02-08-1999 MinutesCommission Action # 99-1904 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS FEBRUARY 8, 1999 4:00 p.m. The City Commission convened at 2:30 p.m. in a Study Session to discuss the Southeast Corridor Engineering Concept Report. The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in Room 107, City -County Building. A roll call was taken followed by the Pledge of Allegiance and a moment of silence. There were present: Mayor Peter F. Brungardt, Chairman presiding Commissioner Kristin M. Seaton Commissioner Monte Shadwick Commissioner Don Heath Commissioner Alan Jilka comprising a quorum of the Board, also present: Greg Bengtson, City Attorney Dennis M. Kissinger, City Manager Judy D. Long, City Clerk Absent: None. None. None. CITIZEN FORUM AWARDS - PROCLAMATIONS PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME (5.1) Public hearing and report on Petition No. 4176 requesting vacation of surplus road right-of-way at the southwest corner Ninth and Schilling in Riffel Addition. (5.1 a) First reading Ordinance Number 99-9912. Mayor Brungardt opened the public hearing. Shawn O'Leary, Director of Engineering and General Services, gave the staff report. There being no questions or further discussion, the public hearing closed. Moved by Commissioner Seaton, seconded by Commissioner Jilka, to approve Ordinance Number 99-9912 for first reading. Aye: (5). Nay: (0). Motion carried. (5.2) Continuation of public hearing and report on Petition No. 4174 requesting vacation of part of the North Tenth Street right-of-way between Lincoln and North. (5.2a) First reading Ordinance Number 99-9913. It was noted that the public hearing was still in session. Shawn O'Leary, Director of Engineering and General Services, gave the staff report. There being no questions or further discussion, the public hearing closed. 99-1905 Moved by Commissioner Jilka, seconded by Commissioner Seaton, to approve Ordinance Number 99-9913 for first reading. ADMINISTRATION (8.1) Second reading Ordinance No. 99-9910 exempting certain property owned by Salina Vortex Corporation from Ad Valorem Taxation. 99-1907 Moved by Commissioner Heath, seconded by Commissioner Shadwick, to adopt Ordinance Number 99-9910 on second reading. A roll call vote was taken. Aye: (5), Jilka, Seaton, Shadwick, Heath, Brungardt. Nay: (0). Motion carried. (8.2) Second reading Ordinance No. 99-9911 amending Sections 25-51 and 25-71 of Chapter 25 of the Salina Code pertaining to Offenses, Miscellaneous Provisions. 99-1908 Moved by Commissioner Shadwick, seconded by Commissioner Heath, to adopt Ordinance Number 99-9911 on second reading. A roll call vote was taken. Aye: (5), Jilka, Seaton, Shadwick, Heath, Brungardt. Nay: (0). Motion carried. (8.3) Resolution Number 99-5417 authorizing the installation and/or removal of traffic control devices. Shawn O'Leary, Director of Engineering and General Services, and Dennis Kissinger, City Manager, explained the recommended changes. Brigid Hall, 231 Fairdale, wants yeild/stop signs every two blocks on Fairdale. This would move traffic back to Seitz and Marymount, which were intended to be collector streets. She thought this item should be tabled. Debbie Payne, 151 Fairdale, agrees with Brigid Hall. 99-1909 Moved by Commissioner Seaton, seconded by Commissioner Jilka, to adopt Resolution Number 99-5417. Aye: (5). Nay: (0). Motion carried. (8.4) Request for executive session. (Personnel) 99-1910 Moved by Commissioner Shadwick, seconded by Commissioner Heath, that the City Commission recess into executive session for 20 minutes to discuss a matter pertaining to non- elected city personnel for the reason that public discussion of the matter would violate the privacy rights of the non -elected city personnel involve; and reconvene in this room at 5:00 p.m. Aye: (5). Nay: (0). Motion carried. The Board of Commissioners recessed at 4:20 p.m. and reconvened at 5:00 p.m. 99-1911 Moved by Commissioner Jilka, seconded by Commissioner Seaton, that the City Commission return to executive session for an additional 10 minutes. Aye: (5). Nay: (0). Motion carried. The Board of Commissioners reconvened at 5:10 p.m. 99-1912 Moved by Commissioner Shadwick, seconded by Commissioner Jilka, that the City Commission return to executive session for an additional 5 minutes. Aye: (5). Nay: (0). Motion carried. The Board of Commissioners reconvened at 5:15 p.m. No action was taken. OTHER BUSINESS None.
