08-08-1994 MinutesCommission Action # CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS AUGUST 8, 1994 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, August 8, 1994, at 4:00 p.m. There were present: Mayor Joseph A. Warner, Chairman presiding Commissioner Carol E. Beggs Commissioner Peter F. Brungardt Commissioner John Divine Commissioner Evelyn Maxwell comprising a quorum of the Board, also present: Absent: Dennis M. Kissinger, City Manager Judy D. Long, City Clerk Greg Bengtson, City Attorney Mayor Warner explained that agenda item 8.13, change order for Smoky Hill Museum, and item 8.14, change order for 1994 subdivision improvements, were not ready for discussion at this meeting and should be tabled until a future meeting. It was the consensus of the Commission that these items be tabled until a future meeting. CITIZEN FORUM None AWARDS - PROCLAMATIONS None PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Public Hearing on the proposed budget for 1995. (5.1a) Resolution Number 94-4776, adopting the 1995 Annual Budget. (5. lb) Resolution Number 94-4777, providing for the appropriation, by fund, of the budget of the City of Salina for the year beginning January 1, 1995; and appropriating money from the various funds to pay payrolls and claims against the City of Salina for the calendar year 1995. (5.1.c) Resolution Number 94-4778, adopting the City Job Classification and Salary Schedule, effective January 1, 1995. (5.1d) Resolution Number 94-4779, establishing various fees for services in Salina, regarding water and sewer rates. Robert K. Biles, Director of Finance and Administration, said the first step in this process was to hold the public hearing. Mayor Warner declared the public hearing open. There were no comments filed, written or oral, so the Mayor declared the public hearing closed. Robert K. Biles, Director of Finance and Administration, explained the four resolutions included in this item. Dennis M. Kissinger, City Manager, explained the notice of hearing that was published in the newspaper. 94-296 1 Moved by Commissioner Brungardt, seconded by Commissioner Maxwell, that Resolution Number 94-4776, adopting the 1995 Annual Budget, be adopted. Commission Action # 94-297 Moved by Commissioner Brungardt, seconded by Commissioner Maxwell, that Resolution Number 94-4777, providing for the appropriation, by fund, of the budget of the City of Salina for the year beginning January 1, 1995; and appropriating money from the various funds to pay payrolls and claims against the City of Salina for the calendar year 1995, be adopted. Motion carried. 94-299 Moved by Commissioner Brungardt, seconded by Commissioner Maxwell, that Resolution Number 94-4779, establishing various fees for services in Salina, regarding water and sewer rates, be adopted. (5.2) Resolution Number 94-4780, consenting to the levy of 1.90 mills on each dollar of assessed tangible valuation on the property within the City of Salina for the year 1994, for use by the Salina Airport Authority in 1995, for the purpose of making capital improvements at the Salina Municipal Airport and Salina Airport Industrial Center. Dennis M. Kissinger, City Manager, explained the mill levy amount and why it is needed. Tim Rogers, Executive Director of the Salina Airport Authority, explained the total difference between the 1994 budget and the 1994 revised budget. He also explained the mill levy request and its uses for 1995. 94-300 Moved by Commissioner Beggs, seconded by Commissioner Divine, that Resolution Number 94-4780, consenting to the levy of 1.90 mills on each dollar of assessed tangible valuation on the property within the City of Salina for the year 1994, for use by the Salina Airport Authority in 1995, for the purpose of making capital improvements at the Salina Municipal Airport and Salina Airport Industrial Center, be adopted. Aye: (5). Nay: (0). Motion carried. Commissioner Maxwell said there will be information in the Buyers Guide on Homestead Taxes and a booklet is available from the County Clerks office. Commissioner Beggs noted that the approved amounts for the 1995 budget are maximums for 1995 and may be reduced. CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting of August 1, 1994. (6.2) Petition Number 4086 was filed by Robert M. Gile for the vacation of the 10' utility easement located on the east line of Lot 5, Block 4, Replat of Blocks 4, 10, 11 and 12, Georgetown Addition. (Refer to City Engineer for a report) (6.2a) Resolution Number 94-4785, setting the date of August 22, 1994 for a public hearing on the Gile utility easement vacation. 