REGULAR MEETING OF THE BOARD OF COMMISSIONERS
JUNE 17, 1996

The Regular Meeting of the Board of Commissioners met in the Commission
Meeting Room, City -County Building, on Monday, June 17, 1996, at 4:00 p.m.
There were present:
Mayor Evelyn Maxwell, Chairman presiding

AWARDS - PROCLAMATIONS
PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME

CONSENT AGENDA
(6.1) Approve the minutes of the regular meeting of June 10, 1996.
(6.2) Resolution Number 96-5019 authorizing the City Manager to execute a
professional services agreement with David M. Griffith and Associates, LTD to
perform a cost allocation study for the Department of Information Services.
(6.3) Approval of a project to replace the floor tile in Heritage Hall and
direct staff to establish a bid date.
(6.4) Resolution Number 96-5020 consenting to the assignment by Equitable
Life Assurance Society of the United States to DMH & Associates, L.L.C., of
its obligations under an Agreement relating to access improvements and release
of Equitable from such obligations.
Shawn O'Leary, Assistant Director of Engineering and Utilities,
responded to the Mayor's inquiry of the need to replace the floor in Heritage
Hall at the Bi -Centennial Center, stating that it was worn and over fifteen
years old.

Brungardt, to approve all items on the consent agenda. Aye: (5). Nay:

DEVELOPMENT BUSINESS
(7.1) Discussion of possible application for 1996 Community Development
Block Grant (CDBG) Housing Program and for the HOME Investment
Partnerships Program Grant (HOME Program) .
Roy Dudark, Director of Planning and Community Development,
explained the grant programs, elaborating on the status of the current HOME
Program and options for the use of funds. In response to Commission inquiry
he stated that while the City could accept both grants, if awarded, it is
unlikely that the City would receive both. He also spoke regarding local
emergency funds for the recent flood damage.
Action
Dennis Kissinger explained matching funds, emergency needs and
federal funds.
96-613 Moved by Commissioner Perney, seconded by Commissioner Brungardt,
to proceed with the applications for the CDBG and HOME Programs in the
realm of $200,000 to $300,000 each and set the date for a Public Hearing of July
8, 1996. Aye: (5). Nay: (0). Motion carried.
ADMINISTRATION
(8.1) Second reading Ordinance Number 96-9743 amending Chapter 38 of
the Salina Code by adding provisions prohibiting yellow curb parking.
Judy Long confirmed no comments have been received.

adopt Ordinance Number 96-9743 on second reading. A roll call vote was
taken. Aye: (5), Perney, Seaton, Divine, Brungardt, Maxwell. Nay: (0).

(8.2) Second reading Ordinance Number 96-9745 amending Chapter 25 of
the Salina Code by adding provisions prohibiting aggressive begging/ soliciting.

Brungardt, to adopt Ordinance Number 96-9745 on second reading. A roll call
vote was taken. Aye: (5), Perney, Seaton, Divine, Brungardt, Maxwell.

(8.3) Second reading Ordinance Number 96-9746 amending Chapter 25 of
the Salina Code by changing the penalty classification regarding criminal damage
to property and by adding provisions regarding criminal trespass.

to adopt Ordinance Number 96-9746 on second reading. A roll call vote was
taken. Aye: (5), Perney, Seaton, Divine, Brungardt, Maxwell. Nay: (0).

(8.4) Second reading Ordinance Number 96-9747 amending Chapter 7 of the
Salina Code by defining certain words and phrases and adding provisions
regarding dangerous or vicious dogs.

96-617 Moved by Commissioner Divine, seconded by Commissioner Seaton, to
adopt Ordinance Number 96-9747 on second reading.
Jim Hill, Chief of Police, responded to the Mayor's concerns regarding
the mandating of veterinarian reporting of dog bites on other animals. He was
not concerned about mandatory reporting and agreed with voluntary compliance
by veterinarians.
A roll call vote was taken. Aye: (5), Perney, Seaton, Divine,
Brungardt, Maxwell. Nay: (0) . Motion carried.
(8.5) Resolution Number 96-5018 stating the permanent status of the Smoky
Hill Museum.
Martha Rhea, Director of Arts and Humanities, explained the
Resolution of Permanence which is part of the accreditation process by the
American Association of Museums.
96-618 Moved by Commissioner Divine, seconded by Commissioner
Brungardt, to adopt Resolution Number 96-5018 and acknowledge receipt of the
bylaws of the Salina Arts and Humanities Commission.
Jack Henry, Dean and Chief Administrative Officer of Kansas
Wesleyan University and Chairman of the Arts and Humanities Commission,
spoke in favor of the resolution and noted the prestigious honor for Salina if
accreditation was given.
The Mayor called for a vote. Aye: (5) . Nay: (0) . Motion carried.

(8.6) Ordinance Number 96-9748 amending Chapter 8 of the Salina Code by
adding provisions relating to the posting of noncommercial opinion signs and
political signs.
Greg Bengston and Dennis Kissinger explained the necessity of the
inance, recent court cases and detailed what was contained within the

the location of signs on properties.

adopt Ordinance Number 96-9748 for first reading. Aye: (5) . Nay: (0) .

Moved by Commissioner Seaton, seconded by Commissioner Divine, to
declare an emergency exists in order to have the second reading of this
ordinance today. Aye: (5). Nay: (0). Motion carried.
Moved by Commissioner Brungardt, seconded by Commissioner Perney,
to adopt Ordinance Number 96-9758 on second reading. A roll call vote was
taken. Aye: (5), Perney, Seaton, Divine, Brungardt, Maxwell. Nay: (0).
Motion carried.
(8.7) Executive Session to discuss a personnel matter.
Moved by Commissioner Brungardt, seconded by Commissioner Perney,
that the Commission recess into executive session for the purpose of discussing
a personnel matter related to non -elected city personnel, for the reason that
public discussion of the matter would potentially invade the privacy rights of
the personnel involved; and reconvene in this room in 10 minutes, or at 4:40
p.m.
Mayor Maxwell noted no action was expected and called for a vote to
the motion. Aye: (5) . Nay: (0) . Motion carried.
The Board of Commissioners recessed at 4:30 p.m. and reconvened
at 4:40 p.m. No action was taken.
