Grantor acknowledges that it is perpetually obligated to maintain the drainage ditch and easement area in a state of good repair. All maintenance within this drainage easement shall be the right, duty and responsibility of the property owner(s). However if the maintenance of the easement area is neglected and is determined to be a hazard or threat to public safety by the City Engineer corrective maintenance may be performed by the City of Salina with costs assessed to and borne by said property owner(s). Officials representing the City Engineering Department shall have the right to enter upon the easement for purposes of periodic inspection and / or corrective maintenance of the detention facility. Upon receiving written approval from the City Engineer, property owner(s) may construct improvements within the easement provided the improvement does not interfere with the function of the drainage swale and ditch. Grantor hereby covenants that it is the lawful owner of the described premises and has the right, power, and authority to convey the rights granted hereby.
