08-22-1994 MinutesAction 94-329 94-330 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS AUGUST 22, 1994 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, August 22, 1994, at 4:00 p.m. There were present: Mayor Joseph A. Warner, Chairman presiding Commissioner Carol E. Beggs Commissioner Peter F. Brungardt Commissioner John Divine Commissioner Evelyn Maxwell comprising a quorum of the Board, also present: Absent: Greg Bengtson, City Attorney Mike Morgan, Assistant City Manager Judy D. Long, City Clerk Dennis M. Kissinger, City Manager CITIZEN FORUM Susan Vanderford, 500 E. Pacific, spoke regarding a weed violation notice. She said contractors have torn up an easement and left chunks of concrete that have stopped up the storm sewer. She said there is also debris from the Focus on the Future building next door in her back yard. Ms. Vanderford also stated that the railroad crossing at Santa Fe and Ninth is not handicap accessible. AWARDS - PROCLAMATIONS None PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Public Hearing and report on Petition No. 4086, filed by Robert M. Gile, for the vacation of the 10 foot utility easement located on the east line of Lot 5, Block 4, Replat of Block 4, 10, 11 and 12, Georgetown Addition. (5. 1a) First Reading Ordinance 94-9650. Shawn O'Leary, Assistant Director of Engineering and Utilities, reported on the vacation request and the change in the ordinance. Moved by Commissioner Divine, seconded by Commissioner Brungardt, that Ordinance 94-9650 be introduced for first reading. Aye: (5) . Nay: (0) . Motion carried. CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting of August 15, 1994. (6.2) Petition Number 4088 was filed by LaVern E. Lyon for the installation of certain street improvements in the Addition to the Grounds of Kansas Wesleyan University. (Refer to City Engineer for a report.) Action _ 94-331 94-332 94-333 94-334 94-335 94-336 DEVELOPMENT BUSINESS (7.1) Consider submittal of a grant application to the Kansas Historic Preservation Department to assist in updating the 1983 Salina Heritage Conservation Plan. Roy Dudark, Director of Planning and Community Development, explained the grant and the conservation plan. Moved by Commissioner Brungardt, seconded by Commissioner Maxwell, that the grant application be approved and submitted to the State and that the City Manager be authorized to execute any related documents. Aye: (5). Nay: (0). Motion carried. (7.2) Consider a budget amendment for the 1993 CDBG Housing Rehabilitation and Home Ownership Assistance Project. Roy Dudark, Director of Planning and Community Development, explained the proposed budget amendment. Moved by Commissioner Divine, seconded by Commissioner Maxwell, that the budget amendment for the 1993 CDBG Housing Rehabilitation and Home Ownership Assistance Project, be approved. Aye: (5). ADMINISTRATION (8.1) Second Reading Ordinance Number 94-9646, providing for the annexation of certain land in Section 17, Township 14 South, Range Two West, of the Sixth Principal Meridian, in Saline County. Moved by Commissioner Brungardt, seconded by Commissioner Divine, that Ordinance Number 94-9646, providing for the annexation of certain land in Section 17, Township 14 South, Range Two West, of the Sixth Principal Meridian, in Saline County, be adopted. (8.2) Second Reading Ordinance Number 94-9647, amending Chapter 7, Section 7-121, of the Salina Code regarding the licensing of Commercial Animal Establishments. Moved by Commissioner Divine, seconded by Commissioner Brungardt, that Ordinance Number 94-9647, amending Chapter 7, Section 7-121, of the Salina Code regarding the licensing of Commercial Animal Establishments, be adopted. Moved by Commissioner Brungardt, seconded by Commissioner' Maxwell, that Ordinance Number 94-9649, providing for the vacation of the ten' foot utility easement located on Lots 11, 12, and 23, replat of Lots 2, 3, 4 and 5, Mount Barbara Park Addition to the City of Salina, be adopted. Action 94-337 94-338 94-339 94-340 94-341 (8.5) Resolution Number 94-4789, authorizing the public sale of $1,230,000 principal amount of combined water and sewage system improvement revenue bonds, Series 1994-13, of the City of Salina, Kansas. Robert K. Biles, Director of Finance and Administration, explained the Resolution. Moved by Commissioner Divine, seconded by Commissioner Beggs, that Resolution Number 94-4789, authorizing the public sale of $1,230,000 principal amount of combined water and sewage system improvement revenue bonds, Series 1994-B, of the City of Salina, Kansas, be adopted. Aye: (5). Nay: (0) . Motion carried. (8.6) Resolution Number 94-4790 appointing members to the various Boards and Commissions of the City of Salina. Judy D. Long, City Clerk, read the list of appointments. Moved by Commissioner Brungardt, seconded by Commissioner Beggs, that Resolution Number 94-4790 appointing members to the various Boards and Commissions of the City of Salina, be adopted. Aye: (5). Nay: (0). Motion carried. (8.7) Report on bids received for the Deflection Testing of the East Dry Creek Interceptor Gravity Sewers, Project No. 94-909. Don Hoff, Director of Engineering and Utilities, explained the project and the bids received on August 16, 1994. Moved by Commissioner Maxwell, seconded by Commissioner Beggs, that the staff recommendation be accepted and that the contract for the Deflection Testing of the East Dry Creek Interceptor Gravity Sewers, Project No. 94-909, be awarded to Ace Pipe Cleaning, Inc., in the amount of $14,008.40. Aye: (S). Nay: (0). Motion carried. (8.8) Consider two change orders for window caulking and painting at the Smoky Hill Museum, in the total amount of $18,1.62. Roy Dudark, Director of Planning and Community Development, explained the change orders. Moved by Commissioner Divine, seconded by Commissioner Brungardt, that the two change orders for window caulking and painting at the Smoky Hill Museum, in the total amount of $18,162, be approved. Aye: (5) . Nay: (0) . Motion carried. (8.9) Reschedule bid date for 1994 Subdivision Improvements, Project No. 94-907. Shawn O'Leary, Assistant Director of. Engineering and Utilities, explained the request for the date change. Moved by Commissioner Maxwell, seconded by Commissioner Beggs, that the bid date for 1994 Subdivision Improvements, Project No. 94-907, be changed from September 6, 1994 to September 13, 1994. Aye: (5). Nay: (0). Motion carried. OTHER BUSINESS Mayor Warner announced that there would be no Commission meetings the next two weeks. He noted that anyone having concerns can contact city staff. Mayor Warner reminded citizens that school zones become active Thursday, August 25, 1994. Commissioner Maxwell asked that inspection procedures be reviewed.
