10-16-1995 MinutesAction 95-345 95-346 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS October 16, 1995 4:00 p.m. The Regular Meeting of the Board of Commissioners met in the Commission Meeting Room, City -County Building, on Monday, October 16, 1995, at 4:00 p.m. There were present: Mayor John Divine, Chairman presiding Commissioner R. Abner Perney Commissioner Evelyn Maxwell Commissioner Peter F. Brungardt Commissioner Kristin M. Seaton comprising a quorum of the Board, also present: Absent: Dennis M. Kissinger, City Manager Judy D. Long, City Clerk Greg Bengtson, City Attorney None. CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) Main Street Award presentation, Salina Downtown, Inc. Nick Slechta, Executive Director for Salina Downtown, Inc., noted that the Governor's Award for Excellence on Main Street was recently presented to Salina Downtown, Inc. by the Kansas National Mainstreet Program in the category of Outstanding Economic Restructuring for the Fox Storefront Revitalization. Mr. Slechta presented the award to the City which will be displayed downtown. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None. CONSENT AGENDA (6.1) Approve the minutes of the regular meeting of October 9, 1995. (6.2) Resolution Number 95-4935 authorizing the City Manager to execute Certificates of Release for Environmental Condition Liability for certain persons. Moved by Commissioner Perney, seconded by Commissioner Maxwell, to approve all items on the consent agenda. Aye: (5) . Nay: (0) . Motion carried. DEVELOPMENT BUSINESS (7.1) Application #P95 -6A, filed by Frank Norton, requesting final plat approval of Highland Meadows Hamlet, a 61 lot subdivision of a 58.77 acre tract located on the south side of Magnolia Road, east of the Smoky Hill River. Roy Dudark, Director of Planning and Community Development, explained the plat for Highland Meadows Hamlet. Frank Norton noted how cooperative and helpful staff had been in working on this project. Moved by Commissioner Maxwell, seconded by Commissioner Seaton, that the Mayor be authorized to sign the final plat. Aye: (5) . Nay: (0) . Motion carried. (7.1a) Second reading Ordinance Number 95-9692 regarding the annexation of Highland Meadows Hamlet Addition. Action 95-347 95-348 95-349 95-350 95-351 95-352 95-353 Moved by Commissioner Brungardt, seconded by Commissioner Maxwell, to adopt Ordinance Number 95-9692 on second reading. A roll call vote was taken. Aye: (5), Maxwell, Brungardt, Perney, Seaton, Divine. Nay: (0) . Motion carried. (7.1b) Second reading Ordinance Number 95-9691 regarding the rezoning of Highland Meadows Hamlet Addition. Moved by Commissioner Maxwell, seconded by Commissioner Seaton, to adopt Ordinance Number 95-9691 on second reading. A roll call vote was taken. Aye: (5), Maxwell, Brungardt, Perney, Seaton, Divine. Nay: (0). Motion carried. ADMINISTRATION (8.1) Second reading Ordinance Number 95-9708 amending Section 42-522 of the Salina Code regarding the allowable sign height of interstate oriented signs in the C-5, C-6 and C-7 districts. Judy Long, City Clerk, advised no comments have been received. Commissioners Perney and Maxwell spoke against the Ordinance. Commissioner Brungardt not that the ordinance would simply allow an equal sight -line in lower lying areas. Walley Storey, on behalf of McDonalds, noted that they can not be seen from the interstate, coming from the east, the way things are currently. This is the reason for the higher sign, a 50 foot sign could not be seen. Moved by Commissioner Seaton, seconded by Commissioner Brungardt, to adopt Ordinance Number 95-9708 on second reading. A roll call vote was taken. Aye: (3), Brungardt, Seaton, Divine. Nay: (2), Maxwell, Perney. Motion carried. (8.2) Second reading Ordinance Number 95-9709 adding Section 42-82 regarding setback requirements for residential corner lots. Moved by Commissioner Perney, seconded by Commissioner Seaton, to adopt Ordinance Number 95-9709 on second reading. A roll call vote was taken. Aye: (5), Maxwell, Brungardt, Perney, Seaton, Divine. Nay: (0). Motion carried. (8.3) Second reading Ordinance Number 95-9710 adding Sections 36-59 through 63 regarding lot split regulations. Moved by Commissioner Brungardt, seconded by Commissioner Seaton, to adopt Ordinance Number 95-9710 on second reading. A roll call vote was taken. Aye: (5), Maxwell, Brungardt, Perney, Seaton, Divine. Nay: (0). Motion carried. (8.4) First reading Ordinance Number 95-9711 levying the annual Business Improvement District service fees for 1996. Dennis Kissinger, City Manager, explained the Business Improvement District Number 1, (BID No. 1) , and their function. Nick Slechta, Executive Director for Salina Downtown, Inc. and BID No. 1, provided the Commission with a mission statement and other information regarding the Business Improvement District. Mr. Slechta gave an update on the Fox Storefronts. The Commission reviewed the 1996 budget and service fees. Moved by Commissioner Seaton, seconded by Commissioner Brungardt, to approve Ordinance Number 95-9711 for first reading. Aye: (5) . Nay: (0) . Motion carried. (8.5) Resolution Number 95-4933 appointing a member to the Board of Zoning Appeals. Moved by Commissioner Brungardt, seconded by Commissioner Perney, to adopt Resolution Number 95-4933. Aye: (5) . Action 95-354 95-355 (8.6) Resolution Number 95-4934 authorizing the Mayor to execute Amendment No. 2 to the Master Services Agreement with Camp Dresser & McKee for engineering services to address the issues involved in the remediation of groundwater and soil contamination in the central part of Salina in an amount not to exceed $532,342. Don Hoff, Director of Engineering and Utilities, explained Amendment Number 2 which addresses the next phase of the project.
