02-17-1997 MinutesAction 97-951 97-952 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS FEBRUARY 17, 1997 4:00 p.m. The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in the Commission Meeting Room, City -County Building, on Monday, February 17, 1997. A roll call was taken followed by the Pledge of Allegiance and a moment of silence. There were present: Mayor Evelyn Maxwell, Chairman presiding Commissioner R. Abner Perney Commissioner John Divine Commissioner Peter F. Brungardt Commissioner Kristin M. Seaton comprising a quorum of the Board, also present: Absent: Greg Bengtson, City Attorney Dennis M. Kissinger, City Manager Judy D. Long, City Clerk None. None. CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) The Week of February 16th through 22nd, 1997 as 'NATIONAL ENGINEER'S WEEK' in the City of Salina. The proclamation was read by Larry Stoss, President of the Smoky Valley Chapter of the Kansas Society of Professional Engineers and an electrical engineer with Bucher, Willis & Ratliff Engineers of Salina. (4.2) Recognizing Shelly Laubhan for her designation as a 1997 Dis- tinguished State Finalist in the Prudential Spirit of Community Awards, a proclamation will be read by George Troutfetter, South High Asst. Principal. (4.3) The Mayor received notice today that Salina has been named "1996 Tree City U.S.A." PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None. CONSENT AGENDA (6.1) Approve the minutes of the regular meeting of February 10, 1997. Moved by Commissioner Divine, seconded by Commissioner Brungardt, to approve the minutes of the regular meeting of February 10, 1997 as amended. Aye: (5). Nay: (0). Motion carried. None. DEVELOPMENT BUSINESS ADMINISTRATION (8.1) Second reading Ordinance Number 97-9786 pertaining to the rezoning of the Bonnie Ridge Planned Community. Judy Long, City Clerk, confirmed that no comments have been received. Moved by Commissioner Brungardt, seconded by Commissioner Seaton, to adopt Ordinance Number 97-9786 on second reading. A roll call vote was taken. Aye: (5), Brungardt, Divine, Perney, Seaton, Maxwell. Nay: (0). Motion carried. Action 97-953 97-954 97-955 97-956 97-957 (8.2) Second reading Ordinance Number 97-9787 amending the Salina Code regarding Private Refuse Hauler licensing. Judy Long confirmed that no comments have been received and explained the resolution amends the Comprehensive Fee Schedule. Moved by Commissioner Divine, seconded by Commissioner Seaton, to adopt Ordinance Number 97-9787 on second reading. A roll call vote was taken. Aye: (5), Brungardt, Divine, Perney, Seaton, Maxwell. Nay: (0). Motion carried. (8.2a) Resolution Number 97-5118 amending Refuse Hauler Fees. Moved by Commissioner Seaton, seconded by Commissioner Perney, to adopt Resolution Number 97-5118. Aye: (5) . Nay: (0) . Motion carried. (8.3) Second reading Ordinance Number 97-9788 designating the structure located at 201 South 8th Street as a Heritage Conservation Landmark. Judy Long confirmed that no comments have been received. Moved by Commissioner Perney, seconded by Commissioner Seaton, to adopt Ordinance Number 97-9788 on second reading. A roll call vote was taken. Aye: (5), Brungardt, Divine, Perney, Seaton, Maxwell. Nay: (0). Motion carried. (8.4) Second reading Ordinance Number 97-9789 amending the Salina Code by adding Section 42-469 pertaining to Heritage Conservation Districts. Judy Long confirmed that no comments have been received. Moved by Commissioner Brungardt, seconded by Commissioner Divine, to adopt Ordinance Number 97-9789 on second reading. A roll call vote was taken. Aye: (4), Brungardt, Divine, Seaton, Maxwell. Nay: (0). Abstain: (1) , Perney. Motion carried. (8.5) Special ballot issue for Kansas League of Municipalities By-laws amendment. Dennis Kissinger, City Manager, explained the minor By -Laws change and clarified that ex -officio members will have a vote. Moved by Commissioner Divine, seconded by Commissioner Seaton, to support the By -Laws of the State of Kansas League of Municipalities. Aye: (5) . Nay: (0) . Motion carried. (8.6) Report on 1997 Phase I Vehicle and Equipment bids. Dennis Kissinger noted that dump trucks usually have history of low warranty work. Commissioner Perney spoke for the elimination of the purchase of the police vehicle initiating a discussion to consider using a van instead. He moved to approve the purchase from Lacy-Regher and delete the Police Suburban (4 -wheel drive) . Dennis Kissinger requested that the police vehicle not be deleted but tabled to allow staff to provide options. motion. Rod Franz, Director of Finance and Administration, explained the bids received February 11, 1997 and the totals, noting the fact that only one bid was received for the truck bids. He indicated that additional future action will be taken to acquire more bids. It was also explained that the Commission may want to go with the low bid on the dump truck from Lacy Regehr with warranty work being done locally. The bid was $572.00 lower than the bid from Long MacArthur Ford. Dennis Kissinger noted that dump trucks usually have history of low warranty work.
