05-09-1994 MinutesThe Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, May 9, 1994, at 4:00 p.m. There were present: Mayor Joseph A. Warner, Chairman presiding Commissioner Carol E. Beggs Commissioner Peter F. Brungardt Commissioner Evelyn Maxwell comprising a quorum of the Board, also present: Greg Bengtson, City Attorney Dennis M. Kissinger, City Manager Judy D. Long, City Clerk Absent: Commissioner John Divine CITIZEN FORUM Bob Schmidt, 119 E. Iron, President of the Salina Downtown Lions Club presented the Arts and Humanities foundation with a $2,000 donation for the Oakdale Stage. AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed the week of May 9th through 15th, 1994 as "NATIONAL SALVATION ARMY WEEK." The Proclamation was read by Captain Ronald Lemirand of The Salvation Army. (4.2) The Mayor proclaimed the week of May 8th through 14th, 1994 as "NATIONAL CHILDREN'S WEEK." The Proclamation was read by Mary Anna Anschutz, President of Wheat State Chapter #599 of the Council for Exceptional Children. (4.3) The Mayor proclaimed the week of May 9th through 15th, 1994 as "NATIONAL POLICE WEEK." The proclamation was read by Paul Wilke, Salina Police Department Chaplin. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting of May 2, 1994. 94-190 Moved by Commissioner Maxwell, seconded by Commissioner Beggs that the Consent Agenda item be approved. DEVELOPMENT BUSINESS None ADMINISTRATION (8.1) Second Reading Ordinance Number 94-9632, relating to the cutting of weeds and vegetation, providing for notice and providing for cutting by the City of Salina, and providing for charges therefor. Antibn #- 94-191 Moved by Commissioner Brungardt, seconded by Commissioner Beggs that Ordinance Number 94-9632, relating to the cutting of weeds and vegetation, providing for notice and providing for cutting by the City of Salina, and providing for charges therefor, be adopted. Aye: Beggs, Brungardt, Maxwell, Warner. (4) . Nay: (0) . Motion carried. i (8.2) First Reading Ordinance Number 94-9633, pertaining to the licensing of cats and dogs in the City of Salina. Judy D. Long, City Clerk, reviewed the proposed changes. 94-192 Moved by Commissioner Beggs, seconded by Commissioner Maxwell that Ordinance Number 94-9633, pertaining to the licensing of cats and dogs in the City of Salina, be introduced for first reading. Aye: (4) . Nay: (0) . Motion carried. (8.3) Resolution Number 94-4737, designating and establishing parking zones within the City of Salina. Shawn O'Leary, Assistant Director of Engineering and Utilities, explained the request to change some parking time limits in the 100 block of North Fifth Street. Nick Slechta, Executive Director of the Salina Business Improvement District, explained the need for the changes. Ann Knowles, owner of Uniglobe Knowles Travel, expressed her opposition to the change. 94-193 Moved by Commissioner Beggs, seconded by Commissioner Maxwell that Resolution Number 94-4737, designating and establishing parking zones within the City of Salina, be adopted. (8.4) Resolution Number 94-4738, authorizing the Mayor to execute agreements between the City of Salina, Kansas and UMB National Bank of America, Tony's Pizza, Philips Lighting, McDonald's and Bear Promotions and Mid-America Awards providing for the purchase of advertising on scoreboards at Bill Burke Park. Steve Snyder, Director of Parks and Recreation, explained the scoreboard purchase and the agreements with the advertising sponsors. 94-194 Moved by Commissioner Beggs, seconded by Commissioner Brungardt that Resolution Number 94-4738, authorizing the Mayor to execute agreements between the City of Salina, Kansas and UMB National Bank of America, Tony's Pizza, Philips Lighting, McDonald's and Bear Promotions and Mid-America Awards providing for the purchase of advertising on scoreboards at Bill Burke Park, be adopted. Aye: (4). Nay: (0). Motion carried. (8.5) Resolution Number 94-4739, authorizing the City to provide grant funding to U.S.D. 305 in the amount of $47,200 to continue certain drug and alcohol intervention programs. Dennis M. Kissinger, City Manager, explained the necessity to provide support for the Drug Abuse Prevention and Intervention Program. Dr. Andy Tompkins, Superintendent for U.S.D. #305, explained the DARE program and said its funding is separate from this request. Betty McFall explained how the program is associated with the Police Department. 94-195 Moved by Commissioner Brungardt, seconded by Commissioner Beggs that Resolution Number 94-4739, authorizing the City to provide grant funding to U.S.D. 305 in the amount of $47,200 to continue certain drug and alcohol intervention programs, be adopted. Commission-_ -— -- (8.6) Request for Executive Session to discuss legal matter. 94-196 Moved Moved by Commissioner Brungardt, seconded by Commissioner Beggs that the Board of Commissioners recess into executive session for 15 minutes for the purpose of discussing a matter subject to the attorney-client privilege, for the reason that public discussion of the matter would waive the attorney-client privilege and would adversely affect the City's position in the matter. Aye: (4). Nay: (0). Motion carried. The Board of Commissioners adjourned at 4:57 p.m. and reconvened at 5:12 p.m. Dennis M. Kissinger, City Manager, said that the City was notified, as of April 29, that in the matter of The City of Salina vs. Maryland Casualty, the judge found in favor of Maryland Casualty. He said this is still under advisement and a recommendation will be made at the May 23rd meeting. OTHER BUSINESS Commissioner Maxwell asked if anyone else was going to Topeka on May 25th and 26th for a Reinventing Government Conference. Dennis M. Kissinger, City Manager, explained that Commissioner Divine will be going. Mayor Warner asked for a report after the conference.
