The proclamation was read by Glen Knack, President of the Smoky Valley Chapter of the Kansas Engineering Society. (4.2) The Mayor proclaimed the Week of February 14 through 20, 1993 as "VOCATIONAL EDUCATION WEEK." (6.2) An application for tax exemption has been filed by Salina Vortex, Inc., 3024 Arnold Avenue. (Set the date of February 22, 1993 for public hearing. ) (6.3) An application for tax exemption has been filed by SP Plastics Manufacturing, Inc., 1648 West Magnolia Road. ( Set the date of February 22, 1993 for public hearing.) (6.4) Set the date of March 2, 1993 at 10:00 a.m. to receive bids for various vehicles and equipment. (6.5) Authorize the City Clerk to issue 1993 Surety on Bail Bond Service Licenses to E. P. Nichols, dba Nichol's Bonding, and Bobby Gordon Smith, dba Bob's Bail Bond Service; and 1993 Surety on Bail Bond Agent Licenses to E. P. DEVELOPMENT BUSINESS (7.1) Recommendation from the City Planning Commission that Zoning Application 92-13, filed by William Stover, for the rezoning of Lot 11, Block 7, Replat of Faith Addition, be approved. ( This application was returned to the City Planning Commission and reconsidered on February 2, 1993.) [Introduce Ordinance Number 93-9558 for first reading.] (7.1a) Protest Petition Number 4053 was filed by Rob Pickerell, signed by property owners within 200' of the proposed property to be rezoned. Roy Dudark, Director of Planning and Community Development, reviewed the application which was approved by the City Planning Commission with certain conditions, and reported Protest Petition Number 4053 is a valid petition which will require a 4/5 vote of the City Commission to adopt the rezoning ordinance, if it moves to do so, when it is considered in two weeks. Rob Pickerell, 735 Moundview, said property owners in this area have relied on the city's previous District R zoning of this residential area when they built their homes. He said he feels property values will be hurt by placing a duplex in the neighborhood, and asked the City Commissioners to deny the rezoning request. The Commissioners and staff discussed drainage easements in the area and the notification process used in the special assessment process. Evelyn Maxwell, 414 Wayne, said she has studied the issue and feels that the city will lose credibility if it doesn't uphold the zoning according to the way it was platted. Bill Stover, 5001 Country Club Road, the applicant, said he feels the best use for this lot is multi -family. He said the unit will compliment the area and he will work with others in the neighborhood to alleviate any drainage problems from this lot. Moved by Commissioner Divine that Zoning Application #92-13, filed by William Stover, be denied. The motion died for lack of a second. Commissioner Divine left at 4:45 p.m. (7.2) Consider submittal of a grant application for repair of the Fox Theatre to the Kansas Historic Preservation Department under the Heritage Trust Fund Program for stabilization repairs. ADMINISTRATION (8.1) Resolution Number 93-4553, authorizing the Mayor to execute an agreement between the City of Salina, Kansas and the Housing Authority of the City of Salina, for the sale of Lots 7 through 13, Block 10, Replat of Faith Addition. Moved by Commissioner Ryan, seconded by Commissioner Brungardt that Ordinance Number 93-9558, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the zoning district map therein and thereby adopted and providing for the rezoning of certain property within the city and prescribing the proper uses thereof, be introduced for first reading. Dennis M. Kissinger, City Manager, said staff reviewed this project and decided to honor the estimates in the feasibility study. He explained that a change in the original scope of work brought the final costs higher. (8.11) Resolution Number 93-4555, authorizing the Mayor to execute and the City Clerk to attest an agreement between the City of Salina, Kansas and Missouri Pacific Railroad Company for a longitudinal pipeline encroachment located south of Cloud Street and west of Roberts Avenue. Shawn O'Leary, Assistant Director of Engineering and Utilities, reviewed the agreement and said there is a one time license fee of $600. Moved by Commissioner Ryan, seconded by Commissioner Warner that Resolution Number 93-4555, authorizing the Mayor to execute and the City Clerk to attest an agreement between the City of Salina, Kansas and Missouri Pacific Railroad Company for a