05-23-1994 MinutesCITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS MAY 23, 1994 ij4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, May 23, 1994, at 4:00 p.m. There were present: Mayor Joseph A. Warner, Chairman presiding Commissioner Carol E. Beggs Commissioner Peter F. Brungardt Commissioner John Divine Commissioner Evelyn Maxwell comprising a quorum of the Board, also present: Greg Bengtson, City Attorney Dennis M. Kissinger, City Manager Judy D. Long, City Clerk Absent: None CITIZEN FORUM None AWARDS - PROCLAMATIONS (4.1) Resolution Number 94-4742 expressing appreciation and gratitude to Jerry L. Berg for serving as a Firefighter and Fire Engineer/EMT for the Salina Fire Department from November 16, 1971 until April 15, 1994. 94-208 Moved by Commissioner Maxwell, seconded by Commissioner Brungardt that Resolution Number 94-4742 expressing appreciation and gratitude to Jerry L. Berg for serving as a Firefighter and Fire Engineer/EMT for the Salina Fire Department from November 16, 1971 until April 15, 1994, be adopted. Aye: (5). Nay: (0). Motion carried. (4.2) The Mayor proclaimed the 28th Day of May, 1994 as "POPPY DAY." The proclamation was read by Cynthia Campbell, American Legion Auxiliary Member. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting of May 16, 1994. (6.2) Set the date of Tuesday, June 14, 1994, as the date to receive bids on Engineering Project 94-908, Bicentennial Center Storefront and Vestibule (Airlock) Improvements. i (6.3) An application for Taxi Cab License Number 32 has been filed by j Fredrick Verl Thayer, 114 E. Beloit, dba Economy Cab Service. j (6.4) Resolution Number 94-4745 consenting, subject to conditions to a corporate reorganization affecting Communications Services, Inc. Judy D. None DEVELOPMENT BUSINESS ADMINISTRATION (8.1) Second Reading Ordinance Number 94-9634, authorizing and directing the issuance, sale and delivery of $1,175,000 principal amount of general obligation internal improvement bonds of the City of Salina, Kansas, Series 1994-A for the purpose of providing funds to pay the cost of certain street and utility improvements in the city. 94-211 '', Moved by Commissioner Beggs, seconded by Commissioner Maxwell 1i that Ordinance Number 94-9634, authorizing and directing the issuance, sale and delivery of $1,175,000 principal amount of general obligation internal improvement bonds of the City of Salina, Kansas, Series 1994-A for the purpose of providing funds to pay the cost of certain street and utility improvements in the city, be adopted. (8.3) First Reading Ordinance Number 94-9636, amending Chapter 27, Article II, of the Salina Code regarding Lakewood Lake Boating Limitations. Steve Snyder, Director of Parks and Recreation, explained the need for the ordinance. 94-213 Moved by Commissioner Brungardt, seconded by Commissioner Divine that Ordinance Number 94-9636, amending Chapter 27, Article II, of the Salina Code regarding Lakewood Lake Boating Limitations, be introduced for first reading. Aye: (5) . Nay: (0) . Motion carried. (8.4) Resolution Number 94-4744, authorizing the Mayor to execute an agreement between the City of Salina, Kansas and Bucher, Willis & Ratliff for professional architectural, engineering and consulting services for General Services Building Addition and Interior Modification. Frank Weinhold, Director of General Services, presented the need for the expansion and recommended approval of the resolution. 94-214 ',' Moved by Commissioner Maxwell, seconded by Commissioner Divine that Resolution Number 94-4744, authorizing the Mayor to execute an agreement between the City of Salina, Kansas and Bucher, Willis & Ratliff for professional architectural, engineering and consulting services for General Services Building Addition and Interior Modification, be adopted in an amount not to exceed $22,252, to be paid from the general fund. (8.5) Resolution Number 94-4743, authorizing the Mayor to execute a facility use agreement with Martin Luther King, Jr., Child Care Center, Inc., for the use of Carver Center. Steve Snyder, request. Director of Parks and Recreation, explained the Jerry Jones Ohlmann, Director of the Martin Luther King, Jr. Child Care Center, answered questions from the Commissioners. 94-215 'I Moved by Commissioner Divine, seconded by Commissioner Maxwell that Resolution Number 94-4743, authorizing the Mayor to execute a facility use agreement with Martin Luther King, Jr., Child Care Center, Inc., for the use of Carver Center, be adopted. Aye: (5). Nay: (0). Motion carried. (8.6) Report on bids received Tuesday, May 17, 1994 for the 1994 Latex Modified Slurry Seal, Engineering Project 94-903. (Award the contract to Ballou Construction Co., Inc., in the amount of $400,145.) Shawn O'Leary, Assistant Director of Engineering and Utilities, presented a report on the bid letting. 94-216 Moved by Commissioner Brungardt, seconded by Commissioner Maxwell i that the staff recommendation be accepted and that the contract for the 1994 Latex Modified Slurry Seal, Engineering Pro ect 94-903, be awarded to Ballou �I Construction Co., Inc., in the amount of 400,145. Aye: (5) . Nay: (0) . Motion carried. (8.7) Report on bids received Tuesday, May 17, 1994 for the 1994 Joint and Crack Sealing, Engineering Project 94-902. (Award the contract to Billings I Development Corp. in the amount of $91,106.10.) Shawn O'Leary, Assistant Director of Engineering and Utilities, presented a report on the bids received. 94-21.7 Moved by Commissioner Beggs, seconded by Commissioner Maxwell that the staff recommendation be accepted and that the contract for the 1994 Joint and Crack Sealing, Engineering Project 94-902, be awarded to Billings Development Corp. in the amount of $91,106.10. Aye: (5). Nay: (0). Motion carried. (8.8) Report on bids received Tuesday, May 17, 1994 for crane truck for the Water and Wastewater Division. (Award the contract to Long -McArthur, Inc. in the amount of $48,207). Don Hoff, Director of Engineering and Utilities, reviewed the bids received. 94-218 Moved by Commissioner Divine, seconded by Commissioner Beggs that the staff recommendation be accepted and that the contract for a crane truck for the Water and Wastewater Division be awarded to Long -McArthur, Inc. in the amount of $48,207. Aye: (5). Nay: (0). Motion carried. (8.9) Request for executive session to discuss legal matter. 94-219 Moved by Commissioner Divine, seconded by Commissioner Brungardt that the Board of Commissioners recess into executive session for 10 minutes for the purpose of discussing a matter deemed subject to the attorney-client privilege, for the reason that public discussion of the matter would waive the attorney-client privilege and would adversely affect the City's position in the matter. Aye: (5) . Nay: (0) . Motion carried. I The Commissioners recessed at 4:50 p.m. and reconvened at 5:02 p.m. The Commissioners took no action. OTHER BUSINESS I Mayor Warner announced that there would be no meeting on Monday, May 30, 1994 in observance of Memorial Day.
