02-13-1995 MinutesCommission Action # CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS February 13, 1995 +4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City - County Building, on Monday, February 13, 1995 at 4:00 p.m. There were present: Mayor Joseph A. Warner, Chairman presiding Commissioner Steve Ryan Commissioner Peter F. Brungardt Commissioner John Divine Commissioner Evelyn Maxwell comprising a quorum of the Board, also present: I Absent: Greg Bengtson, City Attorney Judy D. Long, City Clerk Dennis Kissinger, City Manager None CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Mayor proclaimed The Week of February 13th through 17th, 1995 as "LIFE UNDERWRITERS' WEEK" in the City of Salina. The procalmation was read by Shari Walls, President of the Local Association of Life Underwriters. (4.2) The Mayor proclaimed The Week of February 19th through 25th, 1995 as "NATIONAL ENGINEERS WEEK" in the City of Salina. The proclamation was read by Roger Alexander, District Maintenance Engineer for the Kansas Department of Transportation. (4.3) The Mayor proclaimed the Month of March 1995 as "YOUTH ART MONTH" in the City of Salina. The proclamation was read by Linda Camarena, Art teacher at Roosevelt Lincoln Middle School. (4.4) The Mayor proclaimed Tuesday, February 14, 1995 as "THE 75TH ANNIVERSARY OF THE LEAGUE OF WOMEN VOTERS" in the City of Salina. The proclamation was read by Carmen Wilson, President Elect of the League of Women Voters. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None CONSENT AGENDA (6.1) The Minutes of the Regular Meeting of February 6, 1995 will be available at the next Regular Meeting of the City Commission on February 27, 1995. (6.2) Set date to receive bids on construction for the General Services Office building addition and interior modification. (6.3) Approval of the 1995 Joint and Crack Sealing Project No. 95-926 and authorization to receive bids. Commission Action # 95-038 ,95-039 95-040 95-041 (6.4) Change Order No. 2 for the Fox -Watson Storefront Remodeling Project No. 94-915 has been pulled from the agenda. (6.5) Approval of 1995 Latex Modified Slurry Seal, Project No. 95-927, and authorization to set date to receive bids. (6.6) Resolution Number 95-4846 authorizing the naming of the Salina Community Theatre Stage and house the Charles Kephart Performance Hall. (6.7) Report on bids received January 31, 1995 for a Mini -Van and February 7, 1995 for a subcompact car. (6.8) Resolution Number 95-4848 authorizing the City Manager to enter into an agreement with Thermoflex, Inc., for replacement of the Dean Evans Stadium roof. Deb Wall, Salina Community Theatre explained the dedication of the Charles Kephart Performance Hall scheduled for Friday, February 17, 1995. Moved by Commissioner Brungardt, Seconded by Commissioner Maxwell, that all items on the Consent Agenda be approved, except for minutes and the Change Order No. 2 for the Fox -Watson Storefront Remodeling. DEVELOPMENT BUSINESS (7.1) Consider submittal of a grant application for repair of the Fox Theatre to the Kansas Historic Preservation Department under the Heritage Trust Fund Program. Roy Dudark, Director of Planning and Community Development, explained the proposed grant. Moved by Commissioner Divine, seconded by Commissioner Brungardt, that authorization be given to the City Manager to file the application and sign the related documents for the application. Aye: (5). Nay: (0). Motion carried. ADMINISTRATION (8.1) Second Reading Ordinance Number 95-9673 exempting certain property owned by REMA Bakeware, located at 625 E. North Street, Salina, Kansas from ad valorem taxation and providing for certain in lieu of tax payments. Moved by Commissioner Maxwell, seconded by Commissioner Ryan, that Second Reading Ordinance Number 95-9673 exempting certain property owned by REMA Bakeware, located at 625 E. (8.2) Second Reading Ordinance Number 95-9674 exempting certain property owned by Salina Vortex Corporation, located at 3024 Arnold Avenue, Salina, Kansas from ad valorem taxation and providing for certain in lieu of tax payments. Moved by Commissioner Ryan, seconded by Commissioner Divine, that Ordinance Number 95-9674 exempting certain property owned by Salina Vortex Corporation, located at 3024 Arnold Avenue, Salina, Kansas from ad valorem taxation and providing for certain in lieu of tax payments, be adopted. (8.3) Second Reading Ordinance Number 95-9675 exempting certain property owned by SP Plastics Manufacturing, located at 1648 W. Magnolia Road, Salina, Kansas from ad valorem taxation and providing for certain in lieu of tax payments. Moved by Commissioner Brungardt, seconded by Commissioner Ryan, that Ordinance Number 95-9676 amending the Comprehensive Plan of the City of Salina, be adopted. Motion carried. .5) Second Reading Ordinance Number 95-9677 levying special assessments on lots, pieces and parcel of ground in the City of Salina or the purpose of paying a portion of the cost of certain street and utility improvements. (8.6) First Reading Ordinance Number 95-9678 relating to the cutting of weeds and vegetation, providing for notice and providing for cutting by the City of Salina and providing for charges therefore. Roy Dudark, Director of Planning and Community Development, explained the results of the ordinance which was first passed last year. Moved by Commissioner Brungardt, seconded by Commissioner Ryan, that Ordinance Number 95-9678 relating to the cutting of weeds and vegetation, providing for notice and providing for cutting by the City of Salina and providing for charges therefore, be introduced for first reading. Aye: (5). Nay: (0). Motion carried. (8.7) Resolution Number 95-4849 adopting the City of Salina environmental release policy and related forms. Greg Bengtson, City Attorney, explained the policy and related forms. There will be a 30 day waiting period before this begins and a meeting will be set up with the local banks, title companies and others to discuss the issue. Moved by Commissioner Divine, seconded by Commissioner Brungardt, that Resolution Number 95-4849 adopting the City of Salina environmental release policy and related forms, be adopted. OTHER BUSINESS Mayor Warner announced that there would be no meeting on Monday, February 20, 1995 in observance of the Presidents Day holiday. Commissioner Maxwell noted that a protest petition was received from Mr. and Dr. Nelson. Mayor Warner noted that the petition was received and would be reviewed.
