The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -
County Building, on Monday, February 27, 1995 at 4:00 p.m.

AWARDS - PROCLAMATIONS
4.1) The Mayor proclaimed The Week of March 6 through 10th, 1995 as "SEVERE
HEATHER WEEK" in the City of Salina. The procalmation was read by Gail Aills, Emergency
danaiaement Director.
4.2) The Mayor proclaimed The Week of March 6th through 12th, 1995 as "NATIONAL
3UARD WEEK" in the City of Salina. The proclamation was read by Major Hester of the Kansas
Jational Guard.

(6.1) Approve the Minutes of the Regular Meeting of February 6, 1995 and February 13,
1995.
6.2) Resolution No. 95-4850 establishing various fees for services in the City of Salina.
6.3) Petition Number 4096, filed by West McArthur, requesting the vacation of Pine
itreet between Santa Fe and 5th Streets.
6.4) Petition Number 4097, filed by JoAnn McCullick, requesting the vacation of South
'enn Street from Smoky Hill Drive to the river.
6.5) Resolution No. 95-4851 authorizing the City Manager to enter into a contract to
emove waste tires from the Salina landfill for permanent disposal.
6.6) Resolution No. 95-4853 authorizing the City Manager to enter into a contract to
emove waste from the landfill Waste Collection Area for permanent disposal.

(6.7) Resolution No. 95-4853 authorizing the Mayor to enter into a contract with
Architectural Services Plus, PA for professional architectural, engineering and consulting
services for an equipment storage building at the landfill.
(6.8) Authorization to set date to receive bids for Project 95-929 Vehicle and Equipment
Cold Storage Facility.
Moved by Commissioner Brungardt, Seconded by Commissioner Divine, that all
items on the Consent Agenda be approved.
Commissioner Maxwell asked if the minutes of the 13th, page 4, regarding the
Nelsons be corrected. She noted her concern that items are on the consent agenda which
should be discussed.
Frank Weinhold, Director of General Services, explained item 6.5.

DEVELOPMENT BUSINESS
(7.1) Application #PDD95-1, filed by the Salina Airport Authority, requesting approval
of a preliminary development plan and a change in zoning district classification from I-2, Light
Industrial , to PDD/I-3, Planned Development District, to allow a concrete ready -mix plant and
cement terminal on a 9.2 acre tract in the NE 1/4 of Section 34, T14S, R3W, of the 6th PM,
located between Centennial Road and the Missouri Pacific Railroad tracks in the City of Salina.
Also known as 2601 Centennial Road.
(7.1 a) First reading Ordinance Number 95-9679.
(7.1b) Application #P95-1/lA, filed by the Salina Airport Authority, requesting
approval of a combined preliminary/final plat of Schilling Subdivision No. 2, a 5 lot
subdivision of a tract located in the NE 1/4 of Section 34 and the NW 1/4 of Section 35,
T14S, R3W, of the 6th PM, and a portion of Block 19 of the Schilling Subdivision in the
City of Salina.
(7.Ic) Declare an emergency exists in order to have second reading of Ordinance
Number 95-9679 on the same day.
Roy Dudark, Director of Planning and Community Development, explained the
requested zoning change and proposed use of the property.
Moved by Commissioner Brungardt, seconded by Commissioner Maxwell, that
Ordinance Number 95-9679 be introduced for first reading. Aye: (4). Nay: (0). Motion
carried.
Moved by Commissioner Maxwell, seconded by Commissioner Divine, that

acre tract located east of the Meyer Addition between Republic Avenue on the south and
McAdams Road on the north.

Roy Dudark, Director of Planning and Community Development, explained the
rezoning and annexation requests. He noted that the Planning Commission recommends R-1
zoning only.
Shawn O'Leary, Assistant Director of Engineering and Utilities, explained the
drainage of the area and how it affects the Eastgate Addition.
Pete Earles, Earles and Riggs Engineering, representing GICO, spoke in favor of
the R-2 zoning which was requested and answered questions from the Commission.
Shawna Carter, 1219 Martin Avenue, spoke on behalf of Meyer Addition
residents. She spoke against the R-2 zoning.
Moved by Commissioner Divine, seconded by Commissioner Maxwell, that item
(7.2) be returned to the Planning Commission to work out a planned development for R-2 lots.
Commissioner Maxwell, noted additional reasons for returning this item to the
Planning Commission. 1.) The affected portion of Martin Avenue will have increased hours of
traffic due to need to access City Park. 2.) Any nuisance or unsanitary conditions of back
yards can be addressed by city inspectors and enforcement of city code. 3.) Some City multi-
family lots have been rezoned R-1 for low income housing and this would help replace those
lost designations. 4.) There is a need for a storm shelter for residents whose dwellings are built
on slabs. 5.) Comprehensive Plan requires us to serve the whole city and provide affordable
housing for all income levels. 6.) Potential owners in the development are unable to be here to
represent themselves.
The Mayor asked for a vote on the motion. Aye: (3). Nay: (1). Warner against.
Moved by Commissioner Maxwell, seconded by Commissioner Divine. that the
application for annexation be returned also to keep items together. Aye: (4). Nay: (0).
Motion carried.
ADMINISTRATION
(8.1) Second Reading Ordinance Number 95-9678 relating to the cutting of weeds and
vegetation in the Cityof Salina.
Moved by Commissioner Divine, seconded by Commissioner Brungardt, that
Second Reading Ordinance Number 95-9678 relating to the cutting of weed and vegetation in
the City of Salina. relating to the cutting of weed and vegetation in the City of Salina, be
adopted.
Dennis Kissinger, City Manager, clarified that this ordinance did not specifically
cover residential dandelions under Section 2(b)(3).
The Mayor asked for a vote on the motion. Aye: Brungardt, Divine, Maxwell.

(8.2) Resolution Number 95-4854 appointing members to the various Boards and
Commissions of the City of Salina.

(8.3) Change Order No. 2 for the Fox -Watson Storefront Remodeling Project No. 95-
915 in the net amount of $5,571.
Shawn O'Leary, Assistant Director of Engineering and Utilities, explained the
_ change order.

Change Order No. 2 for the Fox -Watson Storefront Remodeling Project No. 94-915 in the
amount of $5,571, be approved. Aye: (4). Nay: (0). Motion carried.
OTHER BUSINESS
Mayor Warner commented that tomorrow February 28, 1995 is primary election
day and encouraged everyone to vote.

Commissioner Maxwell noted that the City had received a letter regarding
enginering selections.
Dennis Kissinger, City Manager, explained that a response letter is being sent out
this week and Mrs. Maxwell would receive a copy.
Commissioner Maxwell, noted that the City of Salina has the lowest property tax
mill levy of 1 st class cities in the state.
