Ordinance Number 03-10153, amending Chapter 34, Article V, Sections 34-92,34-93 and 34- 96 of the Salina Code pertaining to Salina/Saline County Solid Waste Management Committee and repealing existing Sections 34-92, 34-93 and 34-96, pertaining to Solid Waste Committee membership, terms of office, and quorum. B. Resolution Number 03-5953 authorizing a First Amendment to the Solid Waste Management Interlocal Agreement. BACKGROUND: These recommended changes to the Salina/Saline Solid Waste Management Committee are to bring our committee membership in line with current State statutes concerning membership on the committee, to provide expanded service time to interested citizens, and to provide more flexibility in conducting committee business. The first proposed revision would be to restructure the committee membership in accordance with current State statutes. These statute changes were first brought to our attention in a letter from the Kansas Department of Health and Environment this last January. Although we are proposing to follow the structure established by the State, those membership seats eliminated by the initial change will be reassigned to "At Large" positions, which are allowed under the current State membership design. This adjustment will keep our committee membership at thirteen (13) members. A chart has been provided to illustrate the change from our current structure to the new structure. In addition, with these changes to the membership structure, we will allow all committee members the ability to start over their service time as of September 1, 2003. A term of office will remain three (3) years. However, for some members on the committee, their first term will be for four (4) years in order to spread out the expiration dates. The second change is that Solid Waste Management Committee members will by allowed to serve three (3) consecutive terms, rather then the two (2) consecutive terms that are allowed at this time. This change is to complement the long range planning that this group performs, and to allow interested members more time to serve the community. As is currently the case, once a member has completed their term limit, they can serve again after waiting one year. The third and last change is to revise how we establish the committee quorum. At this time the City Code states under Quorum, "Seven (7) members of the committee shall constitute a quorum for the purpose of conducting the committee's business." This would be revised to allow committee business to be conducted with a simple majority of those persons on the committee at that time. This will allow us to conduct business when we have some positions vacant and several members are not in attendance. RECOMMENDATION: 1. Pass Ordinance No. 03-10153 amending Chapter 34, Article V, Sections 34-92, 34-93 and 34-96 of the Salina Code on first reading. Adopt Resolution No. 03-5953 authorizing a First Amendment to the Solid Waste Mana ement Interlocal A reement. 2. Sec. 34-92. Membership. The committee shall eonsist of thirteen (13) members. Eight (8) representing the City of Salina, nominated by the mayor and appointed by the governing body. Three (3) nomil'Htted by Saline COlmty, representing unincorporated areas. Two (2) nominated by Saline County represØflting third elass cities within the col:lflty. In accordance with K.S.A. 64-3405, the membership of the committee shall include a total of thirteen (13) members, as follows: Five (5) residents of the City of Salina, nominated by the mayor of the City of Salina and appointed by the governing body of the City of Salina, representing the City of Salina as a city of the first class located in Saline County. One (1) resident of the unincorporated area of Saline County, nominated by the board of Saline County commissioners and appointed by the governing body of the City of Salina, representing the unincorporated areas of Saline County. One (1) resident of any of the cities of the third class located within Saline County (Assaria, Brookville, Gypsum, New Cambria, and Smolan), nominated by a majority of the mayors of those cities and appointed by the governing body of the City of Salina, representing the cities of the third class located in Saline County. Six (6) residents of Saline County at-large, including four (4) nominated by the mayor of the City of Salina and two (2) nominated by the board of Saline County commissioners, and all appointed by the governing body of the City of Salina. Elected officials and employees of either Saline County or any city located within Salina County shall neither be nominated nor appointed to the committee. (a) (b) (c) (d) Sec. 34-93.
