Brungardt, Chairman presiding Commissioner Carol E. Beggs Commissioner John Divine Commissioner Evelyn Maxwell Commissioner Joseph A. Warner comprising a quorum of the Board, also present: Absent: Greg Bengtson, City Attorney Dennis M. Kissinger, City Manager Jacqueline Shiever, City Clerk None None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed the Week of September 19 through 25, 1993 as "SALINA RESCUE MISSION WEEK." The proclamation was read by Debbie Divine, Member of the Board of Directors. (4.2) The Mayor proclaimed the Week of September 17 though 23, 1993 as "CONSTITUTION WEEK." The proclamation was read by Maxine Wilson, Constitution Week Chairman of the Mary Wade Strother Chapter of the Daughters of the American Revolution. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting September 1.3, 1993. (6.2) Set the date of Tuesday, November 9, 1993 as the date to receive bids on Engineering Project 93-879, Water Treatment Plant Chlorination Facility. (6.3) Petition Number 4066 was filed by Elly Ritter for certain street and utility improvements in Georgetown Addition, Replat of Blocks 4, 10, 11 and 12. (Refer the petition to the City Engineer for a report on its validity) Commissioner Maxwell stated that the minutes of the September 13 meeting, Item 7.1, should reflect that the amendment to the Code will allow the parking of motor homes, not mobile homes. Moved by Commissioner Warner, seconded by Commissioner Divine that all items on the Consent Agenda, with corrections to the minutes, be approved. Aye: (5). Nay: (0). Motion adopted. DEVELOPMENT BUSINESS (7.1) Move to remove from the table consideration of the recommendation of the City Planning Commission that Plat Application 93-6/6a, filed by Monty Montee and Danny Huehl, for the replat of part of Blocks 1 and 3 and all of Block 4, Country Oaks Subdivision, be approved. (Action on this item was postponed for one week at the September 13, 1993 meeting.) 93-381 93-382 93-383 93-384 Moved by Commissioner Maxwell, seconded by Commissioner Divine that consideration of Plat Application 93-6/6a, filed by Monty Montee and Danny Huehl, for the replat of part of Blocks 1 and 3 and all of Block 4, Country Oaks Subdivision, be removed from the table. Aye: (5) . Nay: (0) . Motion adopted. Roy Dudark, Director of Planning and Community Development, reviewed the plat application and the recommendation of the City Planning Commission. The Commissioners and staff discussed the pedestrian crossing over Dry Creek. Moved by Commissioner Beggs, seconded by Commissioner Maxwell that the recommendation from the City Planning Commission be accepted, that Plat Application 93-6/6a, filed by Monty Montee and Danny Huehl, for the replat of part of Blocks 1 and 3 and all of Block 4, Country Oaks Subdivision, be approved, and that the Mayor be authorized to sign the plat drawing. (7.2) Recommendation from the City Planning Commission that Zoning Application 93-8, filed by Ray and Dennis Lindenmuth, for the rezoning of Lots 139, 141, 143, 145 on Fourth Street, Original Townsite, from District R-3 (Multiple Family Residential) to District PC -5 (Planned Service Commercial), be approved. ( Introduce Ordinance Number 93-9597 for first reading.) Roy Dudark, Director of Planning and Community Development, reviewed the zoning application. The Commissioners and staff discussed drainage requirements and possible problems associated with the removal of trees. Commissioner Maxwell asked that the City Planning Commission consider the retention/removal of trees when reviewing various zoning applications. Moved by Commissioner Divine, seconded by Commissioner Warner that the recommendation of the City Planning Commission be accepted, that Zoning Application 93-8, filed by Ray and Dennis Lindenmuth, for the rezoning of Lots 139, 141, 143, 145 on Fourth Street, Original Townsite, from District R-3 (Multiple Family Residential) to District PC -5 (Planned Service Commercial), be approved and that Ordinance Number 93-9597, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain property within the City and prescribing the proper uses thereof, be introduced for first reading. ADMINISTRATION (8.1) Second Reading Ordinance Number 