REGULAR MEETING OF THE BOARD OF COMMISSIONERS
DECEMBER 4, 1995
4:00 p.m.
The Regular Meeting of the Board of Commissioners met in the Commission
Meeting Room, City -County Building, on Monday, December 4, 1995, at 4:00
p.m.
There were present:
Mayor John Divine, Chairman presiding
Commissioner R. Abner Perney
Commissioner Evelyn Maxwell
Commissioner Peter F. Brungardt
Commissioner Kristin M. Seaton
comprising a quorum of the Board, also present:

Greg Bengtson, City Attorney
Dennis M. Kissinger, City Manager
Judy D. Long, City Clerk

CITIZEN FORUM
Robert Constable, attorney, spoke regarding a records request to
the Human Resources Department. He asked that the records be made
available. He also asked that the policy be changed to allow this type of
information to be released prior to the scheduling of a public hearing.
Greg Bengtson, City Attorney, explained that he has been working
on the request since last week and at this point was waiting for further
information from the Kansas Human Rights Commission before making his
recommendation on whether or not to change the policy.
Mayor Divine asked that the City Manager and City Attorney work
with Mr. Constable to resolve the issue.

PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME

CONSENT AGENDA
(6.1) Approve the minutes of the regular meeting of November 20,
1995.
(6.2) Resolution Number 95-4951 amending the Comprehensive Fee Schedule.
(6.3) Resolution Number 95-4952 authorizing the City Manager to execute
Certificates of Release from Environmental Condition Liability.
(6.4) Approval of the Manhole Reconstruction Project Number 95-955 and
authorize staff to set a date to receive bids.
Moved by Commissioner Seaton, seconded by Commissioner Perney, to
approve all items on the consent agenda. Aye: (5) . Nay: (0) . Motion
carried.
DEVELOPMENT BUSINESS

ADMINISTRATION
(8.1) Award of contract for the Belmont Boulevard Rehabilitation Project
Number 95-946.

Shawn O'Leary, Assistant Director of Engineering and Utilities,
explained the project and the bids received on November 28, 1995.
Moved by Commissioner Maxwell, seconded by Commissioner Perney, to
award the contract for the Belmont Boulevard Rehabilitation, Project Number
95-946, to Frank Construction Company, Inc. in the amount of $662,040.00.
Aye: (5). Nay: (0). Motion carried.
(8.2) Approval of Building Demolition Project Number 95-956 and authorizing
staff to establish a bid date.
Shawn O'Leary, Assistant Director of Engineering and Utilities,
explained the project.
Mike Peterson, Building Inspector and Zoning Administrator, spoke
to the Commission regarding the fourteen (14) condemned properties on the list.
Commissioner Perney, Secretary of the Board of the Habitat for
Humanity, requested three (3) properties owned by the Habitat for Humanity
be removed from the list since they already have permits to remove those
structures; 701 North Third, 708 North Fifth and 715 North Fifth.
Mr. Peterson said he feels this would be appropriate.
Dennis Kissinger, City Manager, suggested that the Commission
authorize staff to seek bids, deleting properties as necessary.
Moved by Commissioner Brungardt, seconded by Commissioner
Seaton, to approve Building Demolition Project Number 95-956 and authorize
staff to receive bids, deleting properties as necessary. Aye: (4). Nay: (0),
Commissioner Perney abstained as Secretary of the Board of the Habitat for
Humanity. Motion carried.
(8.3) First reading Ordinance Number 95-9715 providing for the annexation
of the Woodland Hills Estates Addition.
Judy Long, City Clerk, explained that this ordinance corrects the
legal description contained in Ordinance Number 95-9683, repealing the same.
Moved by Commissioner Maxwell, seconded by Commissioner Perney, to
approve Ordinance Number 95-9715 for first reading. Aye: (5) . Nay: (0) .
Motion carried.
