09-12-1994 MinutesAction CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS SEPTEMBER 12, 1994 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, September 12, 1994, at 4:00 p.m. There were present: Mayor Joseph A. Warner, Chairman presiding Commissioner Carol E. Beggs Commissioner Peter F. Brungardt Commissioner John Divine Commissioner Evelyn Maxwell comprising a quorum of the Board, also present: Greg Bengtson, City Attorney Dennis M. Kissinger, City Manager Judy D. Long, City Clerk Absent: None None None CITIZEN FORUM AWARDS - PROCLAMATIONS PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Public Hearing to consider adoption of a resolution providing for the repair or removal of dangerous structures. (5.1a) Resolution Number 94-4791, setting forth the Board of City Commissioners findings that certain structures are unsafe or dangerous, directing the structures be repaired or removed, and fixing a reasonable time within which the repair or removal of such structures shall be commenced and completed. Mike Peterson, Chief Building Official, gave a report on the properties involved. Mayor Warner declared the public hearing open. George Yarnevich, attorney for the property owners at 509 State Street, explained the sale of the property which took place before the fire that destroyed over 50% of the structure. He asked for an extension. David Richter, 250 S. Fourth Street, representing his mother, Mary Barkus, owner of 703 N. Second, explained the situation in cleaning out his mother's house. He said she no longer lives there, and though he is her guardian, he needs to have court approval before he can have the house removed. There were no other comments filed, written or oral, so the Mayor declared the public hearing closed. 94-343 Moved by Commissioner Divine, seconded by Commissioner Beggs, that Resolution Number 94-4791, be adopted, and that the two structures discussed during the public hearing be reviewed at a later date if necessary. (5.2) Public Hearing and report on Petition No. 4087 requesting vacation of the utility easement located on Lots 1-8, Block 3 and Lots 1-5, Block 4, Austin Subdivision to the City of Salina, Kansas. (5.2a) First Reading Ordinance 94-9651. Shawn O'Leary, Assistant Director of Engineering and Utilities, explained the vacation request filed be Darvin Dent. Mayor Warner declared the public hearing open. There were no comments filed, written or oral, so the Mayor declared the public hearing closed. 94-344 Moved by Commissioner Beggs, seconded by Commissioner Maxwell, that Ordinance Number 94-9651 be introduced for first reading. Aye: (5). Nay: (0). Motion carried. CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting August 22, 1994. (6.2) Resolution Number 94-4792, authorizing the Mayor to execute a License Agreement between the City of Salina, Kansas and Tony's Pizza Service to allow placement of communication cable in the public right-of-way. 94-345 Moved by Commissioner Brungardt, seconded by Commissioner Beggs, that all items on the Consent Agenda be approved. DEVELOPMENT BUSINESS (7.1) Zoning Application #94-3, filed by Max McClintock, requesting a change in zoning district classification from C-3 (Shopping Center) District to C-5 (Service Commercial) on property legally described as Lot 15, Block 2, Holiday Addition to the City of Salina. (aka 411 S. Clark) (7.1a) First Reading Ordinance Number 94-9652. Roy Dudark, Director of Planning and Community Development, explained the rezoning request. 94-346 Moved by Commissioner Beggs, seconded by Commissioner Divine, that Ordinance Number 94-9652, be introduced for first reading. (7.2) Zoning Application #94-4, filed by the Salina City Planning Commission, requesting an amendment to Section 42-553 of the Salina Zoning Ordinance, Off -Street Parking Space Requirements, by changing the number of required parking spaces for various types of uses and the addition of Section 42-554 Modification of Required Spaces. (7.2a) First Reading Ordinance Number 94-9653. Roy Dudark, Director of Planning and Community Development, explained the proposed change and addition. 94-347 Moved by Commissioner Brungardt, seconded by Commissioner Divine, that Ordinance Number 94-9653, be introduced for first reading. ADMINISTRATION (8.1) Second Reading Ordinance Number 94-9650, providing for the vacation of the west 2.5' of the 10' utility easement located on the east line of Lot 5, Block 4, Replat of Blocks 4, 10, 11 and 12, Georgetown Addition to the City of Salina, Kansas. Shawn O'Leary, Assistant Director of Engineering and Utilities, gave an update on this vacation. 