05-12-1997 MinutesAction CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS MAY 12, 1997 4:00 p.m. The City Commission convened at 1:45 p.m. in a Study Session for an Orientation Tour of the Engineering and Planning Departments. The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in the Commission Meeting Room, City -County Building, on Monday, May 12, 1997. A roll call was taken followed by the Pledge of Allegiance and a moment of silence. There were present: Mayor Kristin M. Seaton, Chairman presiding Commissioner Peter F. Brungardt Commissioner Don Heath Commissioner Alan Jilka Commissioner Monte Shadwick comprising a quorum of the Board, also present: Absent: Greg Bengtson, City Attorney Mike Morgan, Deputy City Manager Judy D. Long, City Clerk Dennis M. Kissinger, City Manager None. CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Day of May 13, 1997 as BARBARA WESTERMAN DAY in the City of Salina. The proclamation was read by Kristy Gilreath, South High School Senior Drum Major. (4.2) The Week of May 18 through May 24, 1997 as NATIONAL PUBLIC WORKS WEEK in the City of Salina. The proclamation was read by Shawn O'Leary, the National Delegate for the Kansas Chapter of the American Public Works Association. Mr. O'Leary introduced Larry Magnon of the American Public works Association who presented the Commission with the Transportation Award (2 mill & under) for the Ninth and Broadway improvement project. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Public hearing on Petition Number 4140, requesting the vacation of restricted access on Albert Avenue. Mayor Seaton called the public hearing to order. Shawn O'Leary, Assistant Director of Engineering and Utilities, explained the the petition and asked that the public hearing be continued until May 19, 1997. There being no other comments the Mayor declared the public hearing closed. 97-1049 Moved by Commissioner Brungardt, seconded by Commissioner Heath, to continue the public hearing until May 19, 1997. Aye: (5) . Nay: (0) . Motion carried. CONSENT AGENDA (6.1) Approve the minutes of the regular meeting of May 5, 1997. (6.2) Resolution Number 97-5154 authorizing the City Manager to execute Certificates of Release from Environmental Condition Liability to certain persons. ADMINISTRATION 8.1) Second reading Ordinance Number 97-9801 repealing Articles III, IV, J, VI and VII of Chapter 6 of the Salina Code pertaining to Amusements and Judy Long, City Clerk, noted that she had received one comment in favor of keeping the current ordinance. 97-1051 Moved by Commissioner Heath, seconded by Commissioner Shadwick, adopt Ordinance Number 97-9801 on second reading. A roll call vote was ken. Aye: (5), Jilka, Brungardt, Shadwick, Heath, Seaton. Nay: (0). otion carried. 2) Second reading Ordinance Number 97-9802 amending Section 14-53 of Salina Code pertaining to Fireworks. 97-1052Moved by Commissioner Brungardt, seconded by Commissioner Heath, adopt Ordinance Number 97-9802 on second reading. Nay: (0). otion carried. 97-1053 97-1054 8.3) Second reading Ordinance Number 97-9803 requesting a change in oning from C-1 to PC -3 on property located at 671 Elmore Drive. Moved by Commission Heath, seconded by Commissioner Jilka, to dopt Ordinance Number 97-9803 on second reading. A roll call vote was ken. Aye: (5), Brungardt, Heath, Jilka, Shadwick. Nay: (0). Abstain: 1), Seaton. Motion carried. OTHER BUSINESS None.
