AN ORDINANCE CALLING A SPECIAL ELECTION SUBMITTING TO THE
VOTE OF THE ELECTORS OF THE CITY OF SALINA, KANSAS, IN ACCORDANCE
WITH THE INITIATIVE AND REFERENDUM STATUTE (K.S.A. 12-3013), AN
w ORDINANCE REPEALING ORDINANCE NUMBER 12-10639, WHICH AMENDED
CHAPTER 13 OF THE SALINA CODE BY ADDING "SEXUAL ORIENTATION" AND
"GENDER IDENTITY" AS CLASSES PROTECTED FROM DISCRIMINATION.
' WHEREAS, Ordinance Number 12-10639, which amended Chapter 13 of the Salina Code
U by adding "sexual orientation" and "gender identity" as classes protected from discrimination (the
"Chapter 13 Ordinance"), was adopted by the Governing Body on second reading on May 21, 2012,
was published on June 1, 2012, and was effective commencing June 4, 2012; and
WHEREAS, the Saline County Election Officer has certified that a petition submitted
pursuant to the initiative and referendum statute (K.S.A. 12-3013) containing a request that the
Governing Body adopt an ordinance repealing the Chapter 13 Ordinance (the "Petition") was signed
by the required number of electors qualified to sign; and
WHEREAS, for the reasons that (a) on this 10`h day of September, 2012, a motion to
approve the ordinance set forth in the Petition was not approved on first reading and (b) a regular
city election will not be held within 90 days, the Governing Body is required by K.S.A. 12-3013 to
forthwith call a special city election and at such election submit the ordinance, without alteration, to
the vote of the electors of the city; SO NOW THEREFORE,
BE IT ORDAINED, by the Governing Body of the City of Salina, Kansas:
Section 1. In accordance with K.S.A. 12-3013, the Governing Body submits to the vote of
the electors of the city at a special city election to be held on the same date as and in conjunction
with the general election to be held on November 6, 2012, the following question:

An Ordinance of the City of Salina, Kansas repealing Ordinance 12-10639
which was titled "AN ORDINANCE AMENDING CHAPTER 13, OF THE
SALINA CODE PERTAINING TO EQUAL OPPORTUNITY AND
AFFIRMATIVE ACTION AND REPEALING EXISTING CHAPTER 13.'; passed
by the Governing Body of Salina, Kansas on May 21, 2012 to be effective on June.4,
2012.
BE IT ORDAINED by the Governing Body of Salina, Kansas:
Section 1. Ordinance Number 12-10639 of the City of Salina, Kansas, is
repealed.
Section 2. This Ordinance shall be in full force and effect after its adoption
by the Governing Body of the City of Salina, Kansas, or after approval of a majority
of the qualified voters of the City of Salina, Kansas.
' Section 2. If a majority of the electors of the city voting on the proposition approve the
proposed ordinance, the proposed ordinance shall thereupon become a valid and binding ordinance
of the City and Ordinance Number 12-10639 shall be repealed.
Section 3. The City Clerk is directed to request that the County Election Officer take all
steps necessary to include the proposition set forth in Section 1 above on the ballot for the special
city election to be held on the same date as and in conjunction with the general election to be held
on November 6, 2012.

On September 10, 2012, the City of Salina, Kansas, passed Ordinance No. 12-10656.
The ordinance calls a special election to be held on November 6, 2012, submitting to