93-9593, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain land and prescribing the proper uses thereof. (Zoning Application 93-3, filed by Asbury Salina Regional Medical Center, for a text amendment to Chapter 42 of the Salina Code) (8.2) Second Reading Ordinance Number 93-9594, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain land and prescribing the proper uses thereof. (Planned Development District Application 93-7, filed by the City of Salina Parks and Recreation Department, for the rezoning of Stimmel School from Saline County Agricultural District to Planned Development District) Moved by Commissioner Beggs, seconded by Commissioner Maxwell that Ordinance Number 93-9593, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain land and prescribing the proper uses thereof, be adopted. (8.2) Second Reading Ordinance Number 93-9594, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain land and prescribing the proper uses thereof. Moved by Commissioner Warner, seconded by Commissioner Divine that Second Reading Ordinance Number 93-9594, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain land and prescribing the proper uses thereof, be tabled until November 1, 1993. (8.3) Second Reading Ordinance Number 83-9595, providing for the annexation of certain land in the Northeast Quarter of the Northwest Quarter of Section 1, Township 14 South, Range 3 West of the Sixth Principal Meridian in Saline County, Kansas, in conformity with the provisions of K.S.A. 12-519 to 12-526, inclusive. (Annexation Application 93-4, filed by the City of Salina Parks and Recreation Department, for the annexation of the Stimmel School.) Moved by Commissioner Maxwell, seconded by Commissioner Warner that Ordinance Number 83-9595, providing for the annexation of certain land in the Northeast Quarter of the Northwest Quarter of Section 1, Township 14 South, Range 3 West of the Sixth Principal Meridian in Saline County, Kansas, in conformity with the provisions of K.S.A. 12-519 to 12-526, inclusive, be adopted. (8.4) Second Reading Ordinance Number 83-9596, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain land and prescribing the proper uses thereof. (Planned Development District Application 88/4B, filed by Monty Montee and Danny Huehl, for the rezoning of Part of Blocks 1 and 3 and all of Block 4, Replat of Country Oak Estates Addition from PDD to PDD/R-2, PDD/C-2 and PDD/C-5) Moved by Commissioner Divine, seconded by Commissioner Maxwell that Ordinance Number 83-9596, providing for the amendment of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, and the Zoning District Map therein and thereby adopted and providing for the rezoning of certain land and prescribing the proper uses thereof, be adopted. Aye: Beggs, Divine, Maxwell, Warner, Brungardt. (5). Nay: (0). Motion adopted. (8.5) First Reading Ordinance Number 93-9598, amending Section 39-115 of the Salina Code regarding the marking of vehicles and equipment by licensed tree trimmers; and repealing the existing section. Steve Snyder, Director of Parks and Recreation, reviewed the proposed changes regarding signage requirements of licensed tree trimmers. Moved by Commissioner Warner, seconded by Commissioner Beggs that Ordinance Number 93-9598, amending Section 39-115 of the Salina Code regarding the marking of vehicles and equipment by licensed tree trimmers; and repealing the existing section, be introduced for first reading. (8.6) Report on bids received September 14, 1993 for Golf Course Cold Storage/Cart Storage Building, Engineering Project 93-884, at the Salina Municipal Golf Course. (Award the contract to Salina Building Systems in the amount of $58,751.) Steve Snyder, Director of Parks and Recreation, reviewed the bids received and recommended the contract be awarded to Salina Building Systems in the amount of $58,751. He said the project will be financed through the issuance of general obligation bonds. Moved by Commissioner Beggs, seconded by Commissioner Divine that the staff recommendation be accepted and that the contract for Golf Course Cold Storage/Cart Storage Building, Engineering Project 93-884, at the Salina Municipal Golf Course be awarded to Salina Building Systems in the amount of $58,751.
