08-15-1994 MinutesAction 94-315 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS AUGUST 15, 1994 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, August 15, 1994, at 4:00 p.m. There were present: Mayor Joseph A. Warner, Chairman presiding Commissioner Carol E. Beggs Commissioner Peter F. Brungardt Commissioner John Divine Commissioner Evelyn Maxwell comprising a quorum of the Board, also present: Absent: Greg Bengtson, City Attorney Mike Morgan, Assistant City Manager Judy D. Long, City Clerk Dennis M. Kissinger, City Manager CITIZEN FORUM None AWARDS - PROCLAMATIONS None PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Public hearing and report on Petition No. 4085 requesting the vacation of the ten foot utility easement located on Lots 11, 12 and 23, Replat of Lots 2, 3, 4 and 5, Mount Barbara Park Addition to the City of Salina. (5.1a) First Reading Ordinance 94-9649, providing for the vacation of the ten foot utility easement located on Lots 11, 12 and 23, Replat of Lots 2, 3, 4 and 5, Mount Barbara Park Addition to the City of Salina. Shawn O'Leary, Assistant Director of Engineering and Utilities, reported on the petition. Mayor Warner declared the public hearing open. Charles Grimwood, petitioner, spoke in favor of the vacation. There were no other comments filed, written or oral, so the Mayor declared the public hearing closed. Moved by Commissioner Divine, seconded by Commissioner Brungardt, that Ordinance 94-9649, providing for the vacation of the ten foot utility easement located on Lots 11, 12 and 23, Replat of Lots 2, 3, 4 and 5, Mount Barbara Park Addition to the City of Salina, be introduced for first reading. Aye: (5) . Nay: (0) . Motion carried. CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting of August 8, 1994. (6.2) Petition Number 4087 was filed by Darvin Dent for the vacation of the front 10 feet of the 20 foot utility easement on Lots 5, 4, 3, 2 and 1, Block 4, and Lots 8, 7, 6, 5, 4, 3, 2 and 1, Block 3, Austin Subdivision, Phase I1. (Refer to City Engineer for a report) (6.2a) Resolution 94-4788, setting the date of September 12, 1994 for a public hearing on the Dent utility easement vacation. DEVELOPMENT BUSINESS (7.1) Annexation application 94-1, filed by John Heline, requesting annexation of a 25 foot strip of land adjacent to Block 1 and 2 of the Pheasant Ridge Addition. (7.1a) First Reading Ordinance Number 94-9646, providing for the annexation of certain land in Section Seventeen (17) , Township Fourteen (14) South, Range Two (2) West of the Sixth Principal Meridian, in Saline County, Kansas. Roy Dudark, Director of Planning and Community Development, reviewed Items 7.1 and 7.2. Moved by Commissioner Brungardt, seconded by Commissioner Divine, that Ordinance Number 94-9646, providing for the annexation of certain land in Section Seventeen (17) , Township Fourteen (14) South, Range Two (2) West of the Sixth Principal Meridian, in Saline County, Kansas, be introduced for first reading. (7.2) Plat application 91-213, filed by John Heline, requesting approval of a replat of Pheasant Ridge Addition to expand the platted area from 11.45 acres to 11.68 acres. The subject property is located north of Crawford Street, east of Presbyterian Manor (2700 Block of East Crawford) . Moved by Commissioner Divine, seconded by Commissioner Beggs, that Plat application 91-2B, filed by John Heline, requesting approval of a replat of Pheasant Ridge Addition to expand the platted area from 11.45 acres to 11.68 acres, be approved and that the Mayor be authorized to sign the final plat. ADMINISTRATION (8.1) Second Reading Ordinance Number 94-9643, amending Section 2-162 of the Salina Code regarding membership of the Salina Arts and Humanities Commission. Moved by Commissioner Maxwell, seconded by Commissioner Beggs, that Ordinance Number 94-9643, amending Section 2-162 of the Salina Code regarding membership of the Salina Arts and Humanities Commission, be adopted. Aye: Beggs, Brungardt, Divine, Maxwell, Warner. (5). Nay: (0). Motion carried. (8.2) Second Reading Ordinance Number 94-9644 levying special assessments against certain lots and pieces of property to pay the cost of cutting weeds on certain lots, parts of lots and the parkways abutting thereon. Moved by Commissioner Divine, seconded by Commissioner Maxwell, that Ordinance Number 94-9644 levying special assessments against certain lots and pieces of property to pay the cost of cutting weeds on certain lots, parts of lots and the parkways abutting thereon, be adopted as changed. Moved by Commissioner Brungardt, seconded by Commissioner Beggs, that Ordinance Number 94-9647 amending Chapter 7, Section 7-121 of the Salina Code regarding the licensing of Commercial Animal Establishments and repealing the existing section, be introduced for first reading. (8.5) First Reading Ordinance Number 94-9648 amending Chapter 2, Section 2-2 of the Salina Code regarding license fees, permit fees and other user related fees and repealing the existing section. (Recommended that the contract be awarded to Osborne Sweeping, Inc. in the amount of $15,963.68) Frank Weinhold, Director of General Services, reviewed the bids received. Moved by Commissioner Divine, seconded by Commissioner Maxwell, that the contract for the Fall 1994 Street Marking Project be awarded to Osborne Sweeping, Inc. in the amount of $15,963.68. Aye: (5). Nay: (0). Motion carried. (8.7) Report on bids received for the 1994 Concrete Pavement Improvements, Project No. 94-911. (Recommended that the contract be awarded to Pavers, Inc. in the amount of $93,959.00) Shawn O'Leary, Assistant Director of Engineering and Utilities, reviewed the bids received. Moved by Commissioner Maxwell, seconded by Commissioner Beggs, that the contract for the 1994 Concrete Pavement Improvements, Project No. 94-911, be awarded to Pavers, Inc. in the amount of $93,959.00. Aye: (5) . Nay: (0) . Motion carried. (8.8) Report on bids received for the Fire Station No. 4 Addition, Project No. 94-910. (Recommended that the contract be awarded to Keehner'I, Construction, in the amount of $88,708.00) Shawn O'Leary, Assistant Director of Engineering and Utilities, reviewed the bids received. Tom Girard, Fire Chief, explained the new fire truck and the new addition to Fire Station No. 4. Moved by Commissioner Divine, seconded by Commissioner Brungardt, that Fire Station No. 4 Addition, Project No. 94-910, be awarded to Keehner Construction, in the amount of $88,708.00. Aye: (5). Nay: (0). Motion carried. (8.9) Change Order No. 1 for 1994 Subdivision Improvements, Phase II, Project No. 94-898, in the amount of $13,156.00. Shawn O'Leary, Assistant Director of Engineering and Utilities, reviewed the change order. Action 94-327 94-328 Moved by Commissioner Beggs, seconded by Commissioner Maxwell, that Change Order No. 1 for 1994 Subdivision Improvements, Phase II, Project No. 94-898, in the amount of $13,156.00, be approved.
