A RESOLUTION EXPRESSING THE INTENT OF THE GOVERNING BODY OF
TIIE CITY OF SALINA, KANSAS TO PARTICIPATE IN THE SCULPTURE TOUR
SALINA PROGRAM BY PURCHASING THE PEOPLE'S CHOICE AWARD
SCULPTURE.
WHEREAS, that on February 8, 2010, representatives of "Sculpture Tour Salina" presented
a proposed sculpture tour program for the city of Salina; and
WHEREAS, that the committee was seeking involvement by the City of Salina by
displaying the sculptures within the public right -of --ways in the downtown area and to annually
purchase the sculpture that is voted by the public as the People's Choice Award at a cost not to
exceed the lesser of the offered selling price or'$15,000; and
WHEREAS, that at the February 8, 2010 study session the Governing Body indicated that
there was a general consensus with allowing the display of the sculptures subject to staff review and
to purchase the People's Choice Award; and
WHEREAS, that the Governing Body adopted Resolution Number I 1-6821 authorising a
license agreement for the placement of the sculptures in the downtown area. SO NOW
THEREFORE,
BE IT RESOLVED by the Governing Body of the city of Salina, Kansas:
Section 1. That the City of Salina intends to participate in the Sculpture Tour Program.
Section 2. That the City of Salina intends to participate by allowing the display of the
sculptures within the public right-of-ways in the downtown area by the aforementioned license
agreement and by annually purchasing the sculpture selected by open, public ballot for the People 's
Choice Award.
Section 3. That the purchase of the People's Choice Award winning sculpture is the lesser
of the state sale price'or the maximum amount of $15,000.
Section 4. That the City of Salina will not be obligated to purchase the People's Choice
Award if the sculpture is either in a damaged state or deteriorated beyond reasonable expectations
due to climate conditions or other factors.
Section 5. That the City of Salina intends to annually participate in the program as long as
Sculpture Tour Salina exists, subject to annual budget appropriation by the City Commission.
Section 6. That this resolution shall be in full force and effect upon its adoption.
Adopted by the Governing Body and signed by the Mayor on this 16`x' day of May, 2011.
