07-12-1993 Minutes• U 11 • 1 93-273 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS JULY 12, 1993 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, July 12, 1993, at 4:00 p.m. There were present: Mayor Peter F. Brungardt, Chairman presiding Commissioner Carol E. Beggs Commissioner John Divine Commissioner Joseph A. Warner comprising a quorum of the Board, also present: Absent: Greg Bengtson, City Attorney Dennis M. Kissinger, City Manager Jacqueline Shiever, City Clerk Commissioner Evelyn Maxwell None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed the week of July 11 through 17, 1993 as "NATIONAL THERAPEUTIC RECREATION WEEK". The proclamation was read by Janice Pankratz, Special Recreation Supervisor. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting June 28, 1993. (6.2) Set the date of August 17, 1993 to receive bids for Engineering Project 93-880, the Markley Road Booster Pump Station. (6.3) Resolution Number 93-4613, authorizing the Mayor to execute and the City Clerk to attest an agreement between the City of Salina, Kansas and Payless Cashways Building Materials concerning the implementation of a utility company bill payment drop box system at the Payless Cashways store located in Salina, Kansas. (6.4) Resolution Number 93-4615, directing public notice of application for the vacation of the 30' building setback and the 15' utility easement located on Tract 3, Woods and Durham Planned Development District, in the City of Salina, Saline County, Kansas. (This resolution sets August 2, 1993 for public hearing on the Medina request for vacation . ) (6.5) Resolution Number 93-4616, directing public notice of application for the vacation of a portion of Shady Bend Drive in the Replat of Moose Addition to the City of Salina, Saline County, Kansas. (This resolution sets August 2, 1993 for public hearing on the Summit Group request for vacation . ) (6.6) Set the date of July 27, 1993 to receive bids on a 1993 4 door sedan police patrol vehicle to replace a police cruiser damaged in a motor vehicle accident. Motion adopted. 93-274 93-275 93-276 None DEVELOPMENT BUSINESS ADMINISTRATION (8.1) Second Reading Ordinance Number 93-9576, providing for the vacation of the West 15' of the utility easement located on the West 17.5' of the vacated Michigan Avenue, from the south line of Iron Avenue to the North line of Stapler Avenue, in the City of Salina, Saline County, Kansas, on the condition that KPL and Cable Television companies relocate the existing pole guy wires. Moved by Commissioner Divine, seconded by Commissioner Beggs that Ordinance Number 93-9576, providing for the vacation of the West 15' of the utility easement located on the West 17.5' of the vacated Michigan Avenue, from the south line of Iron Avenue to the North line of Stapler Avenue, in the City of Salina, Saline County, Kansas, on the condition that KPL and Cable Television companies relocate the existing pole guy wires, be adopted. (8.2) Second Reading Ordinance Number 93-9579, authorizing and directing the issuance, sale and delivery of $3,200,000 principal amount of combined water and sewage system improvement revenue bonds of the City of Salina, Kansas, for the purpose of repairing, altering, extending, reconstructing, enlarging and improving the combined water and sewage system, prescribing the form and details of said revenue bonds, providing for the collection, segregation and application of the revenues of said system for the purposes authorized by law, including paying the cost of operation and maintenance of said utility, paying the principal of and interest on the revenue bonds of said City issued against said system and providing adequate reserve funds, making certain covenants with respect to said bonds; and approving a preliminary official statement and official statement relating to said bonds. (8.3) Second Reading Ordinance Number 93-9582, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof. (Tract 10, Centennial Commerce Center PDD, requested in PDD application 79-4E) . Moved by Commissioner Divine, seconded by Commissioner Warner that Ordinance Number 93-9582, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof, be adopted. (8.4) Second Reading Ordinance Number 93-9583, amending Section 27-16 of the Salina Code, regarding closing hours of certain parks and repealing the existing section. (This ordinance adds Centennial Park to the list of parks with a curfew.) 