ORDINANCE NUMBER 12-10641
AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF THE
RIGHT-OF-WAY FOR A PUBLIC PEDESTRIAN WAY IN THE COUNTRY OAK ESTATES
SUBDIVISION IN THE CITY OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on June 18, 2012, the Salina City Commission conducted a public hearing on the
petition filed by Sean VanMeter ("Petitioner") requesting vacation of the South Six (6) feet of the North
Forty-eight (48) feet of Lot Three (3), Block Five (5) in the Country Oaks Estates Subdivision in the
City of Salina, Saline County, Kansas.
The above described right-of-way to be vacated contains Six Hundred and Ninety (690) square
feet, more or less.
Section 2. That the governing body finds from the evidence presented at the public hearing that:
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by vacation of the right-of-way.
(c) In justice to the Petitioner vacation of the right-of-way should be granted.
Section 3. That the above described six (6) foot strip of right-of-way is hereby vacated and shall
revert to the owner of the following described parcel:
Lot Three (3), except the Northeast Forty-eight feet (48'), and Lot Two (2), except the
following described parcel: Beginning at the Southeast corner of said Lot Two (2); thence
northerly along the east line of said Lot Two (2) a distance of Five feet (5'); thence North
83 degrees 11 minutes 13 seconds West a distance of 114.85 feet to the Southwest corner
of said Lot Two (2); thence South 80 degrees 41 minutes 31 seconds East along the South
line of said Lot Two (2) a distance of 114.69 feet to the point of beginning, all in Block
Five (5), Country Oaks Estates Subdivision in the City of Salina, Saline County, Kansas.
Section 4. That this ordinance shall be in full force and effect from and after its adoption and
publication once in the official city newspaper.
