08-25-2003 MinutesCommission Action # 03-61 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS August 25, 2003 4:00 p.m. The City Commission convened at 3:00 p.m. in a Study Session for a Municipal Court Tour. The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in Room 107, City - County Building. A roll call was taken followed by the Pledge of Allegiance and a moment of silence. There were present: Mayor Alan E. Jilka, Chairman presiding Commissioner Deborah P. Divine Commissioner Monte D. Shadwick Commissioner Paul G. Webb comprising a quorum of the Board, also present: Michael Morgan, Deputy City Manager Greg Bengtson, City Attorney Lieu Ann Nicola, City Clerk Absent: Commissioner Donnie D. Marrs None. CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The month of September 2003 as "National Alcohol and Drug Addiction Recovery Month" in the City of Salina. Les Sperling with the Central Kansas Foundation read the proclamation and announced upcoming events. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None. CONSENT AGENDA (6.1) Approve the minutes of August 18, 2003. (6.2) Resolution No. 03-5979 making certain findings regarding the allocation of special assessments to certain tracts for utility improvements to serve North Ohio Street. Moved by Commissioner Webb, seconded by Commissioner Divine, to approve the consent agenda as presented. Aye: (4). Nay: (0). Motion carried. None. DEVELOPMENT BUSINESS ADMINISTRATION (8.1) Second reading Ordinance No. 03-10144 amending Section 36-74.1 of the Salina Code to establish minimum design and paving standards for private streets in residential subdivisions. Lieu Ann Nicola, City Clerk, clarified that Ordinance No. 03-10144 was passed on first reading on August 18, 2003 and since that time no comments have been received. Moved by Commissioner Shadwick, seconded by Commissioner Webb, to adopt Ordinance No. 03-10144 on second reading. A roll call vote was taken. Aye: (4) Divine, Shadwick, Webb, Jilka. Nay: (0). (8.2) Second reading Ordinance No. 03-10159 levying special assessments against certain lots Commission Action # Consoii0aletl.5alina and pieces of property to pay the cost of abatement of nuisances. Lieu Ann Nicola, City Clerk, clarified that Ordinance No. 03-10159 was passed on first reading on August 18, 2003 and since that time no comments have been received. 03-6101 Moved by Commissioner Shadwick, seconded by Commissioner Divine, to adopt Ordinance No. 03-10159 on second reading. (8.3) Second reading Ordinance No. 03-10164 annexing a 14 -acre tract located on the south side of Schilling Road east of the Lowe's Home Improvement Center, also known as the 300 Block of East Schilling Road. Lieu Ann Nicola, City Clerk, clarified that Ordinance No. 03-101,54 was passed on first reading on August 18, 2003 and since that time no comments have been received. 03-6102 Moved by Commissioner Shadwick, seconded by Commissioner Divine, to adopt Ordinance No. 03-10164 on second reading. (8.4) Second reading Ordinance No. 03-10165 providing for a change in zoning district classification from Saline County IL (Light Industrial) to C-5 (Service Commercial, C-6 (Heavy Commercial) and I-2 (Light Industrial) on Lots 1 — 13, Block 1 of the Replat of Bland Subdivision. Lieu Ann Nicola, City Clerk, clarified that Ordinance No. 03-10165 was passed on first reading on August 18, 2003 and since that time no comments have been received. 03-6103 Moved by Commissioner Divine, seconded by Commissioner Webb, to adopt Ordinance No. 03-10165 on second reading. (8.5) First reading Ordinance No. 03-10166 amending Chapter 8, Sections 8-461 and 8-468 of the Salina Code pertaining to definitions and enclosure of pools. Mike Roberts, Building Official, explained the current code requirements, proposed amendments to allow chain link fences as an approved enclosure for pools, and reduce the required height enclosure for temporary pools from six feet to 42 inches. Mr. Roberts also responded to Commissioner Divine's inquiry regarding service calls received in the Building; Services Department regarding the pools. 03-6104 Moved by Commissioner Divine, seconded by Commissioner Webb, to pass Ordinance No. 03-10166 on first reading and declare an emergency exists for second reading on the same day. Aye: (4). Nay: (0). Motion carried. 03-6105 Moved by Commissioner Shadwick, seconded by Commissioner Webb, to adopt Ordinance No. 03-10166 on second reading. A roll call vote was taken. (8.6) Resolution No. 03-5980 appointing members to the Arts and Humanities Commission, Business Improvement District No. 1 Board of Advisors, Business Improvement District No. 1 Design Review Board, Convention and Tourism Committee, Housing Authority, Human Relations Commission, Parks and Recreation Advisory Board, Salina Planning Commission, Tree Advisory Board, Board of Zoning Appeals, and the Salina/Saline County Solid Waste Management Committee. Commissioner Divine requested that this item be postponed until September 8, 2003 and direct staff to review the appointment procedures. A discussion followed between the City Commission, Deputy City Manager Michael Morgan, and City Attorney Greg Bengtson regarding the board appointment procedures and requirements of an Expression of Interest Form on file. 03-6106 Moved by Commissioner Divine, seconded by Commissioner Shadwick, to postpone the consideration of Resolution No. 03-5980 until September 8, 2003 and ask staff'to review the boards Commission Action # 03-610 03-6108 03-6109 03-6110 and commission appointment procedures. (8.7) Resolution No. 03-5978 initiating proceedings for the construction of waterworks systems extending from the Union Pacific Railroad tracks along Schilling Road and north along Ohio Street to Magnolia Road. Rodney Franz, Director of Finance and Administration, explained that the proposed resolution was necessary to initiate the project and provides that the City intends to reimburse itself with bond proceeds. Moved by Commissioner Shadwick, seconded by Commissioner Divine, to adopt Resolution No. 03-5978. Aye: (4). Nay: (0). Motion carried. (8.8) Change Order No. 2 for the 2003 Subdivision Improvements, Liberty Addition, Project No. 03-1404. Brad Johnson, Civil Engineer, explained the project, change order and project funding. Moved by Commissioner Divine, seconded by Commissioner Webb, to approve Change Order No. 2 for the 2003 Subdivision Improvements, Liberty Addition, Project No. 03-1404 with APAC-Kansas, Inc., Shears Division in the amount of $25,247.25. (8.9) Staff report from Assistant City Manager and Director of Utilities regarding Water Watch status and city actions concerning water conservation issues for September and October. Doug Gerber, Assistant City Manager, explained that in late July Governor Sebelius declared a "Drought Watch" in Saline County. He continued to explain that the goals of the City are to reduce the City of Salina public water usage by 20 percent in September and October; as well as reducing community water usage by 20 percent in September and October. Mr. Gerber noted that although the City of Salina is perceived as being a large water user, city facilities account for only a small portion of the overall daily citywide water usage, but the City must be the leader in these efforts. Mr. Gerber then summarized City facilities that were on a low, medium, and high priority watering level. OTHER BUSINESS (9.1) Resolution No. 03-5981 authorizing the Mayor to execute a Permanent Electrical Utility Easement for Underground Service. Brad Johnson, Civil Engineer, explained that Southwestern Bell Company is currently involved with a project involving their electrical service that is provided by Westar Energy, Inc. He continued to explain that Westar has requested an electrical utility easement diagonally traversing the City's public parking lot that is located south of Southwestern Bell Company's building in the 100 block of South Seventh Street. Moved by Commissioner Divine, seconded by Commissioner Shadwick, to adopt Resolution No. 03-5981. Aye: (4). Nay: (0). Motion carried.
