04-24-1995 MinutesAction CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS April 24, 1995 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, April 24, 1995 at 4:00 p.m. There were present: Mayor John Divine, Chairman presiding Commissioner Abner Perney Commissioner Peter F. Brungardt Commissioner Evelyn Maxwell Commissioner Kristin Seaton comprising a quorum of the Board, also present: Absent: Greg Bengtson, City Attorney Dennis M. Kissinger, City Manager Judy D. Long, City Clerk None. CITIZEN FORUM Lorena Knoll, Church Women United of Salina, thanked the Commissioners for the new Basic Cable package. She asked that the Faith and Values Network, Channel 38, replace one of the home shopping channels. Petitions are being forwarded directly to TCI. Geraldine Briscoe, Martin Luther King Child Care Center, invited the commissioners to a Theatre in the Round and Soul Food Dinner on April 29, 1995 at 6:30 p.m. in the YWCA Community Room. AWARDS - PROCLAMATIONS (4.1) The day of April 28, 1995 as "ARBOR DAY" in the City of Salina. The proclamation was read by Susie Marietta, Salina Tree Advisory Board. (4.2) The day of April 25, 1995 as "A NATIONAL DAY OF COMMITMENT TO ELIMINATE RACISM" in the City of Salina. The proclamation was read by Ms. Joyce Brown, Vice President Y . W . C . A . of Salina Board of Directors. (4.3) The week of April 23 through 29, 1995 as "NATIONAL VOLUNTEER WEEK". The proclamation was read by Mary Anne Powell, Coordinator for Meals on Wheels. Nancy Klostermeyer listed the upcoming activities and presented a simulated check to Mayor Divine for $326,460.00 representing 65,293 reported hours of volunteer work just from individuals 55 years of age and over. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None. CONSENT AGENDA (6.1) Approve the Minutes of the Regular Meeting of April 17, 1995. (6.2) Approve Change Order No. 1, Project No. 93-879, Water Treatment Plant Chlorination Facility, in the net amount of $7,826.00. Commissioner Maxwell advised the Minutes of April 17, 1995 need to reflect a continued Public Hearing. 95-119 95-120 95-121 95-122 95-123 95-124 Moved by Commissioner Brungardt, seconded by Commissioner Perney, that all items on the Consent Agenda be approved. DEVELOPMENT BUSINESS (7.1) Application #Z95-1, filed by John Heline, requesting a change in zoning district classification from Saline County AG, Agricultural, to R, Single -Family Residential, and R-2, Multi -Family Residential, for a 20 acre tract of land located east of the Valley View Addition at the southwest corner of Markley Road and Cloud Street. (7.1a) First reading Ordinance No. 95-9687. Roy Dudark, Director of Planning and Community Development, explained the requested rezoning and proposed use of the property at Markley Road and Cloud Street. John Heline, requestor of the rezoning, spoke to the Commissioners regarding the density of the area, clarifying that there is not enough area to have the streets needed for a higher density use. Moved by Commissioner Seaton, seconded by Commissioner Brungardt, to approve the first reading of Ordinance Number 95-9687. Aye: (4) . Nay: (1) , Maxwell. Motion carried. (7.2) Application #A95-1, filed by John Heline, requesting annexation of a 20 acre tract of land located east of the Valley View Addition at the southwest corner of Markley Road and Cloud Street. (7.2a) First reading Ordinance No. 95-9688. Roy Dudark, Director of Planning and Community Development, explained the annexation request. Moved by Commissioner Perney, seconded by Commissioner Seaton, to approve the First Reading of Ordinance Number 95-9688. Aye: (4) . Nay: (1) , Maxwell. Motion carried. (7.3) Application #P94 -3A, filed by GICO, Inc., requesting approval of a final plat of the GICO Addition. Roy Dudark, Director of Planning and Community Development, explained that the request is for final plat approval and Second Readings on the zoning and annexation ordinances. Shawn O'Leary, Assistant Director of Engineering and Utilities, explained the drainage. Moved by Commissioner Brungardt to accept and authorize the Mayor to sign the final plat, seconded by Commissioner Seaton. Aye: (5). Nay: (0) . Motion carried. (7.4) Second reading Ordinance No. 95-9680, providing for the rezoning of certain property within the City. Judy Long, City Clerk, and Roy Dudark, Director of Planning and Community Development, concurred that no comments have been received. Moved by Commissioner Brungardt, seconded by Commissioner Maxwell to approve Second Reading of Ordinance Number 95-9680. Roll call vote was taken. Aye: (5), Maxwell, Brungardt, Perney, Seaton, Divine. Nay: (0) . Motion carried. (7.5) Second reading Ordinance No. 95-9681, providing for the annexation of the GICO Addition. Moved by Commissioner Maxwell, seconded by Commissioner Perney to approve Second Reading of Ordinance Number 95-9681. Roll Call Action 95-125 95-126 95-127 vote was taken. Aye: (5), Maxwell, Brundardt, Perney, Seaton, Divine. Nay: (0). Motion carried. ADMINISTRATION (8.1) Second reading Ordinance No. 95-9686, providing for the vacation of certain street right-of-way on Penn Avenue. Shawn O'Leary, Assistant Director of Engineering and Utilities, explained that no comments had been received except from the petitioner. Moved by Commissioner Maxwell, seconded by Commissioner Brungardt, to approve Second Reading of Ordinance Number 95-9686. Roll call vote was taken. Aye: (5), Maxwell, Brungardt, Perney, Seaton, Divine. Nay: (0) . Motion carried. (8.2) Report on bids for Project No. 95-932, Restroom Facility for East Crawford Recreation Area softball fields. Shawn O'Leary, Assistant Director of Engineering and Utilities, explained the project and the bids which were received on April 18, 1995. Moved by Commissioner Seaton, seconded by Commissioner Maxwell, that the bid for Project Number 95-932 be awarded to Lancaster Construction in the amount of $29,938.00. Aye: (5). Nay: (0). Motion carried. OTHER BUSINESS Commissioner Maxwell congratulated the new Commissioners for completing their first meeting. Mayor Divine challenged the media to put on the front page of the Salina Journal and on the radio stations to have a "what's good about Salina" section every day. Commissioner Maxwell advised that tomorrow is "Made in Salina Day," at the Bicenter, and that the K -State College Center is opening.
