High School Central Subdivision, City of Salina, Saline County, Kansas. Tract #3 ' South Middle School — 2040 South 4`h Street Block 4, Gebhart Manor Addition to the City of Salina, Saline County, Kansas. Tract #4 Lakewood Middle School — 1135 Lakewood Circle Lot 1, Block 1, Lakewood School Addition to the City of Salina, Saline County, Kansas, less the following described portion of Lot 1, Block 1, Lakewood School Addition: Beginning at the Northeast corner of Block 7, Lakewood Addition; • thence on an assumed bearing of 90°00'00" E along the North line of said Lot 1 a distance of 176.82 feet; • thence S 00°16'51" W a distance of 274.77 feet; • thence N 89°47'23" W a distance of 175.42 feet to a point on the East line of said Block 7; thence N 00°00"42" W along said East line a distance of 274.12 feet to the Point of Beginning; said parcel containing 48,336 square feet, more or less, Plus the following described portion of Block 7 of the Lakewood Addition: inning at the Southeast corner of said Block 7; ■ thence along the South line of said Block 7 on a curve to the left with a radius of 216.91 feet, chord bearing of N 70659'18" W (assumed), a chord length of 141.23 feet and arc length of 143.85 feet; ■ thence S 89°59'39" W along said South line a distance of 26.49 feet; ■ thence N 00°00'42" W a distance of 161.37 feet; • thence S 89°47'23" E a distance of 160.01 feet to a point on the East line of said Block 7; • thence S 00°00'42" E along said East line a distance of 206.78 feet to the Point of Beginning, said parcel containing 27,724 square feet, more or less. That all prior ordinances in conflict herewith as they relate to the above ' described real estate are hereby repealed. Section 4. Summary of ordinance for publication. This ordinance shall be published by the following summary: Ordinance No. 13-10671 Summary On January 14, 2013, the City of Salina, Kansas, passed Ordinance No. 13-10671. The ordinance changes the zoning district classification of fourteen (14) individual public school sites owned by USD No. 305 to P -(EF) (Public Use/Education Facilities) in conformance with Future Land Use Map in the Salina Comprehensive Plan.