94-348 Moved by Commissioner Divine, seconded by Commissioner Maxwell, that Ordinance Number 94-9650, providing for the vacation of the west 2.5' of the 10' utility easement located on the east line of Lot 5, Block 4, Replat of Blocks 4, 10, 11 and 12, Georgetown Addition to the City of Salina, Kansas, be Action 94-349 94-350 94-351 94-352 94-353 adopted. Aye: Beggs, Brungardt, Divine, Maxwell, Warner. (5). Nay: (0). Motion carried. (8.2) Report on bids received for Water and Sewerage System Revenue Bonds, Series 1994-B, in the amount of $1,230,000. Dennis M. Kissinger, City Manager, introduced Roger Edgar of George K. Baum who explained the bids which were received. He said Piper Jaffray had the low bid at 5.822945%. Moved by Commissioner Maxwell, seconded by Commissioner Beggs, that the bid for Water and Sewerage System Revenue Bonds, Series 1994-13, in the amount of $1,230,000, be awarded to Piper Jaffray for an interest rate of 5.822945%. Aye: (5) . Nay: (0) . Motion carried. (8.3) First Reading Ordinance Number 94-9654, authorizing the issuance of Water and Sewerage System Revenue Bonds, Series 1994-B, in the amount of $1,230,000. Moved by Commissioner Divine, seconded by Commissioner Brungardt, that Ordinance Number 94-9654, authorizing the issuance of Water and Sewerage System Revenue Bonds, Series 1994-B, in the amount of $1,230,000, be introduced for first reading. (8.4) Resolution Number 94-4793, providing for the issuance of not to exceed $580,000 of general obligation bonds or temporary notes of the City of Salina, Kansas, to finance the installation of a leachate collection system to be located at the city's solid waste facility. Dennis M. Kissinger, City Manager, explained this temporary note issue. Moved by Commissioner Brungardt, seconded by Commissioner Maxwell, that Resolution Number 94-4793, providing for the issuance of not to exceed $580,000 of general obligation bonds or temporary notes of the City of Salina, Kansas, to finance the installation of a leachate collection system to be', located at the city's solid waste facility, be adopted. Aye: (5). Nay: (0). Motion carried. (8.5) Resolution Number 94-4794, authorizing the Mayor to execute an agreement between the City of Salina, Kansas and Wilson & Company for professional engineering services in connection with the filter press facility at the wastewater treatment plant in an amount not to exceed $119,490. Don Hoff, Director of Engineering and Utilities, explained the agreement . Moved by Commissioner Divine, seconded by Commissioner Brungardt, that Resolution Number 94-4794, authorizing the Mayor to execute an agreement between the City of Salina, Kansas and Wilson & Company for professional engineering services in connection with the filter press facility at the wastewater treatment plant in an amount not to exceed $119,490, be adopted. Aye: (5). Nay: (0). Motion carried. (8.6) Report on bids received August 30, 1994 for vehicles and equipment. Dennis M. Kissinger, City Manager, explained the vehicle and equipment bids. Moved by Commissioner Divine, seconded by Commissioner Beggs, that the various vehicles and equipment be awarded as recommended. Aye: (5). Nay: (0). Motion carried. (8.7) Resolution Number 94-4795, authorizing the Mayor to execute a contract amendment between the City of Salina, Kansas and Camp Dresser & McKee, Inc. for professional engineering and consulting services for the City of Salina Municipal Solid Waste Landfill in an amount not to exceed $60,950. Action Dennis M. Kissinger, City Manager, explained the necessity of the contract amendment and noted additional work which would change the expenditure authorization from $60,950 to $64,970. 94-354 Moved by Commissioner Beggs, seconded by Commissioner Maxwell, that Resolution Number 94-4795, authorizing the Mayor to execute a contract amendment between the City of Salina, Kansas and Camp Dresser & McKee, Inc. for professional engineering and consulting services for the City of Salina Municipal Solid Waste Landfill in an amount not to exceed $64,970, be adopted. Aye: (5). Nay: (0). Motion carried. (8.8) Request for Executive Session to discuss real estate matter. 94-355 Moved by Commissioner Brungardt, seconded by Commissioner Beggs, that the Board of Commissioners recess into Executive Session for 30 minutes for the purpose of conducting preliminary discussions relating to the acquisition of real property for the reason that public discussion of the matter would adversely affect the City's ability to potentially acquire the real property at the least public expense and under the most favorable terms possible. Aye: (5) . Nay: (0) . Motion carried. The Board of Commissioners recessed at 5:35 p.m. and reconvened at 6:05. The Commissioners took no action.
