REGULAR MEETING OF THE BOARD OF COMMISSIONERS
MARCH 1, 1993
4:00 p.m.
The Regular Meeting of the Board of Commissioners met in the Commission
Meeting Room, City -County Building, on Monday, March 1, 1993, at 4:00 p.m.
There were present:

CITIZEN FORUM
Bill Nelson, 917 North Thirteenth, Lot 22, requested a Fire Response
Time report from the Salina Fire Department, particularly for North Salina. He
said his insurance company is assessing a surcharge to insure commercial
properties in North Salina because of slower response times.
Mr. Nelson said he is currently receiving the City Commission packets
in the mail, but in the future, he will pick them up on Monday mornings.
AWARDS - PROCLAMATIONS
(4.1) The Mayor proclaimed the Week of March 7 through 13, 1993 as
"SAVE YOUR VISION WEEK." The proclamation was read by Susanne
Somers, Member of the North Central Zone of Para Optimetrics.
(4.2) The Mayor proclaimed the Week of March 7 through 13, 1993 as
"EMPLOY THE OLDER WORKER WEEK." The proclamation was read by Michael
Gleason, Job Developer for Older Kansans Employment Program.
(4.3) The Mayor proclaimed the Week of March 8 through 12, 1993 as
"SEVERE WEATHER WEEK." The proclamation was read by Gail Aills, Director
of Emergency Management.
PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME
(5.1) Continuation of the Public Hearing on an application for Tax
Exemption for SP Plastics Manufacturing, Inc., 1648 West Magnolia Road.
(5.1a) Resolution Number 93-4562, exempting certain property owned by
SP Plastics Manufacturing, Inc., located at 1648 West Magnolia Road,
Salina, Kansas, from ad valorem taxation and providing for certain terms
and conditions.
There were no comments filed, written or oral, so the Mayor declared
the hearing closed.

He said
the public hearing was opened
last week and
continued
to this week so
that the
applicant could make revisions.
He said the
amount of
property taxes
exempted
over 10 years is estimated to be $76,588, or
78%.

that Resolution Number 93-4562, exempting certain property owned by SP
Plastics Manufacturing, Inc., located at 1648 West Magnolia Road, Salina,
Kansas, from ad valorem taxation and providing for certain terms and

(5.2) Public Hearing on the proposed construction of certain improvements
at Wastewater Treatment Plant No. 1. (Effluent Disinfection Facility)
Don Hoff, Director of Engineering and Utilities, reviewed the project
and introduced LaVene Brenden, Director of Municipal Services with Wilson &
Company, the City's consultant on this project.
Mr. Brenden reviewed his firm's role in the project and said they
have studied various methods of disinfection and feel that the vertical ultra
violet system is the best method for the City. He said the estimated
construction cost of this facility is $1,000,000.
Mr. Brenden explained that the public hearing is a requirement of
the Environmental Protection Agency, which is providing grant funds for the
construction of this facility.
The Commissioners and staff discussed possible future improvements
to the new wastewater treatment facility based on EPA/KDHE requirements.
Joe Metzer, Kansas Department of Health and Environment, spoke
about the present contamination of the runoff stream and how the new facility
will help alleviate contamination downstream.
Mayor Beggs declared the public hearing open.
There were no comments filed, written or oral, so the Mayor declared
the hearing closed.
The City Commissioners took no action.
(5.3) Public Hearing on performance of Housing Rehabilitation Grant -
Project Number 91 -HR -080.
Roy Dudark, Director of Planning and Community Development,
reviewed the projects proposed under this grant and those actually completed.
He said 398 persons were benefitted by this grant in rehabilitations and
weatherization improvements.
Mayor Beggs declared the public hearing open.
There were no comments filed, written or oral, so the Mayor declared
the hearing closed.

(6.1) Approve the Minutes of the Regular Meeting February 22, 1993.

(7.1) Recommendation from the City Planning Commission that Annexation
Application 93-1, filed by the Kansas Highway Patrol, for the annexation of the
North 7.1 acres of the former Marymount College, be approved. (Introduce
Ordinance Number 93-9559 for first reading.)

that the recommendation from the City Planning Commission be accepted, that
Annexation Application 93-1 be approved, and that Ordinance Number 93-9559,
providing for the annexation of certain land in Lot Four (4) , Surveyor's Plat
No. Eighteen (18) , Section Seven (7) , all in Township Fourteen (14) South
Range Two (2) West of the Sixth Principal Meridian in Saline County, Kansas,
in conformity with the provisions of K.S.A. 12-519 to 12-526, inclusive, be

(7.2) Recommendation from the City Planning Commission that Zoning
Application 93-1, filed by the Kansas Highway Patrol, for the rezoning of the

reviewed the application. He said it is necessary that the zoning to be

providing for the rezoning of certain property within the City and prescribing

reviewed the application. He said drainage and traffic concerns have been
addressed by the applicant.
The Commissioners and staff discussed the upgrade of Schilling Road
and the mitigation of the drainage problems.

(8.3) Resolution Number 93-4571, authorizing and ordering certain curbing,
guttering, paving, grading, and water main and service improvements on
Huntington Road in Mayfair Addition, ordering preparation of plans and
specifications and the estimate of costs.
Shawn O'Leary, Assistant Director of Engineering and Utilities,
reviewed the project. He explained this is the second step in the process to
improve Huntington Road.
Robert Selm, 2160 Sherwood Lane, asked the City Commissioners to
reconsider the assessment formula for the improvements to Huntington Road.
He said the City should pay it's fair share of the cost of the improvements, as
it owns the ditch across the street.
Brian Lowe, 1320 East Wayne Avenue, asked why he was being
charged for water service when he already has water service to his lot. He
also said there is a drainage problem with the undeveloped lots.
Shawn O'Leary, Assistant Director of Engineering and Utilities, said
only the undeveloped lots will be assessed for water service improvements.
Carl Raccagno, 1316 East Wayne Avenue, said he talked with FEMA
( Federal Emergency Management Agency) officials and other cities. He said
that Robert Marietta, the petitioner, and the City of Salina can be held liable
for damages due to flooding because of these improvements.

that Resolution Number 93-4571, authorizing and ordering certain curbing,
guttering, paving, grading, and water main and service improvements on
Huntington Road in Mayfair Addition, ordering preparation of plans and
specifications and the estimate of costs, be adopted. Aye: (5) . Nay: (0) .

(8.4) City Engineer files plans and specifications for Engineering Project
93-872 for street and utility improvements in Austin Subdivision and Mayfair
Addition. (Set March 30, 1993 as the date to receive bids for this project.)

reviewed the project. He said completion of the project is anticipated in
August, 1993.

reviewed the proposed policy and specific qualifying criteria for certain
projects. He said certain mechanisms, such as public referendum and
public-private partnerships, are provided for in the policy.
