1321 Agr Lic Likins-Fostert) E► RESOLUTIOd JUit 1321 A HESOLUT ON authorizing a variance from the side yard requirements as made and provided .in Section 6, Ordinance iJo. 5549, throughout Likins- Foster Addition to the City of oalina, Kansas. u11',RLAS, all conditions precedent to the authorization hereinafter provided have come to pass; and SO, 111OW, FE IT RLSOLILD by the Board of Zoning Appeals of the City of Salina, Kansas: That the variance in Lild.ns-roster Addition to the City of Salina from the side yard requirements, as r,iade and provided in Section 6, Ordinance ho. 5349, as herein provided will not be contrary to the public interest. That as a consequence of the nathre of the dwellings to be con- structed therein compliance withthe requirements of said ordinance would result unnecessary hardship and be contrary to the public interest. That insaid addition an aggregate of 24;0 of any lot, subject tothe maxirrjum. requirements of said Section 6, being allocated as side yard is hereby required. That said a;:regate side hard may be unevenly allocated between side yards in the following specific situations and in no other: That, (1) where carports, garages, porches or storage rooiis, not designed for occupancy and attached to a dwelling on one lot and which said lot abuts another lot where carports, garages, proches, or storage rooms re atta:hed to a dwelling, so that unoccupied areas are the nearest abutting portions of said dwellings, then the minirjur., side year requirement is hereby reduced to six feet or an ag regate of 12 feet between unoccupied portions of such dwelling. :in such cases all of theremainder of said 24% side yard shallbe allocated to the remaining side yard. (2) That except in the specific situat�:.ons, aforesaid, the side hard regLdrements of said Section 6 shall U e and remain in full force and effect.