longitudinal pipeline encroachment located south of Cloud Street and west of Roberts Avenue, be adopted. (8.12) Resolution Number 93-4556, authorizing and establishing certain charges for the operation of the Salina Municipal Golf Course, amending Resolution Number 92-4417 and repealing the existing resolution. Steve Snyder, Director of Parks and Recreation, said it is staff's recommendation to establish trail fees of $3.00 for 9 holes and $4.50 for 18 holes for all privately owned golf carts, and to reduce annual golf cart storage fees for gas and electric carts to $60.00 and $75.00, respectively. He said that staff is also recommending the existing storage building be demolished and that privatization of the cart storage operation be pursued. The Commissioners and staff discussed demolition of the storage building versus repairing the building. Jim Armes, 223 E. Ellsworth, member of the Golf Association and private golf cart owner, said he would like to see new facilities at the course, but feels the City should rent the facilities in order to control costs. He expressed his opinion that the proposed trail fees are too high. Blaine Daily, 767 Windsor Dr., said he does not have a cart but this is the second consecutive year that fees have been raised at the golf course. He asked that fee adjustments be made at the beginning instead of halfway through the year. Moved by Commissioner Warner, seconded by Commissioner Brungardt that Resolution Number 93-4556, authorizing and establishing certain charges for the operation of the Salina Municipal Golf Course, amending Resolution Number 92-4417 and repealing the existing resolution, be adopted. (8.13) Resolution Number 93-4557, designating and establishing parking zones within the City of Salina, Kansas, and the respective time limits therein; repealing all existing resolutions in conflict with the provisions of this Resolution and repealing Resolution Number 92-4493. Dennis M. Kissinger, City Manager, reviewed the request from Salina Business Improvement District No. 1 for revised parking time limits in certain downtown parking lots. Moved by Commissioner Ryan, seconded by Commissioner Brungardt that Resolution Number 93-4557, designating and establishing parking zones within the City of Salina, Kansas, and the respective time limits therein; repealing all existing resolutions in conflict with the provisions of this Resolution and repealing Resolution Number 92-4493, be adopted. Kansas I:r 93-065 93-066 93-067 93-069 ( 8.14) City Engineer reports on the sufficiency of Petition Number 4052 filed by Darvin Dent for certain street and utility improvements in the Austin Subdivision, and files a feasibility report. Shawn O'Leary, Assistant Director of Engineering and Utilities, reviewed the feasibility report and reported that the petition is valid as the property owners own 100% of the property in the benefit district. Moved by Commissioner Warner, seconded by Commissioner Ryan that the feasibility report for certain street and utility improvements in the Austin Subdivision be accepted. Aye: (4) . Nay: (0) . (8.15) Resolution Number 93-4558, determining the advisability of certain curbing, guttering, paving, grading, lateral sanitary sewer and water main and service improvements in Austin Subdivision, estimating the cost thereof, defining them boundaries of the improvement district, method of assessment, and apportioning the cost between the improvement district and the city -at -large. Moved by Commissioner Warner, seconded by Commissioner Ryan that Resolution Number 93-4558, determining the advisability of certain curbing, guttering, paving, grading, lateral sanitary sewer and water main and service improvements in Austin Subdivision, estimating the cost thereof, defining them boundaries of the improvement district, method of assessment, and apportioning the cost between the improvement district and the city -at -large, be adopted. (8.17) Resolution Number 93-4560, authorizing the Mayor to execute a license agreement between the City of Salina, Kansas and Images, Inc. for exclusive control of a rectangular area of a city -owned public parking lot for use as an Unloading Zone. Mike Peterson, Chief Building Inspector, reviewed the license agreement and changes required to comply with city building codes. Ken Reitz, Images, Inc., reviewed his situation and said he is attempting to solve the problems of safety and convenience for his patrons.
