10-24-1994 Minutes94-399 94-400 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS OCTOBER 24, 1994 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission, Meeting Room, City -County Building, on Monday, October 24, 1994, at 4:00 p.m, There were present: Mayor Joseph A. Warner, Chairman presiding Commissioner Carol E. Beggs Commissioner Peter F. Brungardt Commissioner John Divine Commissioner Evelyn Maxwell comprising a quorum of the Board, also present: Absent: Greg Bengtson, City Attorney Dennis M. Long, City Clerk CITIZEN FORUM None AWARDS - PROCLAMATIONS None PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting of October 17, 1994. DEVELOPMENT BUSINESS (7.1) Resolution Number 94-4809 authorizing city participation in Saline County's Schilling Road drainage project in an amount not to exceed $297,219.00 Roy Dudark, Director of Planning and Community Development, reviewed the project and the financial participation with Saline County. He said this project would greatly improve the flooding conditions in south Salina. The Commissioners and staff discussed the impact of this project on future development in the area. Moved by Commissioner Beggs, seconded by Commissioner Maxwell that Resolution Number 94-4809 authorizing city participation in Saline County's Schilling Road drainage project in an amount not to exceed $297,219.00, be adopted. Action 94-401 94-402 94-403 94-404 94-405 94-406 ADMINISTRATION (8.1) Second Reading Ordinance Number 94-9657, levying the annual Business District service fees for 1995 applicable to all businesses located within the Salina Business Improvement District Number 1; and repealing Ordinance Number 93-9602. Moved by Commissioner Divine, seconded by Commissioner Brungardt, that Ordinance Number 94-9657, levying the annual Business District service fees for 1995 applicable to all businesses located within the Salina Business Improvement District Number 1; and repealing Ordinance Number 93-9602, be adopted. Biles, Director of Finance and Administration, reviewed the resolution. Motion carried. (8.7) Report on bids received for Underground Cable Installation, Project No. 94-913. (Award contract to B & W Electrical Contractors, Inc. for $72,800) received. Don Hoff, Director of Engineering and Utilities, reviewed the bids 94-407 Moved by Commissioner Beggs, seconded by Commissioner Maxwell, that the contract for Underground Cable Installation, Project No. 94-913, be awarded to B & W Electrical Contractors, Inc. in the amount of $72,800. Motion carried. 94-408 94-409 — 94-410 94-411 94-412 94-413 (8.8) Approve Change Order No. 1 for the 1994 Subdivision Improvements, Phase I, Project No. 94-892A, in the net amount of $15,861.00. Shawn O'Leary, Assistant Director of Engineering and Utilities, reviewed the change order. Moved by Commissioner Maxwell, seconded by Commissioner Beggs, that Change Order No. 1 for the 1994 Subdivision Improvements, Phase 1, Project No. 94-892A, in the net amount of $15,861.00, be approved. Aye: (5) . Nay: (0) . Motion carried. (8.9) Approve Change Order No. 1 for the 1994 Subdivision Improvements, Phase 1, Project No. 94-892B, in the net amount of $15,489.36. Shawn O'Leary, Assistant Director of Engineering and Utilities, reviewed the change order. Moved by Commissioner Brungardt, seconded by Commissioner Maxwell, that Change Order No. 1 for the 1994 Subdivision Improvements, Phase I, Project No. 94-892B, in the net amount of $15,489.36, be approved. (8.10) Resolution Number 94-4808 authorizing the Mayor to sign a Consent Order and Settlement Agreement with the Kansas Department of Health and Environment, pertaining to groundwater contamination in the central part of Salina. Dennis M. Kissinger, City Manager, reviewed the agreement and the cleanup process. Rick Brunetti, District Environmental Administrator, Bureau of Distric Operations, Kansas Department of Health and Environment, expressed his appreciation to the Commissioners and staff for their cooperation and diligence it coming to this agreement. Moved by Commissioner Beggs, seconded by Commissioner Maxwell, that Resolution Number 94-4808 authorizing the Mayor to sign a Consent Order and Settlement Agreement with the Kansas Department of Health and Environment, pertaining to groundwater contamination in the central part of Salina, be adopted. Aye: (5). Nay: (0). Motion carried. The Mayor, with the concurrence of the Commissioners, added an item to the agenda. (8.11) Resolution Number 94-4810, concerning unfunded mandates. Moved by Commissioner Divine, seconded by Commissioner Beggs that Resolution Number 94-4810, concerning unfunded mandates, be adopted. Aye: (5). Nay: (0). Motion carried. (8.12) Request for Executive Session to discuss a real estate matter. Moved by Commissioner Brungardt, seconded by Commissioner Beggs, that the Board of Commissioners recess into executive session for 15 minutes for the purpose of conducting preliminary discussions relating to the acquisition of real property for the reason that public discussion of the matter would adversel, affect the City's ability to potentially acquire the real property at the least public expense and under the most favorable terms possible. The Commissioners recessed at 5:00 p.m. and reconvened at 5:15 p.m. Moved by Commissioner Divine, seconded by Commissioner Beggs that staff be authorized to bid on Lot 8, Block 3 Mayfair Addition at the upcoming tax sale, in an amount up to the extent of the judgement lien.
