06-18-2001 MinutesCommission Action # CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS June 18, 2001 4:00 p.m. The City Commission convened at 2:30 p.m. in a Study Session to discuss the Pre -Budget Finance Report. The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in Room 107, City -County Building. A roll call was taken followed by the Pledge of Allegiance and a moment of silence. There were present: Vice Mayor Larry L. Mathews, Chairman presiding Commissioner Deborah P. Divine Commissioner Alan E. Jilka Commissioner Monte D. Shadwick comprising a quorum of the Board, also present: Absent: Greg Bengtson, City Attorney Dennis M. Kissinger, City Manager Lieu Ann Nicola, City Clerk Mayor Kristin M. Seaton None. CITIZEN FORUM AWARDS - PROCLAMATIONS (4.1) Award announcements for city projects and city staff member recent awards. Dennis Kissinger, City Manager, explained that a city staff member and a recently completed city project have been recognized by two statewide organizations. The South Ohio Street project was named the winner of the highest award of the Kansas Chapter of APWA. Also the Kansas Association of Professional Engineers named Shawn O'Leary, Director of Engineering and General Services, the "Government Engineer of the Year." PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None. CONSENT AGENDA (6.1) Approve the minutes of June 4, 2001. (6.2) Authorizing final cost payment of $128,411.98 to the Kansas Department of Transportation on project #85-U-0896-01 for the construction of Crawford Street from Montrose east to Ohio Street. 01-2923 Moved by Commissioner Shadwick, seconded by Commissioner Divine, to approve the consent agenda as presented. DEVELOPMENT BUSINESS ADMINISTRATION (8.1) Second reading Ordinance No. 01-10038 amending Chapter 25 of the Salina Code by adding Section 25-85, pertaining to Furnishing Cigarettes or Tobacco Products to a Minor. Vice Mayor Larry Mathews clarified that Ordinance No. 01-10038 was passed on first reading on June 4, 2001 and since that time no comments have been received. Moved by Commissioner Jilka, seconded by Commissioner Shadwick, to adopted Ordinance No. 01-10038 on second reading amending Chapter 25 of the Salina Code by adding Section 25-85, pertaining to Furnishing Cigarettes or Tobacco Products to a Minor. A roll call was taken. Aye: (4) Divine, Jilka, Shadwick, Mathews. Nay: (0). Motion carried. (8.2) Second reading Ordinance No. 01-10039 amending Chapter 25 of the Salina Code by amending Section 25-132, pertaining to Disturbing the Peace. Vice Mayor Larry Mathews clarified that Ordinance No. 01-10039 was passed on first reading on June 4, 2001 and since that time no comments have been received. Commissioner Divine questioned if the provisions in the ordinance would include automobiles without mufflers. Dennis Kissinger, City Manager, explained that there was a 50 feet provision, and also automobiles without mufflers are addressed in other sections of the Salina Code. Moved by Commissioner Shadwick, seconded by Commissioner Jilka, to adopted Ordinance No. 01-10039 on second reading amending Chapter 25 of the Salina Code by amending Section 25-132, pertaining to Disturbing the Peace. (8.3) First reading Ordinance No. 01-10041 amending Chapter 8 of the Salina Code by adding an exception to Section 8-516, pertaining to Bonds Required under Article XVII Contractors/Tradesman Registration. Mike Morgan, Deputy City Manager, explained that in January of 2001 requirements for contractors/tradesman was adopted. City Staff and Building Codes Advisory and Appeals Board recommended waiving the surety bond requirement when work performed is not regulated by the Uniform Building Code and/or the work performed does not require a permit and/or when the owner of the property is performing the work. Commissioner Shadwick questioned what would happen if the work did not comply with City Code. Mr. Morgan explained that the surety bond is to protect the customer and is reasonable to eliminate the surety bond requirement when the customer is also the owner. Commissioner Shadwick questioned if the surety bond amount of $10,000 was enough. Mr. Morgan clarified that staff believed the amount was appropriate. 01-2926 Moved by Commissioner Jilka, seconded by Commissioner Divine, to pass Ordinance No. 01-10041 on first reading amending Chapter 8 of the Salina Code by adding an exception to Section 8-516, pertaining to Bonds Required under Article XVII Contractors/Tradesman Registration. Commission Action # yea -saga 01-29271 01-29281 01-29291 01-29301 (8.4) (A) Resolution No. 01-5723 authorizing the public sale of approximately $935,000 principal amount of General Obligation Temporary Notes, Series 2001-2 and approximately $5,470,000 principal amount of General Obligation Internal Improvement Bonds, Series 2001-A. (B) First reading Ordinance No. 01-10042 authorizing the issuance and delivery of $5,470,000 principal amount of General Obligation Internal Improvement Bonds, Series 2001-A. Rodney Franz, Director of Finance and Administration, explained that the Series 2001-2 Temporary Notes extend the temporary financing for Airport subdivision and Eastview Estates Phase III subdivision projects that were not completed in time to be included in the bond issue and financing would be extended to August 1, 2002. He continued to explain that approximately $1,570,000 will be repaid through special assessments, $280,000 from utility or impact fee, and $3,620,000 will be an at -large obligation payable from property taxes. Bonds will be issued for a term of 15 years and bond sale is scheduled for July 9, 2001. Mr. Franz explained that Ordinance No. 01-10042 authorizes the issuance and delivery of the bonds and provides that they are to be re -paid through the levy of future taxes and special assessments, a general obligation of the City, and that the City will comply with the Internal Revenue Code as it applies to tax-exempt obligations. He also explained the prepayment process and the at - large projects. Moved by Commissioner Divine, seconded by Commissioner Shadwick, to pass Resolution No. 01-5723 authorizing the public sale of approximately $935,000 principal amount of General Obligation Temporary Notes, Series 2001-2 and approximately $5,470,000 principal amount of General Obligation Internal Improvement Bonds, Series 2001-A of the City of Salina, Kansas. Aye: (4). Nay: (0). Motion carried. Moved by Commissioner Shadwick, seconded by Commissioner Jilka, to pass Ordinance No. 01-10042 on first reading authorizing the issuance and delivery of $5,470,000 principal amount of General Obligation Internal Improvement Bonds, Series 2001-A, of the City of Salina, Kansas.. Aye: (4). Nay: (0). Motion carried. (8.5) Resolution No. 01-5724 authorizing an agreement for T-1 broadband Internet access service. Jason Gage, Assistant City Manager, explained the four proposals that were received and that City Staff believed that Sprint's proposal provides the lowest cost service and best overall value. Moved by Commissioner Jilka, seconded by Commissioner Shadwick, to approve Resolution No. 01-5724 authorizing a three year agreement with Sprint for T-1 broadband Internet access service for annual cost not to exceed $12,871.20. Aye: (4). Nay: (0). Motion carried. None.
