Brungardt, Chairman presiding Commissioner Carol E. Beggs Commissioner John Divine Commissioner Evelyn Maxwell Commissioner Joseph A. Warner comprising a quorum of the Board, also present: Absent: Dennis M. Kissinger, City Manager Jacqueline Shiever, City Clerk Greg Bengtson, City Attorney None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed June 26 and 27, 1993 as "THE 125TH ANNIVERSARY CELEBRATION OF THE FIRST BAPTIST CHURCH". The proclamation was read by Harry McLeod, Chairman of the 125th Anniversary Celebration Committee. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Public Hearing on the request to vacate the west 15' of the north 290' and the south 90' of the utility easement located on the West 17.5' of the vacated Michigan Avenue from Iron Avenue to Stapler Avenue. (Requested in Petition Number 4060 filed by Bill Medina) . (5.1a) First Reading Ordinance 93-9576, providing for the vacation of the west 15' of the north 290' and the south 90' of the utility easement located on the west 17.5' of the vacated Michigan Avenue, from the south line of Iron Avenue to the north line of Stapler Avenue, in the City of Salina, Saline County, Kansas. Shawn O'Leary, Assistant Director of Engineering and Utilities, said the petitioner asked that consideration of this vacation request be tabled for one week in order to continue negotiations with utility companies. Mayor Brungardt declared the public hearing open. Moved by Commissioner Divine, seconded by Commissioner Warner that consideration of the request to vacate part of the utility easement on Michigan Avenue be tabled for one week and that the public hearing be continued until June 28, 1993. (5.2) Public Hearing on the request to vacate 60' of right-of-way on Crompton Road from the west line of Centennial Road to the east line of Scanlan Avenue; and to vacate 100' of right-of-way on Scanlan Avenue from the north line of Hayes Road to the south line of Crompton Road, in the Schilling Subdivision of the City of Salina, Saline County, Kansas. (Requested in Petition Number 4061 filed by Dean Barnum, Director of Facilities for K- State- Salina) . Shawn O'Leary, Assistant Director of Engineering and Utilities, said this vacation will allow the construction of facility improvements to the campus. Lee McQueen, K -State Salina, handed out revised maps of the campus and the proposed improvements. facilities. The Commissioners and staff discussed public access to campus Mike Renkin, Director of Community Affairs at K -State Salina answered questions about public access to the campus. Mayor Brungardt declared the public hearing open. There were no comments filed, written or oral, so the Mayor declared the hearing closed. Moved by Commissioner Warner, seconded by Commissioner Beggs that Ordinance 93-9577, providing for the vacation of 60' of right-of-way on Crompton Road from the west line of Centennial Road to the east line of Scanlan Avenue; and to vacate 100' of right-of-way on Scanlan Avenue from the north line of Hayes Road to the south line of Crompton Road, in the Schilling Subdivision of the City of Salina, Saline County, Kansas, be introduced for first reading. CONSENT AGENDA (6.1) Set the date of Tuesday, July 20, 1993 to receive bids for Engineering Project No. 93-876, Water Distribution Warehouse. (6.2) Petition Number 4063, filed by Bill Medina requesting vacation of the 30' building setback and the 15' utility easement that is within the setback, an area 30' wide by 221' long on Tract 3, Woods & Durham PDD, in the City of Salina, Saline County, Kansas. (Refer to the City Engineer for a report.) Moved by Commissioner Divine, seconded by Commissioner Beggs that all items on the Consent Agenda be approved. Aye: (5) . Nay: (0) . Motion adopted. None DEVELOPMENT BUSINESS ADMINISTRATION (8.1) Ordinance Number 93-9578, regulating traffic within the corporate limits of the City of Salina, Kansas; incorporating by reference the "Standard Traffic Ordinance for Kansas Cities," edition of 1992; and repealing the existing Section 38-1 of the Salina Code. Dennis M. Kissinger, City Manager, explained that this ordinance amends the Standard Traffic Ordinance, adopted by reference and brings the Salina Code into compliance with State Law by lowering the blood alcohol limit to .08. Moved by Commissioner Beggs, seconded by Commissioner Warner that Ordinance Number 93-9578, regulating traffic within the corporate limits of the City of Salina, Kansas; incorporating by reference the "Standard Traffic Ordinance for Kansas Cities," edition of 1992; and repealing the existing Section 38-1 of the Salina Code, be introduced for first reading. (8.2) Resolution Number 93-4607, authorizing the Mayor to execute and the City Clerk to attest an agreement for engineering services between the City of Salina, Kansas and Bucher, Willis & Ratliff for construction observation services during the painting of the Markley Tower in an amount not to exceed $6,600. 93-244 93-245 93-246 93-247 Don Hoff, Director of Engineering and Utilities, reviewed the agreement. Moved by Commissioner Warner, seconded by Commissioner Maxwell that Resolution Number 93-4607, authorizing the Mayor to execute and the City Clerk to attest an agreement for engineering services between the City of Salina, Kansas and Bucher, Willis & Ratliff for construction observation services during the painting of the Markley Tower in an amount not to exceed $6,600, be adopted. Aye: (5). Nay: (0). Motion adopted. (8.3) Receive and review the 1992 Audit Report from Kennedy & Coe and approve submittal of the report to the GFOA Certificate of Conformance Program. Robert K. Biles, Director of Finance and Administration, said the audit contains a "clean" opinion which means that the financial statements are presented fairly in all respects. David Mills, Certified Public Accountant for Kennedy & Coe, reviewed the audit and the state and federal guidelines governing the audit. He also reviewed the three matters of non-compliance. Moved by Commissioner Divine, seconded by Commissioner Warner that the 1992 Audit Report from Kennedy & Coe be accepted and that the submittal of the report to the GFOA Certificate of Conformance Program, be approved. Aye: (5). Nay: (0). Motion adopted. (8.4) Report on bids received June 15, 1993 to repair the Flood Control Ditch Checks. (Award the contract to Frank Construction Co., in the amount of $39,400.) Frank Weinhold, Director of General Services, reviewed the bids received. He said this project is budgeted from the 1993 Capital Improvement Program. Moved by Commissioner Beggs, seconded by Commissioner Maxwell that the staff recommendation be accepted and that the contract to repair the Flood Control Ditch Checks be awarded to Frank Construction Co., in the amount of $39,400.