93-277 93-278 93-279 93-280 93-281 Moved by Commissioner Warner, seconded by Commissioner Beggs that Ordinance Number 93-9583, amending Section 27-16 of the Salina Code, regarding closing hours of certain parks and repealing the existing section, be adopted. Aye: Beggs, Divine, Warner, Brungardt. (4). Nay: (0). Commissioner Maxwell absent. Motion adopted. (8.5) Resolution Number 93-4617, authorizing and directing the issuance of Municipal Temporary Notes 1, 2, 3, Series PT -114, of the City of Salina, Kansas, in the amount of $210,000 to finance acquisition of a landfill compactor. Robert K. Biles, Director of Finance and Administration, said each note is in the amount of $70,000 with maturities in 1994, 1995 and 1996. He said the interest rate for each Municipal Temporary Note is 3.24%, 3.107. and 3.24%, respectively. Moved by Commissioner Warner, seconded by Commissioner Beggs that Resolution Number 93-4617, authorizing and directing the issuance of Municipal Temporary Notes 1, 2, 3, Series PT -114, of the City of Salina, Kansas, in the amount of $210,000 to finance acquisition of a landfill compactor, be adopted. (8.6) Resolution Number 93-4618, authorizing and directing the issuance of Municipal Temporary Note Number 1, Series PT -115 of the City of Salina, Kansas, in the amount of $620,000 for the purpose of providing funds to pay the construction of street and utility improvements in Tasker and Laurie Additions, all in said City. Moved by Commissioner Beggs, seconded by Commissioner Divine that Resolution Number 93-4618, authorizing and directing the issuance of Municipal Temporary Note Number 1, Series PT -115 of the City of Salina, Kansas, in the amount of $620,000 for the purpose of providing funds to pay the construction of street and utility improvements in Tasker and Laurie Additions, all in said City, be adopted. Aye: (4). Nay: (0). Motion adopted. (8.7) Resolution Number 93-4619, authorizing the Mayor to execute a special warranty deed from the City of Salina, Kansas to Byron F. Hutchison, D.D.S. who's property has been the subject of an Industrial Revenue Bond issue. Greg Bengtson, City Attorney, reviewed the Industrial Revenue Bond issue. He said the issue is fully paid and Dr. Hutchison has exercised his right to purchase the property from the City. This deed transfers ownership to Dr. Hutchison. Moved by Commissioner Warner, seconded by Commissioner Divine that Resolution Number 93-4619, authorizing the Mayor to execute a special warranty deed from the City of Salina, Kansas to Byron F. Hutchison, D.D.S. who's property has been the subject of an Industrial Revenue Bond issue, be adopted. Aye: (4). Nay: (0). Motion adopted. (8.8) Authorize the purchase of a 1993 C.D.C. model 1300 (demonstrator) custom built ambulance chassis as a sole source purchase from Carpenter Manufacturing, Inc., of Mitchell, Indiana, for an amount of $25,000; and authorize staff to contract with Emerge -A -Star, of St. Louis, Missouri, for the remount and refurbishment of the 1983 Horton Module for an amount of $24,984 with the trade of the old chassis. Dennis M. Kissinger, City Manager, reviewed this sole source purchase. Moved by Commissioner Divine, seconded by Commissioner Beggs that staff be authorized to purchase of a 1993 C.D.C. model 1300 (demonstrator) custom built ambulance chassis as a sole source purchase from Carpenter Manufacturing, Inc., of Mitchell, Indiana, for an amount of $25,000; and to contract with Emerge -A -Star, of St. Louis, Missouri, for the remount and refurbishment of the 1983 Horton Module for an amount of $24,984 with the trade of the old chassis. Motion adopted. 93-282 93-283 93-284 93-285 (8.9) Resolution Number 93-4620, authorizing the Mayor to execute an amendment to a contract between the City of Salina and Community Access Television of Salina, Inc. Dennis M. Kissinger, City Manager, reviewed the original contract. He said this amendment would allow C . A . T . S . to borrow money against equipment in which the City currently has an interest. Barry Williams, Vice Chair of the Board of Directors of Community Access Television of Salina, Inc. and Chair of the Finance Committee, discussed the Board's finance plan. Moved by Commissioner Divine, seconded by Commissioner Warner that Resolution Number 93-4620, authorizing the Mayor to execute an amendment to a contract between the City of Salina and Community Access Television of Salina, Inc., be adopted. Aye: (4) . Nay: (0) . Motion adopted. OTHER BUSINESS Dennis M. Kissinger, City Manager, said the recent rains have caused YMCA Drive to collapse at the crossing with the Smoky Hill River. He asked the City Commissioners to waive the formal bidding procedure in order to expedite the repair of the river crossing. Moved by Commissioner Divine, seconded by Commissioner Warner that the matter be added to the agenda for consideration at this time. Aye: (4) . Nay: (0). Motion adopted. Don Hoff, Director of Engineering and Utilities, said Engineering will approach three local firms for unit prices and begin the repairs within a week. Moved by Commissioner Divine, seconded by Commissioner Warner that staff be authorized to waive the normal bidding procedure, get unit price quotes from local firms and bring a contract to the City Commission for approval when formulated.
