ORDINANCE NUMBER 03-10166
AN ORDINANCE AMENDING CHAPTER 8, ARTICLE XIV, SECTIONS 8-461
AND 8-468 OF THE SALINA CODE PERTAINING TO PRIVATE SWIMMING POOLS
AND ENCLOSURE OF POOLS AND REPEALING EXISTING SECTIONS 8-461 AND 8-
468.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That Sections 8-461 and 8-468 of Chapter, Article XIV of the Salina Code is
hereby amended to read as follows:
"Section 8-461. Definitions.
Sec. 8-461. Definitions.
For the purpose of this article, certain terms shall have the meanings respectively
ascribed to them:
(1) Private swimming pool shall mean that it is not open to the public, that it is not
publicly owned or not otherwise regulated by the State of Kansas, either by statute
or by rules and regulations by one of its administrative bodies.
(2) Permanent Swimming pool shall mean any permanently constructed structure in or
on the ground intended for swimming or wading, having a depth of two (2) feet or
more at any point.
(3) Portable Swimming pool shall mean any manufactured inflatable or collapsible
pool designed to be stored for non seasonal use and intended for swimming or
wading, having a depth of two (2) feet or more at any point.
Sec. 8-468. Enclosure of pools.
Every private permanent swimming pool shall be completely enclosed by a fence or
wall not less than six (6) f eet in h eight. E very p rivate p ortable swimming p ool shall b e
completely enclosed by a fence or wall not less than 42 inches in height. The design of such
fence or wall may be solid or shall be designed so that no portion of the fence or wall shall
permit the passing of a six-inch sphere through the fence or wall. In addition the fence or
wall shall not be designed with features which could be used for climbing over said fence or
wall. Maximum mesh size for chain link fences shall be a 2.25 -inch square. Gates shall be
self-closing and shall have a latch or other mechanism which shall engage automatically on
closing.. Where the release mechanism of the self -latching device is located less than 54
inches from the bottom of the gate, the release mechanism shall be located on the pool side
of the gate at least 3 inches below the top of the gate, and the gate and barrier shall have no
opening greater than 0.5 inch within 18 inches of the release mechanism. Exception: The
door of a dwelling which opens onto a pool enclosure need not be equipped with such a
device."
Section 2. That the existing Sections 8-461 and 8-468 of the Salina Code are hereby
repealed.
