A RESOLUTION authorizing and providing for the issuance of Temporary gi
Notes of the City of Salina, Kansas in the sum of $12,891.90 _
to pay a portion of the cost of improving certain streets in the City
of Salina to be designated as Series No. PT -2 pendinf the issuance of
bonds to pay the cost of said work.
Z"EMEAS, pursuant to proceedings duly had according to law, contracts
have been let and partially preformed for the construction of certain
street improvements in the City of Salina, "ansas, all as provided by
Resolutions numbered 979, 980, 983, 9860 987, 988, 990, 993, 994, 995,
996, 998, 999, 1000, 1001, 1002, 1004, 1005, 1006, 1007, 1008, 1009,
1014, 1015, 1016, 1017, 1018, 1019, 1020,1027,1028,1029,1030,1031,1032,
I 10339 1035, 1037, 1038, 1039, 1040, 1041, 1042, 1043, 104-,, 1045, 1047,
1048, 1049,1051, 1052, 1053, 1054, 1055, 1056, and Ordinances numbered
52D3, 5294,52,95, 5304, 5316, 5317, 5318, 5325, 5326, 5327, 5335, 5336,
! and 5337 all of which resolutions and ordinances are incorporated herein
by reference as full as tnouJh set out herein in full; and
I WHEREAS, the total estimated cost of said improvements is X307,666.81 and;
fHE MIS, Temporary Notes No. 1,2,3,4,5,6,7,8, and 9 have herefore been
authorized, registered, and issued in the sum of X246,413.02 , and

WHEREAS, approved estimates are now on file in the of -"ice of the City
Clerk establishing that H. J. Taylor Construction Company, contractor
has partially preformed the contract for construction thereof and is en-
titled to receive the sum of 9"'12 891.90 i for such partial prefcrmance;
and ._
ffiHEKEAS, pending the issuance and sale of bonds to pay the cost of said
improvements it is necessary for said City to issue its temporary notes
to acquire funds to pay said co:itractor for such work: and
S0, NOW THEREFORE BE IT RESOLVED BY THE BOB -RD OF C0111ISSIONERS OF THE
CITY OF SALIlik, KANSAS:
That the foregoing preambles are hereby made a part of this resolution.
Thatpending the issuance and sale of bonds to pay the cost of said imp-
rovements the City of Salina shall issue its temporary note, date June 20,
1949, bearing interest at a rate not exceeding 6 per cent per annum,
maturing not later than November 1. 1949, in the sum of $12,891.90
being a sum less than the aggregate amount of bonds to be and now unissued,
as supported and shown by the approved estimate now on file and in
denomination as follows;
Number to $12,891.90
That said temporary note shall be signed by the 1J1ayor and shall be
attested by the signature of the City Clerk and the corporate seal of the
City shall be affixed thereto and that said temporary note shall be regis-
tered in the office of the City Clerk and on the Office of the Auditor of
State, as required by law.
That said note shall be designated as Series PT -2 and each shall be in
the form and shall contain certain recitals substantially as follows; to -wit:

KNOW ALL MM BY THESE PRESENTS, That the City of Salina in the County of
Saline, in the State of t nsas, acknowledgees itself to be indebetd and
for value received promises to pay to the beared the sum of _
Dollars in lawful money of the United States of
.Merica on the first day of ,19 , with interest
thereon, from the date hereof at the rate of pre cent per
annum, payable at maturity thereof, both principal and interest o3d this
note being payable at the office of the State Treasures of the 'tate of
Kansas, in the City of Topeka, Kansas, and said City of Salina, Kansas,
is held and firmly bound by these presents and the full faith, credit and
resources of said City are hereby irrevocably pledged for the payment o
said principal and interest at maturity.
This note is one of a series of notes of like date and tenor, ex-
cepting denomination, aggregating the principal sum of $ ,
issued by the City of Salina, Kansas, for the purpose of paying a part of
the cost of constructing certain curbing, guttering, paving and grading
improvements in said City by the authority of and in full compliance with
the provisions, restrictions and limitations of the constitution and laws
of the State of Kansas, including Sections 10-101 to 10-115, 12-601 to 12-608
and 13-1011 and 13-1011a and 10-123 General Statutes of Kansas, 1935, and
such sections as amended, and all ether provisions of the laws of said State
applicable thereto all pending issuance of bonds of said city to pay the
cost of said work, and this note and interest thereon to be paid by the
City of Salina, Ka.nsas�
And it is hereby declared and certified that all acts, conditions and things
required to be done and to exist precedent to and in the issuance of this
note have been properly done and preformed and do exist in due and regular
form and manner as required by the constitution and laws of the State of
4ansas, and that the total indebtedness of said City, including this series
of notes, does not exceed constitutional or statutory limitations.
IN 'NITNESS WHEREOF, TtiE City of Salina, Kansas, has executed this note by
causing it to be signed by its Ivayor and its corporate seal to be affixed

That the La.yor and the City Clerk are hereby authorized and directed
to prepare and execute said notes and sell the same in the manner prov-
ided by law, and when duly executed and registered to deliver said
notes to the purchaser or purchasers thereof.
