REGULAR MEETING OF THE BOARD OF COMMISSIONERS
MAY 5, 1997
4:00 p.m.
The City Commission convened at 2:30 p.m. in a Study Session to discuss
Central Business District traffic planning. The Regular Meeting of the Board
of Commissioners was called to order at 4:00 p.m. in the Commission Meeting
Room, City -County Building, on Monday, May 5, 1997. A roll call was taken
followed by the Pledge of Allegiance and a moment of silence.

CITIZEN FORUM
AWARDS - PROCLAMATIONS
(4.1) The Days of May 9 and 10, 1997 as BUDDY POPPY DAYS in the city
of Salina. The proclamation was read by Leon P. Kashkin, Buddy Poppy
Chairman, VFW Post #1432.
(4.2) The Week of May 11 through 17, 1997 as POLICE WEEK in the city of
Salina. The proclamation was read by Chaplain Rob Johnson, Salina Police
Department.

CONSENT AGENDA
(6.1) Approve the minutes of the regular meeting of April 21, 1997.
(6.2) Authorize bids on City Vehicles and Equipment, Phase 2.
Moved by Commissioner Brungardt, seconded by Commissioner Jilka,
to approve all items on the consent agenda. Aye: (5) . Nay: (0) . Motion

DEVELOPMENT BUSINESS
(7.1) Application #Z97-4, filed by Mowery Clinic, requesting a change in
zoning district classification from C-1, Restricted Business District, to PC -3,
Planned Shopping Center District, on property located at 671 Elmore Drive.
(7.1a) First reading Ordinance Number 97-9803.
Commissioner Seaton stated that she would be abstaining from the
item and that Commissioner Brungardt would be the acting Chair.
Roy Dudark, Director of Planning and Community Development,
explained the application and zoning request.
97-1038 Moved by Commissioner Heath, seconded by Commissioner Shadwick,
to approve Ordinance Number 97-9803 for first reading. Aye: (4) . Nay:
(0) . Abstain: (1) , Seaton. Motion carried.
Action
(7.2) Application #Z97-3, filed by Timberline Property, Inc., requesting a
change in zoning district classification from RS, Residential Suburban District,
to R-2.5, Multi -Family Residential District, for property located at 1000 W.
Republic.
(7.2a) First reading Ordinance Number 97-9804.
Roy Dudark, Director of Planning and Community Development,
explained the application and change of zoning request from R-2.5 to R-2
zoning.

to approve Ordinance Number 97-9804 for first reading. Aye: (5). Nay:

ADMINISTRATION
(8.1) Second reading Ordinance Number 97-9800 requesting the rezoning of
Lots 1 - 12, Block 1 in the Replat of Lots 1-13, Block 5, GICO Addition.
Mayor Seaton noted that staff reported no further comment has been
received.
97-1040 Moved by Commissioner Brungardt, seconded by Commissioner Jilka,
to adopt Ordinance Number 97-9800 on second reading. A roll call vote was
taken. Aye: (5), Heath, Shadwick, Brungardt, Jilka, Seaton. Nay: (0).
Motion carried.
(8.2) First reading Ordinance Number 97-9801 repealing Articles III, IV,
V, VI and VII of the Salina Code regarding Amusements and Entertainment.
Judy Long, City Clerk, explained the proposed changes.

to approve Ordinance Number 97-9801 for first reading. Aye: (5) . Nay:

(8.3) First reading Ordinance Number 97-9802 amending Section 14-53 of
the Salina Code pertaining to fireworks.
Ellen Mitchell, City Prosecutor, explained the requested change.
97-1042 Moved by Commissioner Heath, seconded by Commissioner Shadwick,
to approve Ordinance Number 97-9802 for first reading. Aye: (5) . Nay:
(0). Motion carried.
(8.4) Resolution Number 97-5152 authorizing vertical expansion of certain
disposal areas at the City of Salina Landfill.
Dennis Kissinger, City Manager, explained that this study session
item from last week is to raise elevations at the landfill cells.
97-1043 Moved by Commissioner Jilka, seconded by Commissioner Brungardt,
to adopt Resolution Number 97-5152. Aye: (5) . Nay: (0) . Motion carried.
(8.5) Report on validity and submittal of engineering feasibility report for
Petition Number 4141, filed by Mr. Darvin Dent, requesting certain street and
utility improvements in Woodland Hills Estates Addition.
(8.5a) Resolution Number 97-5153 determining the advisability of and
authorizing certain street and utility improvements in Woodland Hills
Estates Addition.
(8.5b) Approval of the plans and specifications for the 1997
Subdivision Improvements Project Number 97-1038, and authorize staff to
set a bid date.
Shawn O'Leary, Assistant Director of Engineering and Utilities,
explained the requested improvements and declared the petition to be sufficient
with 100% of ownership represented. He also noted that the feasibility report
was included and gave a brief review.
97-1044 Moved by Commissioner Brungardt, seconded by Commissioner
Shadwick, to adopt Resolution Number 97-5153 and accept the feasibility
report. Aye: (5). Nay: (0). Motion carried.
Action
97-1045 Moved by Commissioner Shadwick, seconded by Commissioner Heath,
to approve the plans and specifications for Project Number 97-1038 and
authorize staff to set a bid date. Aye: (5) . Nay: (0) . Motion carried.
(8.6) Award of contract for the 1997 Storm Drainage Improvements, Project
Number 97-1001.
Shawn O'Leary, Assistant Director of Engineering and Utilities,
explained the project and the bid received April 29, 1997.
97-1046 Moved by Commissioner Heath, seconded by Commissioner Jilka, to
award the contract for the 1997 Storm Drainage Improvements, Project Number
97-1001 to Shears Construction in the amount of $217,826.20. Aye: (5) . Nay:
(0). Motion carried.
(8.7) Award of contract for the Magnolia Road Improvements, Project
Number 97-998.
Shawn O'Leary, Assistant Director of Engineering and Utilities,
explained the project and the bids received April 29, 1997.
97-1047 Moved by Commissioner Shadwick, seconded by Commissioner Heath,
to award the contract for the Magnolia Road Improvements, Project Number
97-998 to Shears Construction in the amount of $335,783.15. Aye: (5). Nay:
(0). Motion carried.
OTHER BUSINESS
(9.1) Mayor Seaton welcomed a Scout from Troop 2 who is working on a
merit badge.