94-301 Moved by Commissioner Brungardt, seconded by Commissioner Divine, that all items on the Consent Agenda be approved. DEVELOPMENT BUSINESS None ADMINISTRATION (8.1) First Reading Ordinance Number 94-9643, amending Section 2-162 of the Salina Code regarding membership of the Arts and Humanities Commission and repealing the existing section. Moved by Commissioner Divine, seconded by Commissioner Brungardt, that Ordinance Number 94-9643, amending Section 2-162 of the Salina Code regarding membership of the Arts and Humanities Commission and repealing the existing section, be introduced for first reading. (8.2) First Reading Ordinance Number 94-9644, levying special assessments against certain lots and pieces of property to pay the cost of cutting weeds on certain lots and parts of lots and the parkways abutting thereon in the City of Salina. (8.3) First Reading Ordinance Number 94-9645, levying special assessments against certain lots and pieces of property to pay the cost of abatement of nuisances, located on certain lots and parts of lots in the City of Salina. Dennis M. Kissinger, City Manager, explained the need for items 8.2 and 8.3. Moved by Commissioner Beggs, seconded by Commissioner Maxwell, that Ordinance Number 94-9644, levying special assessments against certain lots and pieces of property to pay the cost of cutting weeds on certain lots and parts of lots and the parkways abutting thereon in the City of Salina, be introduced for first reading. (8.4) Resolution Number 94-4781, establishing various fees for services in the City of Salina, regarding Commercial Animal Establishments and Cereal Malt Beverages. Judy D. Long, City Clerk, explained the correction of fees. Moved by Commissioner Divine, seconded by Commissioner Maxwell, that Resolution Number 94-4781, establishing various fees for services in the City of Salina, regarding Commercial Animal Establishments and Cereal Malt Beverages, be adopted. (8.5) Resolution Number 94-4782, authorizing and ordering certain street and utility improvements in the Twin Oaks, Twin Oaks II and Twin Oaks III Subdivisions and Jerry Ivey Park. Shawn O'Leary, Assistant Director of Engineering and Utilities, explained that Items 8.5, 8.6 and 8.7 are the next step authorizing the 1994 Phase III Subdivision project. Moved by Commissioner Brungardt, seconded by Commissioner Divine, that Resolution Number 94-4782, authorizing and ordering certain street and utility improvements in the Twin Oaks, Twin Oaks II and Twin Oaks III Subdivisions and Jerry Ivey Park, be adopted. Aye: (5). Nay: (0). Motion carried. (8.6) Resolution Number 94-4783, authorizing and ordering certain street improvements in the Nord Subdivision and Wallerius Addition No. 2. Moved by Commissioner Divine, seconded by Commissioner Maxwell, that Resolution Number 94-4783, authorizing and ordering certain street improvements in the Nord Subdivision and Wallerius Addition No. 2, be adopted. Nay: (8.8) Approval of the plans and specifications for 1994 Subdivision Improvements, Phase III, Project No. 94-907, and setting the date of Tuesday, September 6, 1994 to receive bids. Shawn O'Leary, Assistant Director of Engineering and Utilities, explained the project with an estimated cost of $895,000. Moved by Commissioner Maxwell, seconded by Commissioner Brungardt, that the plans and specifications for 1994 Subdivision Improvements, Phase III, Project No. 94-907, be approved and that Tuesday, September 6, 1994 be set to receive bids. (8.9) Resolution Number 94-4786, authorizing the Mayor to execute a three -party agreement between the City of Salina, Wilson and Company and the Kansas Department of Transportation for the Centennial Road Realignment Project, in an amount not to exceed $49,905.21. Shawn O'Leary, Assistant Director of Engineering and Utilities, explained the agreement and the project. He said the city's share of this project is $12,476.30. Moved by Commissioner Brungardt, seconded by Commissioner Beggs, that Resolution Number 94-4786, authorizing the Mayor to execute a three -party agreement between the City of Salina, Wilson and Company and the Kansas Department of Transportation for the Centennial Road Realignment Project, in the City's share of $12,476.30, be adopted. Aye: (5). Nay: (0). Motion carried. (8.10) Resolution Number 94-4787, authorizing the installation and/or removal of traffic control devices in the City of Salina. Shawn O'Leary, Assistant Director of Engineering and Utilities, reviewed the proposed changes. Moved by Commissioner Maxwell, seconded by Commissioner Beggs that Resolution Number 94-4787, authorizing the installation and/or removal of traffic control devices in the City of Salina, be adopted. Aye: (5) . Nay: (0). Motion carried. (8.11) City Engineer reports on bids received for the Wastewater Treatment Plant Filter Press Facility, Project No. 94-900. (Award the contract to Smoky Hill, Inc., in the amount of $913,700) Don Hoff, Director of Engineering and Utilities, explained the project and the bids received. Moved by Commissioner Divine, seconded by Commissioner Maxwell, that the contract for the Wastewater Treatment Plant Filter Press Facility, Project No. 94-900, be awarded to Smoky Hill, Inc., in the amount of $913,700. Aye: (5) . Nay: (0) . Motion carried. (8.12) Sole source purchase of meter reading equipment from Schlumberger, Inc., in the amount of $19,580. Robert K. Biles, Director of Finance and Administration, explained the purchase. Moved by Commissioner Maxwell, seconded by Commissioner Beggs that the sole source purchase of meter reading equipment from Schlumberger, Inc., in the amount of $19,580, be approved. Aye: (5).
