09-26-1994 MinutesAction 94-366 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS SEPTEMBER 26, 1994 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, September 26, 1994, at 4:00 p.m. There were present: Mayor Joseph A. Warner, Chairman presiding Commissioner Carol E. Beggs Commissioner Peter F. Brungardt Commissioner John Divine Commissioner Evelyn Maxwell comprising a quorum of the Board, also present: Absent: Greg Bengtson, City Attorney Dennis M. Kissinger, City Manager Judy D. Long, City Clerk None CITIZEN FORUM None AWARDS - PROCLAMATIONS None PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting of September 19, 1994. (6.2) Approve Project No. 94-914, Oakdale Park Stage and authorize staff to set a date to receive bids. (6.3) Resolution Number 94-4799, authorizing the Mayor to execute a Quit Claim Deed from the City of Salina to Salina Supply Company relinquishing the City's right, title and interest in a 10 foot x 170.5 foot strip of land adjacent to a vacated alley between Santa Fe and North Fifth Street, north of Elm Street Moved by Commissioner Beggs, seconded by Commissioner Maxwell, that all items on the Consent Agenda be approved. DEVELOPMENT BUSINESS (7.1) Annexation application number 94-2, filed by Great Plains Rentals, Inc., and Brown and Brown, Inc., requesting annexation of Lot 6, Brown and Brown Addition, all of that part of the South 404.86 feet of Lot 5, Brown and Brown Addition lying in the SE quarter of the NE quarter of Section 7, Township 14 South, Range 2 West, and the South 404.86 feet of Dillingham Avenue. (7.1a) First Reading Ordinance Number 94-9655. Roy Dudark, Director of Planning and Community Development, reviewed the application. 94-367 94-368 94-369 94-370 94-371 94-372 94-373 Moved by Commissioner Divine, seconded by Commissioner Brungardt, that Ordinance Number 94-9655, be introduced for first reading. ADMINISTRATION (8.1) First Reading Ordinance Number 94-9656, amending Section 38-1 of the Salina Code regulating traffic within the corporate limits of the City of Salina, Kansas; incorporating by reference the "Standard Traffic Ordinance for Kansas Cities," Edition of 1994; and repealing the existing section. (8.1a) Declare an emergency exists in order to have second reading of Ordinance Number 94-9656 on same day enabling timely implementation of traffic safety provisions. (8.1b) Second Reading Ordinance Number 94-9656. (8.1c) Authorize and direct the City Manager to post certain maximum speed limits on specific public streets within the Salina city limits. Dennis M. Kissinger, City Manager, explained the items. Nick Schlecta, Director of Salina Downtown, Inc., noted that the Business Improvement District Advisory Board addressed this at the last meeting. He said they found no specific objections to the proposed speed limit changes. Joe Peters, Terminal Manager with Roadway Express, asked how these changes would effect Crawford at Graves Boulevard. He explained that it is already difficult for trucks to pull out at this intersection. Steve Britt, pilot for TWA, said he does not agree that speeds will not increase if speed limits are increased. He believes that citizens will still drive 5 miles per hour over the set limit. He suggested picking a test street' to see what happens before changing the speed limits in all the proposed areas . Moved by Commissioner Brungardt, seconded by Commissioner Divine, that Ordinance Number 94-9656, amending Section 38-1 of the Salina Code regulating traffic within the corporate limits of the City of Salina, Kansas; incorporating by reference the "Standard Traffic Ordinance for Kansas Cities," Edition of 1994; and repealing the existing section, be introduced for first reading. Moved by Commissioner Beggs, seconded by Commissioner Brungardt, to declare that an emergency exists in order to have second reading of Ordinance Number 94-9656, enabling timely implementation of traffic safety provisions. Moved by Commissioner Brungardt, seconded by Commissioner Divine, that the City Manager be authorized and directed to post certain maximum speed limits on specific public streets within the Salina city limits. Moved by Commissioner Maxwell to amend the speed limit on Crawford from Graves Boulevard to the city limits from 40 miles per hour to 35 miles per hour. The motion died for lack of a second. Moved by Commissioner Maxwell that State Street from Broadway to the residential district remain the same. The motion died for lack of a second. The Mayor called for a vote on Commission Action #94-371. Aye: (5). Nay: (0). Motion carried. Action (8.2) Resolution Number 94-4798, authorizing the Mayor to execute ar agreement between the City of Salina and Kennedy and Coe, Certified Public Accountants, for an audit of City records for the year ending December 31, 1994, for a cost not to exceed $25,000. Biles, Director of Finance and Administration, explained the contract. 94-374 Moved by Commissioner Beggs, seconded by Commissioner Maxwell, that Resolution Number 94-4798, authorizing the Mayor to execute an agreement between the City of Salina and Kennedy and Coe, Certified Public Accountants, for an audit of City records for the year ending December 31, 1994, for a cost not to exceed $25,000, be adopted. Aye: (5). Nay: (0). Motion carried. (8.3) Approve Change Order No. 1 for Engineering Project #93-890, Wastewater Treatment Plant Clarifier Rehabilitation, in the net amount of $16,562. Don Hoff, Director of Engineering and Utilities, reviewed the change order. 94-375 Moved by Commissioner Brungardt, seconded by Commissioner Divine, that Change Order No. 1 for Engineering Project #93-890, Wastewater Treatment Plant Clarifier Rehabilitation, in the net amount of $16,562, be approved. (8.4) Request for Executive Session to discuss legal matters with the City Attorney. 94-376 Moved by Commissioner Maxwell, seconded by Commissioner Brungardt, that the Board of City Commissioners recess into executive session for 20 minutes for the purpose of discussing with the City Attorney a matter deemed subject to the attorney-client privilege, for the reason that the matter may result in litigation such that public discussion would waive the attorney-client privilege and adversely affect the City's position in the matter. Aye: (5) . Nay: (0) . Motion carried. The Board of Commissioners recessed at 5:25 p.m. and reconvened at 5:45 p.m. The Commissioners took no action.
