12-10632 Annex East Magnolia Right of Way(Published in The Salina Journal March2012.) ORDINANCE NUMBER 12-10632 AN ORDINANCE PROVIDING FOR THE ANNEXATION OF A CERTAIN TRACT OF LAND IN SALINE COUNTY, KANSAS IN CONFORMITY WITH THE PROVISIONS OF K.S.A. 12 -520(a)(2),12 -520(a)(7) and 12-520(b). w WHEREAS, the City of Salina has acquired public right-of-way for the East Magnolia Road Improvement Project from Ohio Street to the levee; portions of which have not become part of the city, and the City wishes to annex the entire project limits into the city; and B 8 WHEREAS, the Unified School District No. 305 Board of Education has consented to the annexation of the Fifty (50) feet roadway easement abutting their property on the south side of Magnolia Road; and WHEREAS, the legal description of the project limits has been reviewed by the City Surveyor and found to accurately describe the right-of-way the City of Salina is proposing to annex. SO, NOW THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That the following described tract of land, to -wit: A tract of land located in the Northwest and the Northeast Quarter of Section 31, Township 14 South, Range 2 West of the 6h Principal Meridian, and the Southeast Quarter of Section 30, Township 14 South, Range 2 West of the 6'h Principal Meridian, and the Magnolia Road Right -of - Way of the River Trail Addition, an addition in Saline County, Kansas, said tract more particularly described as follows: Beginning at the Northeast corner of the Northwest Quarter of said Section 31; - Thence on an assumed bearing of S 88°54'30" W, along the North line of said Northwest Quarter, a distance of 185.71 feet to the Northwest corner of a Tract described in Deed Book 1003, Page 1886-1887; ' - Thence S 00041'12" E along the West line of said Tract described in Deed Book 1003, Page 1886-1887, a distance of 50.00 feet to a point on the South Right -of -Way line of Magnolia Road; Thence N 88°54'30" E along said South Right -of -Way line, a distance of 185.65 feet; - Thence N 88'55'12"E along said South Right -of -Way line, a distance of 229.92 feet to a point on the East line of said Tract described in Deed Book 1003, Page 1886-1887; - Thence N 88°55'12" E along said South Right -of -Way line, a distance of 338.48 feet; - Thence S 00°37'33" E along said South Right -of -Way line, a distance of 10.00 feet; - Thence N 88°55'12" E along said South Right -of -Way line, a distance of 487.87 feet; - Thence S 77°02'37" E along said South Right -of -Way line, a distance of 61.85 feet; - Thence N 88'55'12" E along said South Right -of -Way line, a distance of 315.00 feet; - Thence S 86°21'06" E along said South Right -of -Way line, a distance of 194.82 feet to a point on the South line of an existing City of Salina Flood Control Levee; - Thence N 82°30'43" W along the South line of an existing City of Salina Flood Control Levee, a distance of 276.53 feet to the West line of an existing City of Salina Flood Control Levee; - Thence N 00°30'03" W along the West line of an existing City of Salina Flood Control Levee and said West line extended, a distance of 49.87 feet to the North line of said Northeast Quarter; - Thence S 88°55' 12" W on the North line of said Northeast Quarter, a distance of 19.30 feet; - Thence N 00°00'00" E along a line extended from the West line of an existing City of Salina ' Flood Control Levee and said West levee line, a distance of 30.00 feet to a point on the North line of an existing City of Salina Flood Control Levee; - Thence N 80'26'18" E along said North levee line, a distance of 135.61 feet to the West line of an existing City of Salina Flood Control Levee; - Thence N 26°05'43" W along said West levee line, a distance of 38.62 feet; - Thence N 84'45'14" W along the North Right -of -Way line of Magnolia Road, a distance of 181.51 feet; - Thence S 74°53'02" W along said North Right -of -Way line, a distance of 103.08 feet; - Thence S 01'04'48" E along said North Right -of -Way line, a distance of 10.00 feet; - Thence S 88'55'12" W along said North Right -of -Way line, a distance of 302.09 feet; - Thence S 00°29'32" E along said North Right -of -Way line, a distance of 20.00 feet; - Thence S 88'55'12" W along said North Right -of -Way line, a distance of 88.72 feet; - Thence S 88'55'12" W, along said North Right -of -Way line, a distance of 344.79 feet to the Southeast corner of Lot 38, Block 4, of said River Trail Addition; - Thence S 88'55'12" W, along the North Right -of -Way line of Magnolia Road, a distance of 434.41 feet to the Southwest corner of Block 1 of said River Trail Addition; Thence S 00°32'56" E on the West line of said Southeast Quarter of Section 30, a distance of 50.00 feet to the Point of Beginning, said tract containing 178,187 square feet, more or less, a w meeting the criteria for annexation set out in K.S.A. 12-520(a)(2) and 12-520(b) is hereby annexed and made g a part of the City of Salina, Kansas. ' Section 2. That Ordinance No. 93-9581 is hereby amended so that the following additions meeting o the criteria for annexation set out in K.S.A. 12-520(a)(7) are hereby annexed in their entirety, including all dedicated street right-of-way: - Golden Eagle Estates Addition, to the City of Salina, Saline County, Kansas; - Corrected Plat of Blocks Two and Three Golden Eagle Estates Addition to the City of Salina, Saline County, Kansas; - Golden Eagle Estates Addition No. 2 to the City of Salina, Saline County, Kansas; - Golden Eagle Estates Addition No. 3 to the City of Salina, Saline County, Kansas; and - Eaglecrest Townhomes Addition to the City of Salina, Saline County, Kansas C Section 3. That Ordinance No. 93-9581 is hereby repealed. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
